TANGGUNG JAWAB PENGGUNAAN DATA PRIBADI OLEH PENYELENGGARA SISTEM ELEKTRONIK DALAM LAYANAN PINJAMAN ONLINE: Responsibility for the Use of Personal Data by Electronic System Operators in Online Lending Services
In this era of rapidly developing digital life, the use of information technology has become commonplace. One such development is the emergence of online lending services. These services use electronic systems to conduct their business, including the use of consumers\u27 personal data. Online lending providers that utilize electronic systems are also classified as electronic system operators. In practice, crimes related to personal data, particularly in the online lending sector, are rampant. The responsibility of electronic system operators regarding the use of personal data includes ensuring that their systems are reliable, secure, and responsible for system operations, having a legitimate and clear basis for data processing, providing complete information to the personal data subjects, and maintaining the confidentiality and security of their consumers\u27 data by implementing personal data protection principles. Failure to fulfill the obligations of electronic system operators may result in administrative sanctions, such as written warnings, temporary suspension of activities, deletion of personal data, restriction of products/services, freezing of products/services, dismissal of management, administrative fines, revocation of product licenses, and revocation of business licenses

AKIBAT HUKUM PENETAPAN TANAH TERLANTAR HAK GUNA BANGUNAN YANG SEMULA DIKUASAI PT TAMAN HARAPAN INDAH: The Legal Consequences of Determining Abandoned Land With Building Use Rights Which Controlled by PT Taman Harapan Indah
Currently, many individuals own land but do not utilize it effectively. Neglecting land is an unwise action. This research focuses on the procedure of determining abandoned land previously owned by PT Taman Harapan Indah with the Right to Build (Hak Guna Bangunan - HGB) in accordance with prevailing regulations, along with the legal consequences of such determination based on the Supreme Court Decision Number 565/K/TUN/2020, which was accepted by the rights holder. To address this issue, the research is conducted using a normative legal method, relying on secondary data with qualitative analysis. The conclusions drawn in this research are based on a deductive approach. The research findings indicate that the determination of abandoned land by PT Taman Harapan Indah was carried out based on Government Regulation (PP) 11/2010, with the determination made through Decree (Surat Keputusan - SK) Number 1/PTT-HGB/KEM-ATR/BPN/IV/2019. The legal impact received by PT Taman Harapan Indah, according to the Supreme Court Decision Number 565/K/TUN/2020, includes the revocation of its land rights, the termination of the legal relationship between the landowner and the land, accompanied by an affirmation that the land is now under state control.
PENYERANGAN TERHADAP HORS DE COMBAT DALAM KONFLIK BERSENJATA BERDASARKAN PRINSIP PEMBEDAAN: Attacks Againts Hors De Combat in Armed Conflict Based on The Distinction Principle
This research analyzes and discusses hors de combat as a subject in International Humanitarian Law, focusing on implementing the principle of distinction in armed conflict. The discussion arises from frequent misunderstandings about the subjects of International Humanitarian Law, which juxtaposes combatants with non-combatants. Article 10 of Additional Protocol I of 1977 states that International Humanitarian Law respects and protects all wounded, sick, and shipwrecked persons. Therefore, this paper will discuss the position of combatants who cannot participate in hostilities due to the reasons mentioned in the article and how International Humanitarian Law protects them. PENERAPAN CUSTOMER DUE DILIGENCE PADA SHOPEEPAYLATER SEBAGAI ALTERNATIF METODE PEMBAYARAN: Application of Customer Due Diligence on ShopeePayLater as an Alternative Payment Method
The existence of financial technology (Fintech) in Peer to Peer Lending (P2P Lending) services with the PayLater scheme is the public\u27s choice for payment transactions in the Shopee application (in collaboration with PT. CF). ShopeePayLater (SPayLater) is a trend today because of its simplicity of activation and use, especially for young people, who tend to choose it over bank credit. However, the lack of selectivity in carrying out Customer Due Diligence on prospective debtor customers can lead to an increase in credit arrears or bad credit which results in default. This relates to the principle of prudence in PT CF\u27s credit policy as a provider of SPayLater. Researchers are interested in researching and making the focus of this research by raising the issue of how is the application of Customer Due Diligence on ShopeePayLater as an alternative payment method? The conclusion of this research is that there is no strict supervision and mechanism for prospective debtor customers, so that Customer Due Diligence does not run according to applicable regulations
TINJAUAN YURIDIS PEMUTIHAN PAJAK KENDARAAN BERMOTOR UNTUK MENINGKATKAN PENDAPATAN ASLI DAERAH DI KOTA SEMARANG TAHUN 2023: Juridical Review of Motor Vehicle Tax Reduction in Increasing Original Regional Income in Semarang City in 2023
The central government delegates authority to regional governments to carry out household finances independently through decentralization with the aim of improving the welfare of the community. One of the regional government financing comes from regional taxes. This research adopts a normative juridical method with a descriptive approach, and analyzes secondary data supported by interviews. The PKB whitening program was implemented to encourage taxpayers to pay off their tax arrears by clearing late fines, as was done by Central Java Province, especially Semarang City. Based on Central Java Governor Regulation No. 9 of 2023, this program is designed to help vehicle owners fulfill their obligations without any fines/witnesses. Implementation includes determining objects and subjects, collection procedures, fee provisions, sanctions, and performance budgets. This shows an increase in motor vehicle tax revenue of 20.59% compared to the previous year. This program has proven effective in increasing regional income and taxpayer compliance
RESILIENSI DAN BURNOUT AKADEMIK PADA MAHASISWA KEDOKTERAN DI MASA PANDEMI: PENELITIAN CROSS-SECTIONAL
Latar belakang. Perubahan proses pembelajaran pada masa pandemi menyebabkan mahasiswa perlu beradaptasi. Perubahan proses pembelajaran dari tatap muka menjadi daring dan hybrid serta paparan materi pembelajaran yang banyak, jadwal yang padat, dan perubahan lingkungan belajar dapat menyebabkan terjadinya academic burnout yang ditandai dengan kelelahan baik fisik maupun emosional, sinisme, dan menurunnya efikasi diri. Prevalensi burnout yang dialami mahasiswa bidang kesehatan mencapai 44,9% sehingga perlu ada resiliensi akademik dalam menghadapi tantangan pada proses pembelajaran. Tujuan. Menggali penyebab burnout akademik dan menilai hubungan resiliensi dengan burn-out akademik pada mahasiswa kedokteran di masa pandemi. Metode. Penelitian ini menggunakan pendekatan metode campuran. Tahap kuantitatif menggunakan desain cross-sectional yang melibatkan 105 mahasiswa kedokteran tahun kedua dari Fakultas Kedokteran Universitas Trisakti. Tahap ini dilanjutkan dengan tahap kualitatif menggunakan Focus Group Discussion dengan 26 mahasiswa yang mengalami burnout tingkat sedang hingga berat. Data resiliensi akademik diperoleh dari data sekunder yang dikumpulkan selama tes psikometrik untuk seleksi penerimaan mahasiswa. Burnout akademik diukur menggunakan kuesioner School Burnout Inventory versi Bahasa Indonesia yang telah divalidasi. Hasil. Sebanyak 62,5% mahasiswa mengalami burnout ringan dan hanya 4,8% yang tidak mengalami burnout. Mahasiswa yang mengalami burnout sedang - berat sebesar 32,7%. Kejadian burnout yang cukup tinggi memerlukan penanganan khusus agar tidak menjadi lebih berat. Resiliensi akademik tidak berhubungan secara statistik dengan burnout yang dialami (p>0.05). Kesimpulan. Mahasiswa kedokteran yang mengalami burnout sedang-berat sebanyak 32,7%. Tidak terdapat hubungan antara resiliensi dengan burnout akademik pada mahasiswa Fakultas Kedokteran di masa pandemi
BENEFITS AND RISKS OF ULIPRISTAL ACETATE FOR UTERINE FIBROIDS
Uterine fibroids (FU) are often experienced by women of reproductive age or in their early menopause with therapy options involving surgical intervention such as hysterectomy. Ulipristal Acetate (UPA) is an oral drug from the selective progesterone receptor modulator (SPRM) class which has been proven to be effective in treating FU symptoms so that patients can maintain their fertility and their uterus. The PEARL I-IV clinical trials (PGL4001/UPA Efficacy Assessment in Reduction of Symptoms Due to Uterine Leiomyomata) has proven the effectiveness of this drug in terms of reducing symptoms such as bleeding and pain, reducing fibroid volume, as well as its impact on the patient\u27s quality of life. During ongoing clinical trials, the majority of side effects found were mild-moderate and reversible. In 2020, UPA was discontinued due to reports of the risk of DILI (drug induced liver injury), but after thorough investigation and considering its benefit and risk ratio for patients, UPA can be given again but its indication is limited to intermittent FU therapy with moderate to severe symptoms in women who has not reach menopause or when surgical procedures cannot be performed/have failed. Close monitoring of liver function is of course necessary
PENJATUHAN DUA PIDANA POKOK BAGI PERANTARA PENGEDAR NARKOTIKA OLEH ANAK BERDASARKAN UNDANG-UNDANG NOMOR 11 TAHUN 2012: Imposition of Two Principal Penalties for Child Intermediaries of Narcotics Dealers Based on Law Number 11 of 2012
The imposition of criminal sanctions against a 17-year-old child acting as an intermediary in a narcotics transaction was based on Article 112 of Law Number 35 of 2009 on Narcotics, as seen in Decision Number 00/Pid.Sus-Anak/2022/PN CRP. In this decision, the judge imposed two principal punishments. The main issue discussed in this paper is whether the imposition of two principal punishments is in accordance with Law Number 11 of 2012 on the Juvenile Criminal Justice System. This research uses a normative juridical method through literature study, with a descriptive-analytical approach and deductive reasoning. The results show that imposing two principal punishments on a child contradicts Article 71 of Law Number 11 of 2012, which stipulates that only one type of principal punishment may be imposed on a child. Furthermore, restorative justice cannot be applied in this case because the offense carries a sentence exceeding seven years, as regulated in Article 112 of the Narcotics Law. In conclusion, the imposition of two principal punishments on the child in this decision is inconsistent with the provisions of the Juvenile Criminal Justice System and violates the principles of child protection in criminal proceedings
