Power of the faculty meeting on faculty personnel at national university corporations: Based on a lawsuit to confirm the invalidity of disciplinary action at a national university corporation
With the revision of the School Education Law (Law No.26 of 1947) and the Special Law for Educational Public Employees (Law No.1 of 1949), national universities tend to reduce the power and role of the faculty meetings. This induces the illegal managements and operations by the presidents of some national university corporations, making it difficult for such university corporations to manage and operate soundly. In this paper, one case of disciplinary action against a professor on the ground of academic harassment by a national university corporation is considered. This makes it clear that the strengthening power of the presidents at national university corporations carries the risk of causing a crisis of university autonomy itself
