The anti-alienation clauses in mortgage loan contracts
El presente artículo reflexiona en torno a la validez de las cláusulas de no enajenar en los contratos de mutuo hipotecario. Se revisa si, más allá del tenor del artículo 2415 del Código Civil, existe algún interés del acreedor hipotecario que pueda protegerse legítimamente mediante una de estas cláusulas. El análisis se realiza, fundamentalmente, desde la perspectiva del Código Civil y la Ley n° 19.496 de 1997, en consideración que se está frente a un auténtico contrato de adhesión. El derecho de persecución, contemplado en el artículo 2428 del Código Civil, y la nulidad de las cláusulas que puedan comprenderse en el artículo 16 letra g) de la Ley n° 19.496, sirven como marco de referencia del análisis. Se coordina lo planteado con las normas pertinentes del Código de Procedimiento Civil, la Ley n° 18.010, la Ley General de Bancos y el Reglamento del Registro Conservatorio de Bienes Raíces, especialmente en atención a lo establecido en el artículo13 del Reglamento: “El Conservador no podrá rehusar ni retardar las inscripciones: deberá, no obstante, negarse, si la inscripción es en algún sentido legalmente inadmisible”. Además, se reflexiona sobre los gravosos efectos que tendría la cláusula si se conjugase con una cláusula de aceleración. The present article reflects on the validity of anti-alienationclauses in mortgage loan contracts. We review if, beyond thewording of the article 2415 of the Chilean Civil Code, there is anyinterest of the mortgagee that may be protected legally through oneof those clauses. The analysis is made, mostly, from the perspectiveof the Chilean Civil Code and the Act n°19.496, having in considerationthat we are in front of an authentic contract of adhesion. Theright of pursuit referred in the 2428 article of the Civil Code, and thenullity of the clauses that may be included in the article 16 letter g ofthe Act n°19496, serve as framework of the analysis. It coordinatesthe issues raised with the pertinent standards of the Civil ProcedureCode, the Act n° 18.010, Banks General Act of and the Regulationof the Conservatory Registry of Real State, especially in attention towhat is established in article 13 of the Regulation: ‘The Conservatorymay not refuse or delay the enrollments: it must, however, refuse ifthe inscription is in any sense legally inadmissible’. The concept of consumer in the European and Spanish law
El presente trabajo tiene como objetivo demostrar, como el concepto de “consumidor” ha sido uno de los caballos de batalla a nivel comunitario y en el ordenamiento jurídico español; prueba de ello son las diversas sentencias del Tribunal de Justicia de las Comunidades Europeas, en donde se ha excluido a las personas jurídicas que adquieren bienes o contratan servicios con fines de lucro. En este sentido, las Directivas y Reglamentos que brindan un concepto de consumidor, coinciden con los siguientes elementos: que sea una persona física y que adquiera bienes o contrate servicios sin fines de lucro.This paper aims to demonstrate how the concept of“consumer” has been a problem in Europe and the Spanish law;proof different judgement of Court of Justice of the EuropeanCommunities, where it has been excluded to the legal entity thatbuy goods or hire services for profit. In this sense, the Directives andregulation that gives a concept of consumer, agree with the followelements: that is a natural person and buy goods or hire serviceswithout non profit

Este trabajo prueba que la propiedad privada sobre bienes materiales encuentra su título en la justicia distributiva y en el principio de subsidiaridad. Refuta las concepciones liberal lockeana y marxista del derecho de propiedad. En particular, sostiene que los males que los marxistas atribuyen a la propiedad privada como a su causa se deben más bien al carácter de los hombres y no se resolverían, sino que se agravarían, con la abolición de la propiedad. Muestra que hay diversos posibles regímenes justos de propiedad y que debe revisarse hondamente el sistema de “propiedad intelectual”. Sostiene que la propiedad privada sobre bienes intelectuales es, en cambio, contraria a la subsidiaridad.The paper proves that one is entitled to have privateproperty due to distributive justice and to the principle of subsidiarity.It refutes the Liberal-Lockean and the Marxist conceptions of theright to property. It demonstrates, in particular, that the evils whichMarxist thinkers consider as flowing from private property as theircause would not disappear but, rather, worsen if private propertywere abolished. It demonstrates that there are a variety of possiblejust property systems and that the system of “intellectual property” must be submitted to a thorough revision. It holds that private property concerning intellectual rights is contrary to subsidiarity
Treaty interpretation of the right to life before birth by Latin American and Caribbean states: an analysis of international treaty obligations, regional agreements and relevant state practice
A pesar de que en la actualidad algunos organismos internacionales no judiciales promueven una visión distorsionada de las obligaciones contenidas en los tratados de derechos humanos respecto a la legalización del aborto, los Estados partes y tribunales internacionales, únicos que pueden emitir interpretaciones vinculantes de los tratados internacionales de derechos humanos, han entendido que la Convención sobre los Derechos del niño de 1989 (en adelante CDN) y la Convención Americana sobre Derechos Humanos de 1969 (en adelante CADH) reconocen ampliamente un derecho a la vida desde el momento de la concepción y protegen al niño no nacido del aborto. Este artículo examina evidencia concreta del rechazo, por parte de los Estados de América Latina y el Caribe, a un supuesto derecho al aborto y de su reconocimiento de una obligación internacional de proteger el derecho a la vida antes del nacimiento, en virtud de la CDN y la CADH. Las secciones II y III describen los tratados internacionales ratificados por América Latina y el Caribe que explícitamente protegen la vida prenatal, así como otras normas aplicables en la región, incluyendo las normas de interpretación de los tratados en el derecho internacional. La sección III analiza la práctica de los Estados Latinoamericanos y del Caribe en foros internacionales que refleja un acuerdo regional en cuanto su interpretación. Esta sección explora las declaraciones internacionales, declaraciones regionales, reservas a tratados internacionales, informes oficiales a los órganos de vigilancia de los tratados, comunicaciones oficiales con organismos regionales de derechos humanos y decisiones relevantes por tribunales regionales e internacionales.Even though non-judicial international bodies currently promote a distorted understanding of human rights treaty obligations as mandating the legalization of abortion, states parties and international courts, which alone may issue authoritative interpretations of international human rights treaties, have interpreted the Convention on the Rights of the Child and the American Convention on Human Rights to recognize right to life from conception and to protect the unborn child from abortion. This article examines evidence of Latin American and Caribbean states’ rejection of abortion rights, as well as evidenceof legally binding interpretation of their treaty obligations to recognize and protect the right to life before birth under the Convention on the Rights of the Child and the American Convention on Human Rights.Sections II and III discuss international treaties ratified by Latin American and Caribbean states that explicitly protect pre-natal life as well as other applicable rules of international law in the region, including international norms of treaty interpretation. Section III addresses subsequent state practice in international for evincing the agreement of Latin American and Caribbean states regarding treaty interpretation, such as international declarations, regional declarations, reservations upon treaty ratification, oficial reports to treaty monitoring bodies, oficial communications with regional human rights bodies and relevant decisions by regional and international tribunals
The role of the OECD in the elaboration of multilateral norms concerning Foreign Direct Investments: a sharp contrast between two different approaches
Este artículo versa sobre el rol de la OCDE en lo relativoa la elaboración de normas multilaterales sobre la regulación deInversiones Extranjeras Directas. Particularmente, al distinguir entreuna aproximación promocional y una regulatoria, pretende analizarcómo la actuación de la OCDE cumple con la necesidad de ponderarlos derechos económicos de los inversores privados con los interesespúblicos del Estado anfitrión. Particularmente, al tiempo que muestracómo los intentos anteriores de la OCDE de elaborar un AcuerdoMultilateral sobre Inversión se preocupaban principalmente de la promociónde sectores económicos estratégicos de países desarrollados,descubre que las Directrices para Empresas Multinacionales tambiéntoman en consideración la protección de numerosos “bienes públicos”.Sin embargo, el vacío que subsiste en la regulación de inversionesinternacionales puede ser cubierto por estas Directrices sólo a travésde su incorporación en instrumentos jurídicos vinculantes.This paper focuses on the OECD role with reference to the elaboration of multilateral norms concerning the discipline of Foreign Direct Investments. In particular, by distinguishing between a promotional approach and regulatory one, it aims to analyze how the OECD activities fulfill the need for balancing the economic rights of the private investors with the host State’s public interests. In particular, while showing how the previous OECD attempts to elaborate a Multilateral Agreement on Investment (forward MAI) were primarily concerned with the promotion of developed countries’ strategic economic sectors, it finds that the Guidelines for Multinational Enterprises also take into consideration the protection of numerous “public goods”. However, the gap which remains in the discipline of international investments could be filled by these Guidelines only through their incorporation into binding legal instruments
