No full textThe subject of this paper is an analysis of the relevance of tax law principles to the proper application of the income tax exemption of income of a church legal entity for religiously useful purposes. The Supreme Administrative Court upheld interpretation of the tax law that only entities directly involved in religious activities can benefit from this exemption. The article also addresses the problem of limiting aggressive tax optimisation involving church legal entities. The article points out the need to change the system of tax reliefs and preferences provided for religious associations. The ruling aims to reduce aggressive tax optimisation practices and ensure that tax exemptions are used for legitimate religious purposes, rather than for tax avoidance. This decision clarifies that only entities directly controlled by church legal entities are eligible for the exemption, reinforcing the importance of adhering to the true spirit of the law and preventing misuse. Finally, the ruling highlights the need for a deeper reflection on the systemic nature of tax exemptions for religious associations, suggesting that new tax solutions could be developed through bilateral agreements between the State and churches. This would align tax exemptions with modern tax principles.
Przedmiotem analizy niniejszej glosy jest zastosowanie zwolnienia z podatku dochodowego dla dochodów kościelnych osób prawnych przeznaczonych na cele religijnie użyteczne na kanwie wyroku Naczelnego Sądu Administracyjnego w Warszawie z dnia 16 stycznia 2025 roku, II FSK 501/22. Ponadto w opracowaniu poruszono problem ograniczenia agresywnej optymalizacji podatkowej związanej z podmiotami kościelnymi. NSA potwierdził, że zwolnienia podatkowe muszą być wykorzystywane wyłącznie do celów religijnych, a nie unikania opodatkowania. Dodatkowo NSA zaznaczył, że tylko podmioty religijne bezpośrednio zaangażowane mogą korzystać z tego zwolnienia, co podkreśla konieczność przestrzegania prawdziwego celu ustawy i zapobiegania jej nadużywaniu. W komentarzu wskazano na potrzebę głębszej refleksji nad systemem zwolnień podatkowych dla związków wyznaniowych, sugerując, że nowe rozwiązania podatkowe mogłyby zostać opracowane w ramach umów bilateralnych między państwem a związkami wyznaniowymi. Taki krok pozwoliłby lepiej dostosować zwolnienia podatkowe do współczesnych zasad prawa podatkowego
United States Concepts of Due Process in Criminal Procedure and the International Criminal Court
No full textThe provisions of the Rome Statute of the International Criminal Court should be evaluated considering the due process principles of the United States Constitution to determine if it would be appropriate for the US government to sanction the sending of a US citizen to the ICC or adopting the Rome Statute. There are several areas including the right to trial by jury, right to confrontation, speedy trial and the composition of the Court that raise serious due process concerns from an American perspective. Considering the ICC’s inability to guarantee the same due process protected by the US Constitution there are serious doubts about American involvement in the Court
"Breaking a Dog’s Neck" as a Metaphor for Oppressing the Weak. An Exegetical-Historical Analysis of the Expression ערף כלב (Isa 66:3)
Get PDFThis paper analyses Isa 66:3 and presents a new interpretation of the expression ערף כלב “breaks a dog’s neck.” There are various proposals to explain this enigmatic expression. One points, for example, to a possible ritual in which dogs were to be sacrificed by breaking their necks. This ritual was supposed to have been practised in the ancient Levant, including the Israelites/Judahites. This explanation is called into question in this article. It is pointed out that the phrase can be understood as a metaphor for people who impinge on the dignity of others. The exegesis of biblical texts, the examples cited from ancient Near Eastern literature, and the analysis of archaeological material indicate that this expression may have a different meaning from that hitherto accepted

The Culmination of the “Royal Travesty” in the Poetic Imagery of Solomon’s Wedding Procession (Song 3:6-11)
No full textThe description of the wedding procession in Song 3:6–11 is distinguished by the culmination of royal features and its climax in the cyclical poetic development of the theme of the king. It is also the only direct reference to weddings in the Song of Songs. Therefore, the following question has been asked about the content of the culmination of royal metaphors in 3:6–11: What is the relationship between the meaning of the pericope and the wisdom conclusion of the entire Canticle (8:5–7)? The article begins with the cultural context (Sitz im Leben) of weddings, and then arguments are presented in favour of the interpretation of pericope 3:6–11 as a poetic vision of a wedding procession. The literary device of the royal travesty and its use in the Song of Songs (form criticism) are explained. The basic exegetical analysis is preceded by an analysis of the composition of the pericope. It leads to the conclusion that there is a compositional relationship between the pericope under study 3:6–11 and the punch line of Canticle 8:5–7. They reflect the steps in the progression of the message within the cyclical development of its content, so characteristic for the Song of Songs. The study ends with an intertextual analysis of the studied pericope 3:6–11 and the wisdom conclusion of Canticle 8:5–7. A deeper analysis results in the conclusion that the royal travesty of the wedding procession serves as something more than the praise of the nuptials themselves. The bridegroom’s royal travesty is an attempt at a human response to the experienced mystery of the power and splendour of love (mysterium fascinosum) between the bride and bridegroom. The compositional relationship between the pericopes makes it possible to interpret and justify the words of the punch line of Canticle 8:6 as a call to a commitment and oath of nuptial love
"Who Is David and Who Is – the Son of Jesse?". The Interpretation of the Figure of King David in the Development of Old Testament Theology
No full textThe article addresses the issue of the numerous inconsistencies and contradictions found in the David cycle in 1 Sam 14 – 1 Kings 2. Usually, exegetes tend to believe that the biography of the king, especially the section the ‘History of David’s rise to power’, shows traces of two legends of different origins, regardless of whether the figure actually existed in Israel’s history. However, after comparing the inconsistencies in the portrayal of the king, it can be concluded that the basis of the legends about David may have been a real historical figure of a certain warrior whose biography can be traced from 1 Sam 27 – a certain warrior from the Philistine city of Ziklag who conquered the heights of Hebron and may be considered the founder of the Judah statehood
The difference between gaming disorder and alcohol use disorder in early maladaptive schemas
No full textBackground. The study investigated the relationship between Early Maladaptive Schemas (EMS), Gaming Disorder (GD), and Alcohol Use Disorder (AUD). Previous studies did not address the possible relationship between AUD and GD, which could lead to an incomplete understanding of the relationship between ESM and these disorders. The current study addressed this research gap by testing the relationship between AUD, GD and ESM.
Methods. The study included 1,054 participants (565 females, M = 22.96 years, SD = 2.52) who reported playing video games and consuming alcohol within the past 12 months. Participants completed the Young Schema Questionnaire (YSQ-S3), Gaming Disorder Test (GDT), and Problem Drinking Scale (PDS). Seemingly Unrelated Regression (SUR) analysis was used to model the relationships between EMS, GD, and AUD while controlling for gender, age, gaming hours, and alcohol consumption frequency.
Results. AUD was positively associated with dependence/incompetence, vulnerability to harm or illness, self-punitiveness, and entitlement/grandiosity schemas and negatively related to social isolation/alienation and insufficient self-control/self-discipline schemas. GD was positively related to enmeshment and subjugation schemas and negatively associated with unrelenting standards and pessimism/negativism schemas. Significant differences were found between GD and AUD in their associations with specific EMS, suggesting distinct psychological pathways.
Conclusions. The findings highlighted the differential roles of EMSs in AUD and GD. The results suggest that EMS contribute uniquely to addictive behaviours and underscore the importance of considering schema-based interventions. Future research should further explore the mediating role of parenting styles in the development of AUD and GD.The research was funded by a grant from the Ministry of Health, Gambling Problem Solving Fund awarded to The John Paul II Catholic University of Lublin (grant number: 31.01.23/HM/DBMWM)
Право собственности как конституционное субъективное право и принцип пропорциональности – административно-правовые вопросы
No full textNiniejsze opracowanie przedstawia zagadnienie oddziaływania konstytucyjnej zasady proporcjonalności na prawo własności, ze szczególnym uwzględnieniem wpływu jednego z czynników, jakim jest ochrona środowiska. Opracowanie zmierza do udzielenia odpowiedzi na pytanie: jakie relacje zachodzą między prawem własności a zasadą proporcjonalności, w szczególności w związku z ochroną środowiska. Po przeprowadzeniu badań stwierdzono, że wymagania ochrony środowiska są czynnikami wpływającymi w poważnym stopniu na ograniczenia prawa własności, a relacje między nimi są złożone.
This study presents the issue of the impact of the constitutional principle of proportionality on the property right, with particular emphasis on the influence of one of the factors, namely environmental protection. The study aims to answer the question: what relationships exist between the property right and the principle of proportionality, in particular in relation to environmental protection. After conducting research, it was found that environmental protection requirements are factors that have a serious impact on the limitations of the property right, and the relationships between them are complex.
У даному дослідженні розглядається питання впливу конституційного принципу пропорційності на право власності, з особливим наголосом на вплив одного з факторів, яким є захист навколишнього середовища. Метою Автора є спроба відповісти на питання, які відносини існують між правом власності та принципом пропорційності, зокрема у зв’язку з охороною навколишнього середовища. Проведені аналізи показують, що природоохоронні вимоги є факторами, що суттєво впливають на обмеження прав власності, а взаємозв’язки, які з’являються між ними, є складними.
В настоящем исследовании рассматривается вопрос о влиянии конституционного принципа пропорциональности на право собственности с особым акцентом на воздействие одного из факторов, а именно охраны окружающей среды. Исследование призвано ответить на вопрос: какова взаимосвязь между правом на собственность и принципом пропорциональности, в частности, в отношении охраны окружающей среды. В результате исследований было установлено, что требования охраны окружающей среды являются факторами, которые серьезно влияют на ограничения права собственности, и взаимосвязь между ними носит сложный характер
