The information, in the main paper, the analytical-descriptive method, the comparative method, the method of deduction and induction will be used, and at the end wewill summarize with the exact truth, as our view of the analyzed problem

THE LEGAL CHALLENGES OF ASYLUM IN THE ERA OF THE REFUGEE CRISIS

    No full text
In this paper I will discuss the topic "The legal challenges of asylum at the height of the refugee crisis", where we will get to know the term asylum, how the status of asylum seeker is acquired, asylum in history, asylum according to Macedonian law, procedure for acquiring the right to asylum, the challenges of asylum, the legal framework, as well as the Asylum Sector. In our legal system, issues related to asylum refer to several legal sources: the Constitution, the Law on Foreigners, the Law on Citizenship and the Law on International and Temporary Protection. The right to asylum is one of the basic human rights, according to the 1948 Universal Declaration of Human Rights. Everyone has the right to seek asylum, except criminals and persons who have violated the principles of the United Nations Charter. States are not obliged to grant asylum, but it is done on a voluntary basis. Some countries allow this right to be claimed in diplomatic missions and missions. Finally, through examples from everyday practice in this area, we will determine whether the rights of persons seeking asylum are respected in order to determine whether the basic human rights of persons seeking asylum are respected

CONCEPTUAL DIFFERENCES IN REGULATING COMPULSORY SUCCESSION IN THE WORKING VERSIONS OF THE CIVIL CODES OF SERBIA AND NORTH MACEDONIA

    No full text
Although the Commission for the Drafting of the Civil Code of the Republic of Serbia ceased its work in mid-2019, it can be expected that the prepared Pre-Draft of the Civil Code will serve as a solid basis for future work on the codification of civil law. On the other hand, in North Macedonia, the Commission for the Drafting of the Civil Code is actively working on the preparation of the codex, particularly making significant progress in the regulation of inheritance. Compulsory succession is a very significant area within the field of inheritance law, which in recent years and decades has undergone significant changes in European continental legal systems. These changes primarily manifest in the expansion of the freedom of testamentary disposition of the testator, resulting in narrowing the rights of compulsory heirs. In the working versions of the civil codes of Serbia and North Macedonia, there are significant conceptual differences in the construction of rules related to compulsory succession. These differences are evident in defining the circle of compulsory heirs, the conditions they must meet to be entitled to a compulsory share, the size of compulsory portions, the legal nature of the right to a compulsory share, etc. The paper will point out the ideas that guided the editors of these two codifications and discuss the substantial differences in the normative shaping of compulsory succession. Additionally, the author will share his reflections on how this significant area of inheritance law should be regulated

FORMS AND POLITICS OF PROTECTION OF COMPETITION

    No full text
This scientific paper will analyze the basic forms and models of competition protection from a comparative legal point of view. At the beginning of this work, the very concept of competition protection is determined, while competition is observed from different aspects, in order to define its essence and determination of its social significance. Further in the following chapters, the characteristic forms of competition protection will be discussed, which in this paper will be grouped under the general categories of direct and indirect competition protection. These two forms ensure the protection of competition through different procedures regulated by law, of which special attention will be devoted to approaches to the protection of competition in comparative law. Then, a brief overview of the most important comparative legal models of competition protection will be made and their historical genesis and basic characteristics will be presented. The scientific results of this paper and the elements of the competition protection model that is applicable in the legal systems of the countries formed on the territory of the former Yugoslavia, with a special reference to Macedonia, will be highlighted in the concluding remarks of the paper itself. POST HUMAN REPRODUCTION (POST MORTEM): PARENTAL STATUS AND INHERITANCE STATUS OF THE CHILD

    No full text
Reproductive freedom and the right to found a family is a fundamental human right, which enjoys protection and guarantee in the Constitution of every country. Technological developments now enable a child not only to be born but also to be conceived after the death of one of the spouses or partners, so through this method it is possible for people to freeze their genetic materials in order to use them for reproduction after death. This artificial way of reproduction presents a series of bio-ethical, social and legal problems, since most states have interpreted it in different ways, either with partial legislation or with partial legislation that needs interpretation. However, the fear of new technologies exists and is not new since in practice it represents a field loaded with case studies and the question arises: "Is the decision to have the child of the deceased a proper and welcome decision since the woman goes through the process of suffering and does not think rationally"? What is the legal status of the child and how is the issue of paternity/maternity handled after the death of one of the spouses? We can say that in cases where natural reproduction becomes impossible for health reasons, artificial reproduction can be viewed as welcome as it creates a new life and the use of new technologies for reproduction is mainly in the interest of the parents in their choice if they want to move on and lead a new life

    No full text
The crucial role or importance of management in the Republic of Northern Macedonia, and thus managers, consists in leading the company in the field of tourism to achieve the goals in the most efficient and effective way. Each company has a certain goal for which it exists, and management has that responsibility to exploit and combine organizational resources in the most optimal way, thus achieving the company\u27s goal. Management is moving the corporation towards achieving the goals by focusing on the activities that company members are obliged to carry out. If such activities are largely creatively and creatively defined, the productivity of each employee will contribute to the achievement of the goals of the travel company

COMPARATIVE ENVIRONMENTAL ANALYSIS BETWEEN CONVENTIONAL AND COGENERATION GAS-FIRED CENTRAL HEATING SYSTEMS

    No full text
Heating power plants are the major source of hot water intended for heating of communal areas or districts, or even whole cities for any developed country on a large scale. The usual concept for conventional heating power plants is burning fuel into combustible chambers called boilers and production of heat in the form of hot water. Then, using already developed heat network consisted of pipes and pumps, the hot water is distributed to final customers. At the cogeneration power plants, the process is almost similar, with the major difference that in the boilers instead of hot water, the so-called superheated water vapor is generated which initially is used in the steam turbinesfor electricity generation, and later the exhausted steam is re-used using condensers for production of heat in the form of hot water for central heating purposes. In this paper, the authors present comparative environmental analysis between two gas-fired plants used for central heating of the city of Skopje. The first one is the conventional gas-fired heating plant which has only one product, hot water for central heating purposes. The second power plant is cogeneration gas-fired power plant; thus, it simultaneously generates electricity and heat used for central heating. Since 2013, both plants use natural gas as primary fuel, which although still a fossil fuel, is less polluting and environmentally more acceptable. The obtained results of the analysis and comparison between both power plants are given in details showing that both plants are within the prescribed environmental regulations

IMPACT OF CORE SATURATION ON OPERATING CHARACTERISTICS OF THREE-PHASE SQUIRREL CAGE MOTOR

    No full text
The induction motors are considered to be the largest electricity consumers worldwide. Therefore, the exact calculation of their operating characteristics in various operating modes is important for determining their operation, electricity consumption and the various types of losses that occur during their operation that have the considerable impact on efficiency of the motors. Paper analyses two models of three-phase squirrel cage induction motor, modeled in Simulink. The first model is considered to have linear magnetizing characteristic while in the second model the core saturation is taken into account by introducing the non-linearity of the magnetization characteristic. The models are analyzed with fifteen percent increased voltage which shifts the operating point into the saturated part of magnetizing characteristic for the saturated model. The impact of core saturation on motor current, speed and torque is observed. The obtained results of the transient characteristics from Simulink are compared with data of current and torque from steady-state models. The core saturation increases the motor current, losses and decreases the motor efficiency. The areas where the core saturation occurs, mainly located in stator teethes, are also observed in Finite Element models (FEM). The derived models contribute to the better understanding of effect of core saturation and its impact on motor operation, thus providing the guidelines for the motor designers

THE RECEPTION OF CAMUS IN MACEDONIA

    No full text
Albert Camus and Jean-Paul Sartre, as two main representatives of French existentialism, two “frenemies” have exerted a strong influence on the cultural, literary, ideological, and political life of Macedonia. They remain relevant to the reflection and sensitivity of today’s Macedonian public. The reception of their literary and philosophical works varied depending on the cultural, literary, ideological, and political circumstances faced by the Macedonian public. They received a warm welcome immediately after World War II and especially during the 1960s. Initially, this reception was primarily based on ideological preferences, with Sartre being considered a supporter of the more liberal Yugoslav communist model. Sartre somewhat overshadowed Camus. After the publication of “The Rebel” a definitive rupture between Sartre and Camus occurred, mainly due to their political orientations. After only a few years, Camus received the Nobel Prize, a highly appreciated award at the time by the public. For a while, Camus overshadowed Sartre, and his works began to be translated into Macedonian and Albanian. A bit later, in 1964, Sartre declined the Nobel Prize, and this act elevated his fame to its peak, perhaps until his death. The fall of the Berlin Wall and the change in ideological and political values also led to a change in cultural and literary values. This brought about an updating of the works of these two authors. Today, in the Macedonian cultural space, in search of exclusively literary and aesthetic values, faithful translations of the works of these two authors are being born, as well as in-depth studies about them, in Macedonian and Albanian languages, which foster a new reading of their works based on the art that arises from their literary creativity and no longer from extraliterary preferences. Keywords: Camu; French; existentialism; literary reception; literature; politics; Macedonia
