Dear Mr. McAnulty: 
The U. S. Environmental Protection Agency (EPA), in consultation with the Montana Department of 
Environmental Quality (DEQ), is providing comments on the Butte Priority Soils Operable Unit (BPSOU) 
2022 Draft Final Insufficiently Reclaimed Sites Sampling: BRES No. 38 – Sister Dump Site Evaluation 
Summary Report (SESR) (December 31, 2024). Please address the comments below and resubmit the 
document for agency review. 
General Comments 
1. Existing cover soil cap thickness at IR sites needs to be discussed in all future site evaluation 
summary reports (SESRs). Inadequate soil cover cap thickness can be a cause of poor vegetative 
cover performance at BRES sites. 
2. There are XRF samples that provided indication that samples should have been submitted for 
laboratory confirmation analysis based on human health or waste identification criteria. This 
deviation needs to be acknowledged and discussed in the SESR, data summary report (DSR), and 
data validation report (DVR). See specific comments  
3. Given the particularly high lead results found in some of the IR and most of the UR samples, EPA 
looks forward to the remedial action work plan (RAWP) to address the metals exceedances, rills 
and gullies, baren conditions and the run-on/run-off of sediment transport. In the interim please 
provide and/or improve site best management practices (BMPs) to prevent sediment and surface 
water run-off. 
Specific Comments 
1. SESR, Section 3.1, New Data Summary: In the first bullet, EPA supports the conclusion that the IR-
38-SS-09 sampling location “be included in the proposed remedy for the site...” The XRF lead 
result for sample BPSOU-IR38SS09-102822-1 was +/-25% for IR sites of the Human Health Action

Level; therefore, this sample should have been submitted for laboratory analysis. Please 
acknowledge this here in this section as well as in the Data Validation Report deviations 
discussion. Similarly, based on Waste Identification Criteria, XRF samples BPSOU-IR38SS23-
102722-3 and BPSOU-IR38SS23-102722-4 (for zinc), and sample BPSOU-IR38SS28-102722-5 (for 
lead) should have been submitted for laboratory analysis. Please acknowledge this here in this 
section as well as in the Data Validation Report deviations discussion. 
2. SESR, Section 3.1, New Data Summary: In several locations in this section it is discussed that the 
IR XRF samples are compared to plus or minus 25% of the action level and criteria to determine 
which samples require laboratory analysis; however, UR samples are subject to plus or minus 35% 
window to determine samples that require laboratory analysis. Please add text discussing UR 
samples that required further laboratory analysis. 
3. SESR, Figure 1: Additional information is needed to be able to approve a boundary adjustment for 
this BRES site. Please confirm whether there is a small portion of the original BRES boundary 
within the property boundary of the residential property at 103 O’Neill Street. If the property is 
within the BRES Site boundary, please ensure that the residential sampling is completed under 
the Residential Metals Abatement Program for consideration by the Agencies. A small adjustment 
to the south boundary may also be necessary to correspond to existing property boundaries. 
4. SESR, Tables 5 and 6: The correct organic matter criterion is 1% or greater organic matter 
content. In Table 5, recent submittals for cover soil sources generally have native levels exceeding 
1% organic matter; whereas, when the original BHRS was written the Butte Landfill source has no 
organic matter. Thus, Footnote 1 in Table 5 (which applies to the Butte Landfill source) is now 
unnecessary and should be removed. Table 6 should be modified to highlight only the organic 
matter results less than 1%, not 1.5%. Please make these adjustments to Tables 5 and 6. 
5. Data Summary Report, Section 3.3, Data Quality Evaluation: At the end of the first paragraph, 
reference made to Field XRF to Laboratory Correlation and Regression Analysis Procedure for 
Unreclaimed (UR) and Insufficiently Reclaimed (IR) Sites. Prepared by Pioneer Technical Services, 
Inc. July 3, 2023, i.e., “Atlantic Richfield 2023c”. Comments on this analysis will be forthcoming. 
However, EPA believes the field XRF method being employed may not yield results of sufficient 
quality, even with regression coefficients applied, to predict whether the sample passed or failed 
pertinent action levels. This is primarily due to, among other factors, the limitations of the sample 
preparation and analytical method being employed (i.e., analyzing samples through the sample 
bag) which is inherently a screening-level XRF method. That said, EPA believes it may be possible 
to reduce the plus or minus 25% of the pertinent action level window for IR samples (plus or 
minus 35% for UR samples) using statistical analysis. Please modify the last sentence of the first 
paragraph to read: “…currently under Agency review and consideration (Atlantic Richfield 
Company, 2023c), but have not been approved at this time.” Additional discussion  
6. Data Summary Report, Section 4.0, Second Bullet: The text states that the completeness for the 
IR QAPP samples was 75%. Section 4.5 of the Data Validation Report in Attachment A states that 
the completeness for IR QAPP samples was 85.7%. Please clarify this discrepancy or update the 
completeness percentages. 
7. Data Summary Report, Section 4.5.2, Laboratory Completeness: Paragraph 2 states that “Per the 
2022 IR Sites QAPP, five natural samples requiring laboratory confirmation were sent to the 
laboratory. Per the 2022 UR Sites QAPP, two natural samples requiring laboratory confirmation

were sent to the laboratory. Four additional natural samples were sent to the laboratory as field 
QC or at the discretion of the field team leader.” The samples described here only account for 11 
of 12 samples sent to Pace. Please verify these numbers. 
8. Data Summary Report, Figure 1: Please identify all markings in the legend (e.g., purple, orange).
Please continue to expedite the review and submittal of evaluation summary reports for these BRES 
sites where data was collected in 2022. Please provide EPA with a status update for the remaining 
SESRs to be submitted. If you have any questions or concerns, please call me at (406) 438-0826.

Atlantic Richfield Company (Atlantic Richfield) and Montana Resources, LLC (MR) (collectively ‘the 
Parties’) submit this July 2025 monthly report to satisfy the requirements of the updated Final Berkeley 
Pit Waterfowl Protection Plan (Plan) dated August 4, 2021, which was approved by the Agencies on 
September 1, 2021. 
 
Observations at the Berkeley Pit (Pit) for waterfowl protection efforts continued during July 2025 in 
compliance with the Plan. During July 2025, a total of 98 individual observations were conducted, 
documenting 265 waterfowl. Waterfowl Observation Logs and Hazing Logs for July 2025 are included 
with this report. 
 
Submission of this report does not constitute a statement by Atlantic Richfield or MR concerning 
responsibility between them for any identified tasks or a statement by Atlantic Richfield or MR that any 
specific task is required to comply with any existing agreement.

The U. S. Environmental Protection Agency (EPA) in consultation with the Montana Department of 
Environmental Quality (DEQ) has reviewed and is conditionally approving the Clark Tailings 
Consolidated Waste Management Area Site Investigation Quality Assurance Project Plan Revision 0 
(2025 Update) and Response to EPA Comments (dated February 27, 2025). Please address the 
comments within the attached EPA QAPP crosswalk distribute this QAPP as final.
