Protección al consumidor y menores: el TJUE refuerza la defensa contra cláusulas abusivas en contratos deportivos
Full text linkThe judgment of the Court of Justice of the European Union (CJEU) of March 20, 2025, in case C-365/23 (Arce) marks a significant step forward in protecting minors in contractual agreements. The case involves a contract between a minor represented by their parents and a sports development company, in which the minor’s future income is pledged. The CJEU\u27s ruling extends the scope of Directive 93/13 on unfair terms to contracts signed by minors, even when they are not yet professional, and emphasizes the importance of judicial review of clauses that may cause an imbalance between the parties, especially when the terms are not adequately explained. This judgment reinforces consumer protection, particularly for vulnerable groups such as minors, by ensuring that they are not subjected to abusive clauses that can affect their long-term interests.La sentencia del TJUE de 20 de marzo de 2025 en el asunto C 365/23 (Arce) constituye un avance significativo en la protección de los menores en el ámbito contractual. El fallo extiende la aplicación de la Directiva 93/13 a los contratos celebrados por menores representados por sus padres, especialmente en el contexto deportivo, donde las cláusulas económicas pueden tener efectos a largo plazo sobre el futuro de los jóvenes. La información sobre la lógica aplicada en el credit scoring automatizado: fácil, concisa y sin tecnicismos
Full text linkOn 27 February 2025, the CJEU delivered its judgment in Dun & Bradstreet (Case C-203/2022), interpreting for the first time the scope of the data subject’s right to obtain “meaningful information about the logic involved” in automated individual decision-making [Art. 15(1)(h) GDPR], such as a credit score. This information must be comprehensible, accessible, and free of technical jargon, enabling the data subject to understand which personal data were used and how they influenced the outcome. The Court also held that data controllers cannot invoke trade secrecy to refuse access to such information. Although the judgment focuses on transparency obligations, it indirectly brings to light one of the most pressing risks of automated credit scoring: algorithmic discrimination. This article warns that sociodemographic data—such as place of residence—though statistically correlated with default risk, may not reflect an applicant’s actual creditworthiness and may lead to discriminatory outcomes. To prevent this, the article argues that automated credit scoring systems should rely exclusively on data that directly reflects the individual’s financial capacity to perform the contract.La STJUE de 27 de febrero de 2025, asunto C-203/2022, Dun & Bradstreet, interpreta por primera vez el alcance del derecho del interesado a obtener “información significativa sobre la lógica aplicada” a decisiones individuales automatizadas [art. 15.1 h) RGPD], como un score de solvencia. Esta información debe ser comprensible, accesible y libre de tecnicismos, permitiendo al interesado entender qué datos se usaron y cómo influyeron en el resultado. Además, el Tribunal rechaza que el responsable del tratamiento pueda escudarse en el secreto comercial para denegar esa información. Aunque la sentencia se centra en la transparencia de la información, indirectamente saca a la luz uno de los mayores problemas derivados del credit scoring automatizado, esto es, la discriminación algorítmica. Así, el presente artículo alerta de que los datos sociodemográficos, como el domicilio, aunque estadísticamente correlacionados con el riesgo de impago, pueden no reflejar la solvencia real del solicitante y dar lugar a decisiones discriminatorias. Para evitarlo, se defiende que los procesos de credit socring automatizado deberían basarse exclusivamente en datos que reflejen la capacidad financiera individual del interesado para cumplir el contrato
III Estadísticas de las TAE y precios medios aplicados a los micropréstamos (2025)
Full text linkThe doctrine on usury established by the Spanish Supreme Court, since the judgment of 11.25.2015, provides for resorting to the statistics of the Bank of Spain to determine what is the normal interest rate of money (for the purposes of article 1 of the Spanish Usury Law). In addition, since STS 4.3.2020, the Spanish Supreme Court has been insisting that the average interest rate that must be taken from the statistics used as a reference must be that of the specific market of the product. However, in terms of non-mortgage loans of non-banking lenders, there are no public statistics since non-banking lenders are not reporting entities according to Circular 1/2010, nor are they subject to prior registration. Consequently, we intend to reflect the average rates and prices applied to payday loans, with updated data for the entire 2024 financial year, as well as demonstrate that the APR is not an indicator able to represent the onerousness of a payday loan, due to the exponential effect caused by the frequency of payments incorporated by its formula.La doctrina en materia de usura sentada por el Tribunal Supremo, desde la sentencia de 25.11.2015 (RJ 2015\5001) prevé recurrir a las estadísticas del Banco de España para determinar cuál es el interés normal del dinero (a efectos del art. 1 de la Ley de Usura). Además, a partir de la STS 4.3.2020 (RJ 2020\407), el Alto Tribunal viene insistiendo en que el tipo medio de interés que ha de tomarse de las estadísticas que se usen como referencia, tiene que ser el del mercado específico del producto controvertido. Sin embargo, en materia de préstamos no hipotecarios extrabancarios, no existen estadísticas públicas ya que los prestamistas no entidades de crédito no son entidades declarantes según la Circular 1/2010, ni están sujetos a registro previo. En consecuencia, nos proponemos reflejar los tipos y precios medios aplicados a los micropréstamos, con datos actualizados para todo el ejercicio 2024, así como demostrar que la TAE no es un indicador que permita representar la onerosidad de un micropréstamo, por el efecto exponencial que provoca la frecuencia de pagos que incorpora su fórmula
Processos de gentrificação e turistificação em “áreas tensionadas” de cidades médias em Catalunha
Full text linkThe processes of gentrification and touristification are closely linked and present in both large and medium-sized cities, with the increase in demand for housing and its transformation into tourist accommodation, under new urban planning logics that profoundly impact urban morphology and the daily lives of their residents. This is what is evident in Catalan medium-sized cities and their "stressed residential market areas" (Law 12/2023 on the right to housing), which are suffering from abusive increases in rental and purchase prices, reducing their residents\u27 access to this basic necessity. This research aims to analyze this problem in medium-sized non-metropolitan cities in the Autonomous Community of Catalonia (Spain) by assessing citizen perceptions, price trends compared to household income, and the increase in the Consumer Price Index (CPI). It also includes case studies that confirm how the associated processes of gentrification and touristification contribute to rising housing and rental prices.Los procesos de gentrificación y de turistificación están estrechamente vinculados, y presentes tanto en grandes ciudades, como en ciudades medias, con el aumento de la demanda de viviendas y su transformación en alojamientos turísticos, bajo nuevas lógicas urbanísticas que impactan profundamente en la morfología urbana y en el cotidiano de sus residentes. Es lo que se constata en las ciudades medias catalanas y sus “zonas de mercado residencial tensionado” (Ley de 12/2023 por el derecho a la vivienda) que sufren el incremento abusivo de los precios del alquiler y de la compra de viviendas, reduciendo las posibilidades de acceso a este bien de primera necesidad, a sus residentes. Esta investigación tiene por objetivo analizar esta problemática en ciudades medias no metropolitanas de la Comunidad Autónoma de Cataluña (España), mediante la valoración de la percepción ciudadana, la evolución de los precios en comparación con la renta familiar y el incremento del IPC, y de estudios de casos específicos que confirman como los procesos de gentrificación y turistificación asociados contribuyen al incremento de los precios de la vivienda y del alquiler.Os processos de gentrificação e de turistificação estão intimamente vinculados, e presentes tanto nas grandes cidades como nas cidades médias, com o aumento da demanda de habitações e a sua transformação em alojamentos turísticos, sob novas lógicas urbanísticas que impactam profundamente na morfologia urbana e no cotidiano dos seus residentes. É o que se constata nas cidades médias catalãs cujas “zonas de mercado residencial tensionadas” (Lei de 12/2023 pelo direito à habitação) sofrem com o aumento abusivo dos preços de aluguer e de compra de habitações, reduzindo as possibilidades de acesso a este bem de primeira necessidade a seus residentes. Esta pesquisa visa analisar este problema nas cidades intermédias não metropolitanas da Comunidade Autónoma da Catalunha (Espanha), mediante da avaliação da percepção dos cidadãos, da evolução dos preços em comparação com o rendimento familiar e o aumento do IPC, e de estudos de casos específicos, que confirmam como os processos de gentrificação e de turistificação contribuem para o incremento dos preços das habitações e dos aluguéis
Cidades médias e o processo de aglomeração urbana: considerações a partir das dinâmicas demográficas recentes em realidades não metropolitanas do Brasil
Full text linkThis text aims to foster debate on the process of urban agglomeration within the context of intermediate cities. To this end, data and studies from the Instituto Brasileiro de Geografia e Estatística (IBGE) were examined, alongside an analysis of demographic trends based on the most recent intercensal period (2010-2022). The findings highlight significant aspects for discussions on the topic, as they reveal a trend of accelerated demographic growth in smaller municipalities within agglomerations compared to the main core. In light of this, it is crucial to pay attention to the ongoing transformations, as they significantly impact dynamics related to both territorial continuity - of urban areas - and spatial - related to spatial interactions. These aspects are essential for analyses and discussions aimed at the theoretical and conceptual construction concerning medium-sized cities, as well as for understanding the urban dynamics of Maringá, Presidente Prudente, and São José do Rio Preto, which are examined in depth in the present study.Este texto tiene como objetivo fomentar el debate sobre el proceso de aglomeración urbana en el ámbito de las ciudades intermedias. Para ello, se realizó un levantamiento de información a partir de estudios y bases de datos del Instituto Brasileiro de Geografía e Estatística (IBGE), así como un análisis de la evolución demográfica durante el último período intercensal (2010-2022). Los resultados señalan aspectos relevantes para las discusiones sobre el tema, ya que evidencian una tendencia al aumento del ritmo de crecimiento demográfico de los municipios más pequeños que forman parte de las aglomeraciones, en comparación con el núcleo principal. En este sentido, es fundamental prestar atención a las transformaciones en curso, dado que impactan significativamente en las dinámicas asociadas a la continuidad territorial - de las áreas urbanas - y espacial - en relación con las interacciones espaciales. Estos aspectos resultan fundamentales para los análisis y debates orientados a la construcción teórica y conceptual sobre las ciudades intermedias, así como para la comprensión de las dinámicas urbanas de Maringá, Presidente Prudente y São José do Rio Preto, las cuales son examinadas en profundidad en el presente estudio.Este texto tem como objetivo suscitar o debate a respeito do processo de aglomeração urbana no âmbito das cidades médias. Para tanto, foi realizado um levantamento de informações junto a estudos e bases de dados do Instituto Brasileiro de Geografia e Estatística – IBGE, bem como uma análise da evolução demográfica a partir do último período intercensitário (2010-2022). Os resultados apontam para aspectos importantes para as discussões sobre o tema, uma vez que evidencia uma tendência de aumento do ritmo de crescimento demográfico dos municípios menores que compõem as aglomerações em relação ao núcleo principal. Diante disso, é necessário se atentar para as transformações em curso, uma vez que impactam significativamente nas dinâmicas atreladas à continuidade territorial – das áreas urbanas – e espacial – quanto às interações espaciais. Tais aspectos revelam-se fundamentais para as análises e debates voltados à construção teórica e conceitual acerca das cidades médias, assim como para a compreensão das dinâmicas urbanas de Maringá, Presidente Prudente e São José do Rio Preto, as quais são examinadas em profundidade no presente estudo.
Percepción de los orientadores sobre el aprendizaje basado en juegos y los juegos serios en sesiones de tutoría [Counsellors’ perception about game-based learning and serious games in tutoring sessions]
No full textThis study investigates the use and understanding of game-based methodologies, such as Game-Based Learning (GBL) and Serious Games, among educators in León and its surrounding areas. The sample of 34 educators reveals a limited use of these tools in tutoring sessions. The results indicate that 26.5% are male and 73.5% are female, with the majority being over 50 years old. There is evidence of a poor understanding of Serious Games creation and preparation. Although some educators use GBL and Serious Games, they primarily do so to engage students\u27 interest. Greater familiarity with these methodologies is recommended to enhance motivation and academic performance. This study underscores the importance of GBL and Serious Games in secondary education and academic guidance.Esta investigación aborda el uso y conocimiento de metodologías basadas en juegos, como el Aprendizaje Basado en Juegos (ABJ) y los Juegos Serios, entre orientadores de León y sus alrededores destacando su importancia en la Educación Secundaria y la orientación académica. Se realiza un análisis descriptivo con una muestra de 34 orientadores. Se observa predominio del conocimiento sobre ABJ frente a Juegos Serios; el 65% carecen de formación específica. El ABJ se utiliza ocasionalmente, por su efecto positivo sobre el interés del alumnado. La implementación limitada del ABJ se asocia a falta de formación y recursos. Existe interés por en recibir formación y se reconoce el ABJ como motivante. Es una herramienta educativa prometedora pero infrautilizada. La formación docente es clave para su aplicación en la tutoría. Se sugiere fomentar el ABJ en Planes de Acción Tutorial y profundizar en la motivación de los orientadores.

Abstract:
This research addresses the use and knowledge of game-based methodologies, such as Game-Based Learning (GBL) and Serious Games, among counsellors in León and its surroundings, highlighting their importance in Secondary Education and academic guidance. A descriptive analysis was carried out with a sample of 34 counsellors. Knowledge about ABJ is predominant over Serious Games; 65% lack specific training. The ABJ is used occasionally, due to its positive effect on the interest of the students. Limited implementation of the ABJ is associated with a lack of training and resources. There is interest in receiving training and the ABJ is recognized as motivating. It is a promising but underutilized educational tool. Teacher training is key to its application in tutoring. It is suggested to promote the ABJ in Tutorial Action Plans and to deepen the motivation of the counsellors.

In there you can, and sometimes must, deposit the historical documentation of both the Curia and the parishes, as well as all those entities that, by their nature, were born under the mantle of the Catholic Church of Albacete.El Archivo Histórico Diocesano de Albacete es el guardián de la memoria de nuestra iglesia particular, la albaceteña. En él se puede y, en ocasiones se debe, depositar la documentación histórica tanto de la Curia como de las parroquias, así como de todas aquellas entidades que, por su naturaleza, nacieron bajo el manto de la Iglesia Católica de Albacete. En el presente artículo trataremos de explicar la pequeña gran historia de nuestro Archivo, sus características, su fondo documental y el servicio que presta, así como las líneas de investigación que ofrecen esos fondos

Análisis bibliométrico de estudios relacionados con la educación musical en Educación Infantil [Bibliometric analysis of studies related to music education in Early Childhood Education]

The sample is delimited by the articles published in Web of Science and Scopus between 2000 and 2023, which represents a total of 670 articles, 343 journals, 11045 references, 1362 authors and 1769 keywords. The method is quantitative and the techniques used include citation analysis, co-citations, co-occurrences and scientific mapping. The results show: an exponential growth of studies on this subject; the relevance of Spain in this context, as it is the country with the second highest scientific productivity; and the fact that the most cited articles belong to the field of psychology, although those that publish the most articles belong to the field of music education. Finally, there are three main research topics: music therapy/special education; psychological development and learning; and musical methodology, training, technology and creativity.El presente trabajo pretende cuantificar la producción científica referente a la educación musical en Educación Infantil. La muestra está delimitada por los artículos publicados en Web of Science y Scopus entre 2000 y 2023, lo que supone un total de 670 artículos, 343 revistas, 11045 referencias, 1362 autores y 1769 palabras clave. El método es cuantitativo y entre las técnicas utilizadas destaca el análisis de citaciones, co-citaciones, co-ocurrencias y mapeo científico. Los resultados muestran: un crecimiento exponencial de estudios sobre esta temática; la relevancia de España en este contexto, pues se sitúa como segundo país con mayor productividad científica; y la pertenencia de los artículos más citados con el ámbito de la psicología, aunque las que publican más artículos pertenecen al ámbito de la educación musical. Por último, se advierte la existencia de tres grandes temáticas investigadas: musicoterapia/educación especial; desarrollo psicológico y aprendizaje; y metodología musical, formación, tecnología y creatividad.
