The idea for the translation of the meaning of the Holy Quran in Malay Archipelago had appeared since the middle of 17th century. However, some problems in the translation of its meaning had resulted in a non-accurate translation of Quranic words or verses. A major factor contributing to this problem is the limited skills among the translators in the various fields and topics covered in Quran. Thus, a Review Committee for the Translation of the Meaning of Al-Quran consisting of experts in various field of knowledge related to Quran such as Arabic language, the target language, Quran interpretation and other disciplines such as history, geography, chemistry, biology, medicine and others that have been proposed. This article analyses two Malay translations of Holy Quran; Tafsir Pimpinan ar-Rahman and Tafsir Quran Karim guided by science-oriented exegesis (tafsir ‘ilmi) to find out whether the translation of meaning matches modern scientific facts. The accurate translation of the verse will then be proposed. The result revealed limitation in the translation of the meaning for the word adna Al-Ard to “nearest place”, while the word has various meaning. With regard to the interpretation of the mufassir and modern science fact, the suggested meaning for the word adna Al-Ard is supposed to be “the nearest place with lowest altitude”. Cite as: Hilmi, A.B.A., Mohd Yusoff, Z., Amir, S., & Zakaria, Z. THE INFLUENCE OF SPELL-CHECKERS ON STUDENTS’ ABILITY TO GENERATE REPAIRS OF SPELLING ERRORS

Recent studies show that spell-checkers help reduce students’ surface errors in writing by flagging spelling errors and giving correct spelling suggestions. This study investigates if the error correction provided by the spell-checker tool in word processors are internalized by students. A quasi-experimental two-group study was conducted on 30 Form 1 students in a school in Kuching, Sarawak.  The learners were given dictations which contained words listed as commonly misspelled words according to Oxford University Press (2012). The experimental group were given three dictations- one in which they used word processors and allowed to use the spell-checker tool and the control group was given two dictations, both handwritten. The data gathered were analysed using a software for statistical analysis. This study found that, while the spell-checker helped the learners revise their spelling on one dictation exercise, learners still made the same errors in their spelling after the use of spell-checkers. Therefore it argues that while spell-checkers help eliminate surface errors, they have very little influence on correcting the errors on the cognitive level. Keywords: Spell-checkers, word processors, error correction, dictation, spellingCite as: Rimbar, H. This Article explores the involvement of the Malay Rulers in institutionalizing the Constitution of the Federation of Malaya 1957. It aims to examine the validity of the popular statement that claims the Federal Constitution is the end-result of a social contract negotiated among the multi-ethnic society championed by the elite nationalists in Malaya. It further examines the allegation that the sovereignty of the Malay Rulers and the power of the state governments had been retained by the British due to the demand fought by the above group. This qualitative research uses primary sources collected from the historical records and presented in legal history design. The findings show that the Malay Rulers are the supreme authority in institutionalizing the Constitution of the Federation of Malaya 1957 upon consultation with the Constitution Working Committee for the establishment of a single independent self-governing unit for a Federation. It concludes that the legitimacy of the Constitution of the Federation of Malaya 1957 originates from the sovereignty of the Malaccan Sultanate, its local conditions have been entrenced in the fundamental provisions of the said Constituton, and they are stil preserved to date.  Keywords: Institutionalization, sovereignty, legacy, independance, social contract.Cite as: Wan Hussain, W.A.F., Che Ngah, A., Anwar, Od. EVOLVING A CONSENT-BASED SEXUAL ENCOUNTER

    Get PDF
Recently, the news media have been saturated with reports of sexual assault of women by men of high social status. In this article, the author examines sexual abuse from an evolutionary and socio-psychological perspective. The piece is based on a desk research (as opposed to a field research). It draws upon evolution as well as literature on human and animal behaviour, so as to re-examine how men may have evolved psychological mechanisms that compel them to sexually dominate women. Of particular concern to the author is the mating game apparently inherited from the lower animals. The article questions the persistence in modern society of such primitive attitude towards sexual relationship between men and women. Finally, it calls for further discussion and research enquiry about the human socialization process as a way of deconstructing the prehistoric mating game. While the issues highlighted in this paper are global in nature, they are pertinent to the Asian context – where there have been widespread reports of sexual abuse against women. It is important for readers in the South East Asian region to be informed of such transnational perspective on this world-wide phenomenon. Keywords: Gender, mating game, rape, sex in animals, sexual abuseCite as: Ibhakewanlan, J.O. Get PDF
The objectives of this paper are three folds: firstly, to highlight the studies which have used documentary film as authentic input in teaching second language skills, secondly to review the studies which have used documentary film in enhancing the second language writing skill, and lastly to offer ways to deal with documentary film in improving Arabic as a Second Language (ASL) writing skill. For this purpose, the paper analyses related literature review and previous studies in the field. The literature review shows the concern of second language practitioners as well as scholars in the field in using documentary film in the learning process. However, studies related to ASL are very scarce. There are four steps to be adopted for the purpose of linking documentary film input with enhancing writing skills output. The paper also highlights the strengths of documentary film as authentic input in language teaching as well as putting forth some technical advice and suggestions to improve the selection of teaching materials. Keywords: TASL, teaching material, Arabic for specific purposes, Arabic writing skill, authentic inputCite as: Tg Abdul Rahman, T.A.F, Chik, A.R., Sahrir, M.S., & Nordin, M.S. A COMPARATIVE ANALYSIS OF RETRIBUTIVE JUSTICE AND THE LAW OF QISAS

    Get PDF
Discussion on penology generally revolves around the philosophy behind the ‘punishment’ and its ‘implementation’ in order to maintain a crime-free, harmonious society. To understand the philosophy of the major school of thoughts for punishment, this paper discusses the theory of retributivism as a punishment mechanism and relates it to Qisas - the theory of punishment that hinges on Islamic criminal law jurisprudence. The objective of this paper is to compare the retributive concept of punishment with the Islamic theory of Qisas and to unravel how Islam attempts to establish justice through punishment while implementing forgiveness. It is significant to note that we can find a nexus between the retributive and Qisas school of theory that perpetrators should be punished as a consequence of the crime or an act that is against norms of the community. Nonetheless, this paper concludes that Qisas is quite distinct from the concept of retributivism in the case of punishment. Whereas the core of the retributive justice system is to put the moral blame on the offender for the offence and to provide justice through similar punishment; the law of Qisas is more concerned with the fairness and forgivingness. Keywords: Forgiveness, Islamic criminal law, punishment, retributive justice, QisasCite as: Karim, R., Newaz, S., & Kabir, A.I.

COVERING UP AND SPEAKING UP! A RHETORICAL ANALYSIS OF HIJABI NARRATIVES

    Get PDF
In the debate concerning the state of women in Muslim societies, scholarly literature on the hijab or the Muslim dress code is often relayed by observers and not by those who enact the religious obligation. Post 9-11 and recent developments on both the local and global stage have heightened the focus on Islam and its followers. Hate, Islamaphobic, and extremist rhetoric have unfortunately overwhelmed the moderates. This state of exigency needs to be addressed. Focusing on Muslim women and the hijab, this paper attempts to address the hegemonic discourse on the dress code while bringing to the fore the narratives on hijab from personal conversations as well as texts from the media. Using bell hook's enactment as a rhetorical option and standpoint theory as a theoretical framework, this study seeks to contribute to existing literature by highlighting the voices of moderate, conscious, and practicing Muslim women who offer their views on the hijab. In expressing their faith and their practice of hijab, the women indirectly contribute to the act of da'wah while demonstrating their agency. Conversations with the women in this study revealed that the act of hijab for them correlates with the notion of agency, emancipation, and self-reward. Keywords: Standpoint Theory; Enactment; Rhetoric; Narratives; Malaysian Women - hijabis.Cite as: Mat Nayan, S. Family and marital disputes are commonly heard cases in our daily lives. The trial courts and the alternative resolution methods may be used for the parties involved in the disputes to settle their problems. This paper reviews the aspects of the legal provisions concerning the jurisdiction of courts (civil and Syariah) and also the alternative dispute resolution methods. Some of the proposed alternative methods are arbitration, mediation, and sulh. These alternative resolution methods may be used to avoid the tedious court processes and to reduce the cost of settling the disputes. The alternative methods are strongly encouraged in Islam and there are clear guidelines in Malaysia regarding the ways to employ the alternative methods. The use of the alternative methods is effective as reflected in the number of cases which have been succesfully solved using the methods. This paper concludes that Muslim community in Malaysia has the convincing options to resolve their family / marital disputes either in courts or through the alternative resolution methods.  Keywords: Syariah Court, Alternative Dispute Resolution, Sulh Council, Arbitration, Mediation.Cite as: Dahlan, N.K., Palil, M.R., Abdul Hamid, M., & Yaakub, N.I.
