    No full text
The study examined the jurisdictional issues and influence of the operations of anti-corruption agencies [Nigeria Police Force (NPF), Independent Corrupt Practices and Other Related Offences Commission (ICPC) and Economic Financial Crimes Commission (EFCC)] with a view to identifying the challenges and opportunities in their interactions. Structural-Functional and Public Choice Theories were adopted as theoretical framework while qualitative research design was utilized. Primary and secondary sources of data were employed. The primary data were obtained through Key Informant Interviews (KIIs). Eighteen (18) KIIs were conducted purposively with selected officials of the NPF, ICPC and EFCC. Secondary sources of data included the use of textbooks, journals, Acts of the agencies, etc. Data were analyzed using thematic content analyses. Findings revealed that although the interaction of these agencies caused local frictions, but were influenced through collaboration, threshold and coordination mechanisms for intelligence gathering in combating corruption. The study concluded that jurisdictional issues between the NPF and the specialized agencies have had mixed consequences. While conflicts between the NPF and the specialized agencies have occurred, there have also been synergy in their operations. The paper recommended that the agencies should streamline their operations and embrace consensus driven anti-corruption policies and practices in Nigeria. &nbsp

COMBATING DOMESTIC VIOLENCE: DEVELOPING LEGISLATIVE AND SOCIO-ORGANIZATIONAL MEASURES TO PROTECT WOMEN IN KAZAKHSTAN

    No full text
Domestic violence remains a widely prevalent issue worldwide. International organizations recognize the necessity of improving the legislative framework to prevent domestic violence and protect victims. However, the application of only legislative measures will not change the situation in countries where domestic violence against women is common, based on the patriarchal understanding of women’s role in society. This article explores the possibility of applying measures to combat domestic violence at the current stage of Kazakhstan\u27s development. Special attention is given to evaluating the effectiveness of these measures. The purpose of the article is to assess the possibility of using legislative, organizational, educational, informational, and technological measures to combat domestic violence from the perspective of their applicability in Kazakhstan. This study proposes measures to improve the legal system, including legislative and socio-organizational measures, to prevent domestic violence and support victims

REFORM OR TRANSFORM: THE RISE OF CHINA’S NATIONAL SUPERVISION SYSTEM

    No full text
China’s 2018 constitutional adoption of the National Supervision Commission marked a watershed in the country’s supervision system and anti-corruption work. This article seeks to investigate the power dynamics between the state machinery and the Chinese Communist Party as the newly supervisory power has come into being. It delves into the National Supervision Commission’s origins, mandate, structure, and potential impacts on China’s political sphere. It suggests that the emergence of the National Supervision Commission is a testament to the consolidation of the Chinese Communist Party control, potentially contradicting earlier attempts to separate party and state functions. This institutional novelty represents a paradigm change. The article proposes a nuanced understanding of the National Supervision Commission, considering both its potential to strengthen party authority and its bifurcated relationship with other state bodies

THE IMPACT OF SELECTED SOCIAL INDICATORS ON INDIVIDUAL HAPPINESS IN THE REPUBLIC OF NORTH MACEDONIA

    No full text
Happiness as a complex combination of individual, collective, affective, rational, and circumstantial constituents is either integrated or should be integrated in the policy-making of modern states and societies, in line with the global endeavor towards achieving sustainable development goals. Given the social relevance of happiness, the most broadly accepted relevant indicators for its attainment, and the great gap that exists due to insufficient empirical treatment of the matter in North Macedonia, this exploratory paper aims to determine the impact of age, gender, health, unemployment, religion, ethnicity (by spoken language), and language-based discrimination on individual happiness in the Republic of North Macedonia. The research was based on descriptive statistical operations and regression analysis of the ESS 10 data regarding the Republic of North Macedonia, obtained for the first time for this country; as well as on secondary analysis of studies considering wide-range surveys, statistical data and reports. Health, employment, ethnicity, and ethnic and linguistic discrimination represent strong determinants of happiness in this country. Indications are high that age and happiness are linearly correlated. The gender is less important in defining happiness in North Macedonia; however, women are slightly happier than men. The majority population, speaking the Macedonian language and practicing Orthodox Christianity, experience higher levels of happiness than the linguistic and religious native minorities in North Macedonia. Further in-depth research based on consistent and compatible data is needed, to the end of advancing research-based policies in the social, economic and healthcare systems of this county

LEGAL LOOPHOLES IN PYRAMID AND PONZI SCHEME REGULATIONS: A CAUTIONARY TALE FROM ALBANIA TO INDONESIA

    No full text
This paper examines the legal loopholes and regulatory measures taken in response to pyramid and Ponzi schemes, specifically analyzing the lessons learned from Albania\u27s financial crisis in the 1990s and what insights Indonesia can learn. The collapse of these schemes in Albania, which had a catastrophic effect on the economy and triggered an entire social and political crisis, exposed significant measures in governance negligence, financial supervision, legal frameworks, and understanding of investments. Through an in-depth examination of the Albanian catastrophe experience, this paper examines the legal framework in terms of inadequate regulations, government negligence due to lack of experience handling Ponzi and pyramid scheme issues, and lack of investment literacy. The paper explores how Indonesia can enhance its legal and regulatory environment by drawing lessons from Albania\u27s mistakes in the past. Suggestions involve strengthening financial authority roles, establishing specific regulations to regulate pyramid and Ponzi schemes, and providing comprehensive investment literacy education for investors. This study highlights the significance of legislative reform and efficient governance to prevent financial schemes that take advantage of legal loopholes and uneducated investors, ultimately leading to a more resilient and stable financial system. By examining Albania\u27s experience, Indonesia may establish a proactive strategy to protect its citizens and economy from the dangers of pyramid and Ponzi schemes

THE CONDITIONS OF APPARENT AUTHORITY FROM A COMPARATIVE PERSPECTIVE

    No full text
This research examines the concept of apparent authority, a legal doctrine that can hold a principal liable for the unauthorised actions of an agent. Despite a person’s lack of expressed desire for representation or an agent’s deviation from instructions, the ordinary legal consequences of representation can still apply if the conditions of apparent authority are established. This research adopts a comparative approach, analysing the criteria for applying apparent authority across civil law and common law legal traditions, as well as in soft law instruments. Lithuania, with its explicit legal provisions on apparent authority, serves as the primary jurisdiction of this analysis. By examining the interpretation of the individual conditions of apparent authority, this research seeks to determine how to ensure balanced protection of the interests of the parties involved in agency relationships (i.e. the principal, the agent and the third parties)

FROM LIBERAL PEACE TO LOCAL PEACE: TRANSDISCIPLINARY THEORETICAL APPROACHES

    No full text
The peace research turn from approaches of liberal peace to those of post-liberal and local requires an understanding of the conceptual and theoretical foundations on which both of these approaches were built. This paper seeks to overcome the conceptual gaps and cognitive misperceptions between these two approaches. This paper began with a preliminary introduction of the uses of the definition of the concept of peace focusing on studying the intertwined conceptual relationships. In its second phase, this paper will attempt to analyze the levels of interaction between local and liberal peace by showcasing the limitations of the perspectives concerning the liberal practices of peacebuilding. In the third stage, the paper suggests a procedural and conceptual key point for crossing between local and global levels

POLISH MILITARY DIPLOMACY CONCERNING UKRAINE IN 2022-2024: BETWEEN CENTRISM AND PERIPHERALITY OF DIRECTION

    No full text
The article is devoted to a comprehensive study of the approaches, principles, and measures of the political and military leadership of the Republic of Poland in the field of military diplomacy, the importance of which increased in 2022-2024, when the Russian Federation carried out a large-scale invasion of Ukraine, which changed the hybrid war into a modern total war. The research methodology is based on objectivity and historicism, within which the principles of generalization, analysis and synthesis, statistical method, as well as retrospective and systemic approaches were applied. The article for the first time comprehensively reflects the main practical approaches and decisions of Polish political, diplomatic, and military leaders against the background of geopolitical, geo-economic, and socio-cultural processes in Eastern Europe at the present stage. Having understood the Russian threat, the Polish political leadership chose the path of resistance in the diplomatic, military, and economic spheres. The diplomacy of official Warsaw operated within the framework of Polish strategic interests, the intentions of leading NATO countries in Central Europe, and Ukrainian national interests.  It has been determined that as a result of the influence of the alliance, represented by Washington and Berlin, which is based on an unnatural reaction to the Russian information attack on the use of nuclear weapons and refusal to openly confront the axis of evil (Russia, North Korea, Iran and its proxy, China), Polish politicians are gradually avoiding placing the Ukrainian case in the center of security structures, leaning towards classifying it as peripheral. This change in the approaches of the Polish leadership is caused by the demands of the allies, who fear the transformation of the Russo-Ukrainian War from a local one to a regional one.   &nbsp
