    No full text

Zina in Consensual Non-Monogamous Relationships: A Comparative Legal Analysis between Indonesian and Islamic Law

    No full text
This article critically examines the emerging practice of swinger relationships in Indonesia, analyzing its legal implications under both Indonesian criminal law and Islamic criminal law. The primary objectives are to investigate the divergent regulatory frameworks concerning adultery in the context of consensual non-monogamous relationships within Indonesian criminal law and Islamic law, the sanctions prescribed by the Indonesian Criminal Code and Islamic ḥudud law; and the scope and nature of legal protections afforded to individuals engaged in swinger practices. Employing a qualitative research design with a phenomenological approach, this study analyzes primary sources such as the Indonesian Criminal Code (KUHP) and classical Islamic jurisprudence texts, alongside secondary sources comprising scholarly articles, legal commentaries, dissertations, and expert opinions. Data collection was conducted through a systematic literature review. The findings underscore fundamental distinctions between the secular orientation of Indonesian criminal law, which criminalizes adultery only when involving at least one legally married party and requires a formal complaint for prosecution, and the religiously anchored Islamic criminal law, which categorizes zina as a ḥudud offense with fixed divine penalties and stringent evidentiary standards. Legal protections under Indonesian law emphasize procedural safeguards and due process rights to prevent arbitrary prosecution, whereas Islamic law prioritizes the protection of individual honor (ḥifẓ al-‘irḍ) and social morality through rigorous evidentiary requirements and the prohibition of false accusations (qazf). Notably, Islamic legal provisions demonstrate substantive justice by exempting pregnant and nursing women from ḥudud punishments, reflecting considerations of humanity and equity. This research contributes novel insights into the complexities of harmonizing Indonesia’s secular criminal legal framework with its predominant religious values, particularly in addressing consensual non-monogamous sexual conduct such as swinger practices. It highlights the tension between evolving social behaviors and entrenched legal-religious norms, thereby informing ongoing debates on legal pluralism and human rights protections in Indonesian society

Evaluating the Arabic–Indonesian Translation Quality of ChatGPT on Quranic and Hadith Texts

    No full text
This study examines the reliability of ChatGPT in translating Arabic–Indonesian religious texts, addressing the concern that AI often struggles with culturally embedded, legal, and theological expressions as highlighted in recent translation studies. The issue is significant because Qur’anic and hadith texts carry normative meanings whose alterations may lead to doctrinal misinterpretation. Data were collected from ten Qur’anic legal verses and ten hadiths from al-Arbaʿīn al-Nawawiyyah, translated by ChatGPT using a standardized prompt. The translations were evaluated through Nababan et al.’s accuracy–acceptability–readability model by expert reviewers and general readers. Findings show that ChatGPT performs well in accuracy and readability but displays limitations in rendering legal terminology, cultural nuance, and doctrinally sensitive expressions. This research contributes empirical evidence on the strengths and risks of AI-assisted translation for Islamic texts and underscores the necessity of expert post-editing to ensure theological precision and culturally appropriate interpretation

From Melody to Modesty: The Semiotic Interplay of Sherine’s Abdel-Wahab's 'Kalam Eineh' and the Consumption of Abaya Trends on TikTok

    No full text
This article discusses the semiotic meaning in the song Kalam Eineh by Sherine Abdel Wahab and its relationship to the phenomenon of using abaya on the TikTok platform as part of popular cultural representation. This research is in the realm of cultural and semiotic studies, with the aim of revealing how popular music and traditional fashion play a role in shaping social and ideological meanings in the digital space. This topic was chosen because the abaya trend on TikTok reflects the negotiation between tradition, modernity, and religious identity, which until now has rarely been studied in depth. The method used is descriptive qualitative with Roland Barthes' semiotic analysis which emphasizes three layers of meaning, namely denotation, connotation, and myth. To strengthen the validity of the analysis, this study also uses theoretical triangulation through Appadurai's view of mediascapes, Giddens on agency and structure, and Hall on representation and negotiation of meaning. The results of the study show that at the level of denotation, songs represent romantic expressions, while abaya serves as clothing; at the level of connotation, both feature symbols of lifestyle, identity, and piety. Meanwhile, at the mythical level, the abaya has undergone a transformation into a popular culture icon that naturalizes the ideology of religiosity, modernity, and aesthetics in digital culture. This research contributes to the study of popular culture and media by emphasizing the relevance of Barthes' semiotic theory in reading contemporary cultural texts in the era of social media

Nonverbal Signs in the Qur’an: Integrating Theology, Semiotics, and Communication Studies

    No full text
This study explores the concept of sign language in the Qur’an as a universal form of communication rooted in human nature. Unlike previous studies focusing on verbal ethics in Islamic communication, this research highlights nonverbal expressions silence, gestures, and visual signs as legitimate and sacred forms of al-bayān (articulation of meaning). Through a qualitative-descriptive library research approach, the study employs thematic Qur’anic exegesis (tafsīr mauḍū‘ī), nonverbal communication theory as articulated by Ray L. Birdwhistell, and theological semiotics to analyze verses depicting prophetic gestures: prophet Zakariyya’s symbolic silence Surah Āli ʿImran verse 41; Surah Maryam verse 10, Maryam’s gesture toward prophet ‘Isa surah Maryam verse 26, prophet Musa’s radiant hand Surah Ṭaha verse 22, and the regulation of voice and conduct in communication Surah al-Ḥujurat verses 2–3. Findings reveal that nonverbal communication in the Qur’an functions not merely as an alternative to speech but as a divinely sanctioned medium of spiritual awareness and worship. Silence becomes a means of purification and surrender, gestures become extensions of divine will, and light serves as a visual symbol of divine truth. Theologically, this study affirms that al-bayān represents a holistic system of meaning (niẓām al-maʿnā), integrating verbal, paralinguistic, and nonverbal dimensions into a unified Qur’anic communication paradigm. The research contributes to Qur’anic communication studies by proposing a tauḥīdī framework in which silence, movement, and light operate as sacred languages of devotion and consciousness demonstrating that divine communication transcends speech and resonates within all dimensions of human expression

    No full text
This study employs a quantitative survey method with correlation analysis to investigate the influence of constructivist biology learning experiences, democratic attitudes, and learning independence on the learning motivation of high school students in Wajo Regency. The research utilizes Structural Equation Modeling (SEM) for path analysis to determine the direct and indirect effects among the studied variables. The population comprises all high school students in Wajo Regency, with a sample of 274 students selected through simple random sampling from three schools: SMAN 1 Wajo, SMAN 3 Wajo, and SMAN 7 Wajo. Data were collected using four validated instruments: a 35-item constructivist biology learning experience questionnaire, a 30-item democratic attitude questionnaire, a 49-item learning independence questionnaire, and a 30-item learning motivation questionnaire. Descriptive analysis reveals that the average scores for constructivist learning experience, democratic attitudes, learning independence, and learning motivation are 66.16%, 67.56%, 70.79%, and 72.35%, respectively. SEM results show that constructivist biology learning experiences positively influence learning motivation (path coefficient = 0.228), as does learning independence (path coefficient = 0.430). In contrast, democratic attitudes exhibit a significant negative influence on learning motivation (path coefficient = -0.645). These findings highlight the critical role of active, student-centered learning approaches and learner autonomy in enhancing motivation. Interestingly, the negative correlation between democratic attitudes and learning motivation suggests a complex relationship that may reflect contextual or cultural factors specific to the student population. This study contributes to the field of educational psychology by emphasizing the effectiveness of constructivist pedagogical strategies and the promotion of student independence in motivating learners. The results provide practical implications for educators and policymakers seeking to improve motivation and learning outcomes through the design of more effective instructional practices

Problem Based Learning Methods in the Digital Era: Measuring the Impact on Students Learning Motivation and Social Character

    No full text
This study examines the impact of the Problem-Based Learning (PBL) method on students’ learning motivation and social character development within the context of Islamic Religious Education (PAI). Reflecting Nelson Mandela’s assertion that education is the most powerful tool to change the world, fostering a supportive learning environment is especially vital in the digital era and the post-Covid-19 period, both of which have significantly affected student motivation and character formation. PBL emerges as a relevant and effective approach to meet these challenges. A mixed-methods design was employed, combining quantitative methods to measure key variables and qualitative methods for deeper insights through interviews and observations. Data collection involved 25 questionnaire items and 6 interview questions administered to educators and students, with a total of 128 survey respondents and 10 interview participants from SMAN 2 Bandung and MAN Cimahi City. Quantitative data were analyzed using descriptive statistics, while qualitative data were processed using Miles and Huberman’s framework, including data reduction, data display, and conclusion drawing. The results reveal that PBL positively influences learning motivation and supports the development of four key dimensions of social character: (1) religiosity, (2) worship, (3) responsibility, and (4) tolerance. Notably, SMAN 2 Bandung showed the greatest improvement in tolerance (3.71), whereas MAN Cimahi City excelled in the worship dimension (3.70). Overall, worship and tolerance were the most significantly affected aspects. These findings suggest that integrating PBL into PAI can enhance students' academic engagement and deepen the internalization of religious values. This study contributes empirical evidence that PBL fosters not only cognitive growth but also social and spiritual development, offering practical recommendations for educators and policymakers to create more effective, student-centered PAI learning models in a post-pandemic educational landscape
