PRINCIPLE OF NON-REFOULMENT AND ITS LIMITS IN THE CONTEXT OF CONFLICTS IN SYRIA AND UKRAINE

    No full text
This paper examines complexities and dynamics surrounding the principle of non-refoulment within the context of the conflicts in Syria and Ukraine, both of which significantly influence European Union refugee policies. While one conflict is intrastate and the other interstate, each of them plays a pivotal role in shaping how refugees are received and treated within the European Union. The study explores the legal framework, practical applications, and arguments concerning exceptions to non-refoulment, focusing on its significance. Furthermore, it highlights contrasting responses that reveal disparities in treatment and pose challenges, such as contradictory safety assessments in Syria and variations in the European Union’s reception of the Ukrainian refugees. The swift activation of the Temporary Protection Directive (TPD) in Ukraine serves as a model for effective international response, yet critiques emerge regarding unequal treatment and perceptions of racial bias. Conversely, the Syrian situation highlights the complexity of the crisis with debates over safety assessments and the reluctance of certain countries to accept refugees. While security concerns might occasionally warrant the categorization of refugees, such actions must strictly adhere to the principles outlined in international law and human rights norms. The study underscores the importance of upholding the non-refoulment principle in addressing the refugee crisis amidst present-day complexities and challenges

HEARING A MINOR AS AN INSTRUMENT OF PROTECTING THE CHILD’S BEST INTERESTS IN POLISH AND MACEDONIAN PROCEDURAL LAW

    No full text
The child’s welfare has contemporarily become one of the fundamental, universal, and systemic values chiefly addressing authorities charged with applying the law, courts included. While of supreme importance and not subject to valuation, the child’s welfare concept remains vague and escapes definition, encouraging its perception as a preventive mechanism for child objectification. Acts of international law present standards exercising fundamental human rights while constituting an obligation to introduce appropriate national-level guarantees. The paper attempts to compare solutions applied in Polish and North Macedonian procedural law. A confrontation of the experience of countries drawing on dissimilar traditions and models ought to encourage continuous improvement of procedural solutions, and their proper application in view of the special status of minors

The research will collect data on the familiarity of students about the definition and content of the freedom of expression, and use of social media by students, and the findings will be analyzed with the results of in-depth interviews

ТУРИСТИЧКА ПРОМОЦИЈА НА КУЛТУРНИТЕ ВРЕДНОСТИ ВО ГРАД ВИТИ

    No full text

AI impact on traditional credit scoring models

    No full text
Credit scores are an integral part of a bank\u27s lending process because they provide insight into the creditworthiness of each borrower. The traditional credit scoring models offer a standardized approach, but they come with certain shortcomings. AI and machine learning credit scoring models overcome the negative aspects of traditional models while offering banks and borrowers more accurate techniques for risk assessment. Even though AI-powered models are superior to the traditional, they do come with certain challenges related to potential bias, transparency, privacy, and regulatory compliance. It is anticipated that in the future, hybrid credit scoring models will most likely be developed by banks in their efforts to emphasize the advantages and reduce or eliminate the shortcomings of the different models

Islamic Banking-A challenge for the Turkish financial system

    No full text
The Islamic banking model based on the zero interest rate or in practice, the enormously low reference interest rates and the fair distribution of profit and loss is seen as a challenge for economies that have long had the conventional economic model as their basis. The Republic of Turkey, which is one of the world\u27s largest economies, for ideological reasons made an attempt to introduce the Islamic banking model, which required a significant reduction in the reference interest rate by the National Bank of Turkey, and as a result of this, the country faced a rapid growth in inflation, which in a given period reached over 80%, the Turkish lira recorded a historic devaluation, and the Istanbul Stock Exchange noted significant oscillations in the direction of the accelerated growth in the value of the BIST 100 (XU100) index. The focus of this research paper is to examine the effect of the introduction of the Islamic banking model on the financial system with special reference to the financial market of the Republic of Turkey, that is, the Istanbul Stock Exchange and the representative index BIST 100 (XU100). According to the results of the research, it can be concluded that the Islamic banking model, which contradicts the principles of the conventional economy which was based on the Turkish financial system, has caused significant destabilization of the Turkish financial system, that is, the financial market. Namely, the growth of inflation contributes to the growth of the BIST100 (XU100) index and changes in the functioning of financial flows

REGULATORY ASPECTS AND FUTURE TRENDS IN DRONE MANAGEMENT THROUGH AN ANALYSIS OF EUROPEAN AND NATIONAL LEGAL FRAMEWORKS

    No full text
Unmanned aerial vehicles, or drones, represent a significant innovation in modern technology, which radically changes traditional methods of work through the automated execution of tasks without the need for the physical presence of a pilot. Since their initial use in military operations, drones have expanded into a wide variety of civilian areas, including commercial applications, scientific research, agriculture, and rescue operations. They offer significant advantages such as improved efficiency, cost reduction and increased accuracy in performing tasks. With the increasing use of drones, new challenges arise that require the adaptation of legal norms and regulations. There is a need to develop legal frameworks that will regulate the safety of airspace, the privacy of individuals and the responsibility of operating drones. The European Union has introduced significant regulations, such as Regulation (EU) 2019/947 and Regulation (EU) 2019/945, which set basic rules and standards for the registration, licensing and certification of drones and their operators. As drone technology continues to evolve, legal frameworks must be flexible and able to adapt to new conditions and challenges. With the continuous integration of new technologies into legal regulation, it is possible to ensure the safe and efficient use of drones, while protecting the rights and interests of all stakeholders
