PENEGAKAN HUKUM TERHADAP PELAKU TINDAK PIDANA PENJUALAN OBAT KERAS TANPA RESEP DOKTER DIHUBUNGKAN DENGAN UNDANG-UNDANG NOMOR 17 TAHUN 2023 TENTANG KESEHATAN (Studi Putusan Nomor 302/Pid.Sus/2023/PN Cjr)
This study examines law enforcement mechanisms against the illegal distribution of drug solvents without medical prescription under Law No. 17 of 2023 concerning Health, analyzing the legal framework, enforcement challenges, and policy implications through Decision No. 302/Pid.Sus/2023/PN Cjr. The proliferation of illegal drug sales without medical prescription remains a persistent challenge in Indonesia, driven by factors including public demand for convenient access, cost considerations, and systemic weaknesses in pharmaceutical oversight, creating a critical gap between regulatory provisions and effective law enforcement implementation. Employing a normative legal research approach, this study analyzes positive law provisions, particularly Law No. 17 of 2023 concerning Health and relevant criminal law provisions, to evaluate the legal basis and enforcement mechanisms against unauthorized pharmaceutical distribution. Article 435 of Law No. 17 of 2023 provides a robust legal foundation for prosecuting both individual perpetrators and corporate entities involved in producing or distributing drug solvents without compliance with regulatory requirements. This study finds that Decision No. 302/Pid.Sus/2023/PN Cjr demonstrates the application of the ne bis in idem principle, ensuring defendants are not tried twice for the same criminal act. However, the case reveals significant structural weaknesses in the pharmaceutical regulatory and supervisory systems that continue to undermine effective enforcement. While law enforcement efforts against unauthorized drug distribution have commenced, current mechanisms remain insufficient without comprehensive systemic reform. The judiciary has correctly applied fundamental criminal law principles, yet enforcement success depends on strengthening digital oversight systems, harmonizing cross-sector regulations, and enhancing law enforcement capacity and digital forensics capabilities. This study contributes to legal scholarship by demonstrating the need for an integrated approach combining criminal prosecution, regulatory reform, and institutional capacity building, recommending that policymakers and law enforcement agencies prioritize modernizing pharmaceutical surveillance through digital systems, harmonizing regulations across relevant agencies, and developing specialized law enforcement units equipped with advanced forensic capabilities to effectively combat pharmaceutical crimes.Praktik penjualan obat keras tanpa resep dokter ini dipicu oleh berbagai faktor, antara lain kemudahan akses yang diinginkan masyarakat, harga obat yang lebih murah dibandingkan konsultasi dokter. Metode yuridis normatif. Pendekatan ini dilakukan dengan menelaah ketentuan-ketentuan hukum positif yang berlaku, khususnya Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan, serta ketentuan hukum pidana yang relevan, untuk mengkaji dasar hukum penegakan terhadap peredaran obat keras tanpa resep dokter. Menurut peneliti penerapan asas ne bis in idem harus diperhatikan dalam penanganan kasus-kasus seperti ini, dimana seseorang tidak dapat diadili dua kali untuk perbuatan yang sama. Oleh karena itu, jaksa penuntut umum harus cermat dalam merumuskan dakwaan agar dapat menjangkau seluruh aspek perbuatan yang dilakukan terdakwa tanpa melanggar asas tersebut. Sehingga menurut penulis Putusan No. 302/Pid.Sus/2024/PN Cjr memang menjadi langkah awal penting dalam menindak pelaku kejahatan farmasi. Namun, tanpa reformasi sistem pengawasan dan penegakan hukum yang menyeluruh, peredaran obat ilegal akan terus menjadi ancaman. Berdasarkan uraian mengenai pengaturan hukum pidana. Ketentuan pidana yang diatur dalam Pasal 435 beserta unsur-unsur tindak pidananya memberikan landasan hukum yang kuat untuk menindak pelaku, baik individu maupun korporasi, yang memproduksi atau mengedarkan obat keras tanpa memenuhi persyaratan. Putusan No. 302/Pid.Sus/2024/PN Cjr mencerminkan bahwa penegakan hukum terhadap peredaran obat keras tanpa resep dokter di Indonesia telah berjalan, namun masih menyisakan sejumlah kelemahan struktural dalam sistem regulasi dan pengawasan farmasi. Kasus ini menggarisbawahi perlunya reformasi menyeluruh, tidak hanya melalui pendekatan pidana, tetapi juga dengan memperkuat sistem pengawasan digital, harmonisasi regulasi lintas sektor, serta peningkatan kapasitas penegakan hukum dan forensik digital
Analysis of Legal Protection for Consumers in Property Credit: Promoting the Value of Justice
This article analyzes the legal protections afforded to consumers within property credit agreements, emphasizing the critical role of justice in ensuring equitable outcomes. Employing a qualitative research methodology, this study explores the existing legal framework, its practical application, and the challenges faced by consumers in navigating the complexities of property credit. The analysis incorporates scholarly perspectives and recent legal developments to advocate for enhanced consumer protection measures that align with principles of fairness and transparency. Findings reveal significant gaps in the current legal framework, particularly in addressing power imbalances between lenders and borrowers, as well as in providing accessible remedies for consumers facing unfair practices. The study highlights the need for clearer disclosure requirements, stronger enforcement mechanisms, and improved financial literacy programs to empower consumers. By synthesizing theoretical insights with empirical observations, this research contributes to the ongoing discourse on consumer rights and proposes actionable reforms to strengthen the legal safeguards within property credit agreements. Ultimately, the article underscores the importance of a justice-oriented approach in fostering a more equitable and transparent credit market
Pentingnya Audit Investigasi pada Perusahaan Unicorn Indonesia yang Melakukan Penipuan Investasi
This study aims to analyze in more depth the case of alleged manipulation of eFishery\u27s financial statements, showing the importance of investigative audits in maintaining transparency, accountability, and investor trust. This study uses a normative legal approach to analyze the alleged manipulation case of eFishery\u27s financial statements and the urgency of investigative audits in preventing and prosecuting similar cases in Indonesian unicorn companies. Common fraud schemes include financial statement manipulation, where companies inflate revenue, record fictitious transactions, or conceal debt to create an illusion of profitability. Additionally, Ponzi schemes pose a significant risk to investors, as returns promised to earlier investors are paid using funds from new investors rather than legitimate business profits. Regulations such as Law No. 8 of 1995 on Capital Markets and Law No. 10 of 1998 on Banking require companies raising public funds to provide transparent and accurate financial information. In the case of eFishery, investigative auditing is essential to uncover potential violations of these regulations. Findings from investigative audits can be used by regulators such as OJK, Bappebti, and Kominfo to tighten supervision and take action against companies proven to engage in fraudulent practices. Additionally, investigative auditing plays a preventive role in maintaining investor confidence and ensuring the sustainable, transparent growth of the startup ecosystem.Penelitian ini bertujuan untuk menganalisis lebih mendalam kasus dugaan manipulasi laporan keuangan eFishery, menunjukkan pentingnya audit investigasi dalam menjaga transparansi, akuntabilitas, dan kepercayaan investor. Penelitian ini menggunakan pendekatan hukum normatif untuk menganalisis kasus dugaan manipulasi laporan keuangan eFishery dan urgensi audit investigasi dalam mencegah dan mendakwa kasus serupa pada perusahaan unicorn Indonesia. Skema penipuan yang umum terjadi termasuk manipulasi laporan keuangan, di mana perusahaan menggelembungkan pendapatan, mencatat transaksi fiktif, atau menyembunyikan utang untuk menciptakan ilusi keuntungan. Selain itu, skema Ponzi menimbulkan risiko yang signifikan bagi investor, karena pengembalian yang dijanjikan kepada investor sebelumnya dibayarkan menggunakan dana dari investor baru daripada keuntungan bisnis yang sah. Peraturan seperti Undang-Undang No. 8 Tahun 1995 tentang Pasar Modal dan Undang-Undang No. 10 Tahun 1998 tentang Perbankan mengharuskan perusahaan yang menghimpun dana masyarakat untuk memberikan informasi keuangan yang transparan dan akurat. Dalam kasus eFishery, audit investigasi sangat penting untuk mengungkap potensi pelanggaran peraturan tersebut. Temuan audit investigasi dapat digunakan oleh regulator seperti OJK, Bappebti, dan Kominfo untuk memperketat pengawasan dan mengambil tindakan terhadap perusahaan yang terbukti melakukan praktik penipuan. Selain itu, audit investigasi berperan sebagai tindakan pencegahan dalam menjaga kepercayaan investor dan memastikan pertumbuhan ekosistem startup yang berkelanjutan dan transparan
Cultural Distortion in Marriage Taaruf Through Matchmaking Applications from the Perspective of Islamic Law
The advancement of technology has transformed the way individuals seek life partners, including among Muslims. One emerging phenomenon is the use of matchmaking applications as a medium for taaruf in preparation for marriage. This study aims to analyze the use of matchmaking applications as a taaruf medium from the perspective of Islamic law. The research employs a qualitative method with a literature study approach, examining various sources related to Islamic family law, the concept of taaruf, and the use of technology in partner-seeking. The findings indicate that Islam does not prohibit the use of technology in finding a spouse, provided that Sharia principles are upheld, such as maintaining interaction boundaries, involving a guardian (wali), and prioritizing the right intentions. Several applications offer features that support Islamic taaruf, such as identity verification, filtering potential partners based on Islamic values, and guardian supervision in communication. However, challenges such as the risk of identity misuse and potential deviations from Islamic norms must be considered. Therefore, regulations and user education are necessary to ensure that these applications are used wisely and remain within the framework of Islamic law. Legal Position of Business Competition Law in the Perspective of Legal Certainty in Indonesia: A Normative Study of Law No. 5 of 1999 Post-Omnibus Law
This study aims to analyze the legal position of business competition law within Indonesia’s legal system following amendments introduced by the Omnibus Law, as well as its implications for legal certainty in competition case resolution. This research employs a normative legal method through legislative, conceptual, and case approaches. The findings indicate that Law No. 5 of 1999, after being amended by the Omnibus Law, places competition law within the administrative non-criminal legal framework, yet still leaves several legal uncertainties, particularly regarding the authority of the Business Competition Supervisory Commission (KPPU) in conducting investigations. These uncertainties result in inconsistencies in law enforcement and overlaps with other legal systems. This study recommends a comprehensive procedural framework for business competition law, reinforcing KPPU’s position as an auxiliary state institution with full authority over administrative investigations, along with improvements in evidence mechanisms

Marriage data disparity between marriage registration agency and the people reluctivity to register their marriage due to inaccessibility of Civil Registration Office are few marriage registration problems in Indonesia, therefore the Ministry of Religion brought the idea to provide services for all religions through KUA Inklusif. The main concern in this article is the authority and the possibility of KUA as a one-stop service for all religion marriage registration. This research uses a normative juridical approach method by examining library materials or secondary data. This research is descriptive analytical, describing the applicable laws associated with legal theories and the implementation related to the problems to be studied. KUA is under the auspices of the Directorate General of Islamic Community Guidance, one of whose functions is to carry out marriage registration for the Muslim community so that the KUA is not authorized to carry out marriage registration for other religion
Analisis Sebaran Dan Edukasi Hipertensi Menggunakan Sistem Informasi Geografis (GIS)
Hipertensi atau tekanan darah tinggi merupakan salah satu penyakit tidak menular yang menjadi masalah kesehatan global, dengan prevalensi yang terus meningkat setiap tahun. Penyakit ini berkontribusi signifikan terhadap angka kematian dan kecacatan global, termasuk 12,8% dari total kematian dunia dan 3,8% DALYs. Diprediksi bahwa pada tahun 2025, jumlah penderita hipertensi secara global mencapai 1,56 miliar jiwa. Hipertensi didefinisikan sebagai tekanan darah sistolik ≥140 mmHg dan diastolik ≥90 mmHg yang diukur dalam dua atau lebih pengukuran. Penyebab utamanya adalah peningkatan curah jantung atau resistensi perifer, dengan 90% kasus termasuk hipertensi primer yang penyebabnya belum diketahui. Jika tidak ditangani dengan baik, hipertensi dapat menyebabkan komplikasi serius seperti stroke, penyakit jantung, dan gangguan ginjal. Di Provinsi Jawa Tengah, kasus hipertensi menunjukkan tren peningkatan signifikan, dari 379.084 kasus pada 2016 menjadi 2.543.732 kasus pada 2020. Di Kota Semarang, hipertensi menjadi penyakit peringkat kedua pada 2023 dengan 88.113 kasus, di mana wilayah kerja Puskesmas Bandarharjo menempati peringkat ketiga. Sistem Informasi Geografis (GIS) memiliki potensi besar dalam menggambarkan distribusi dan pola penyebaran penyakit seperti hipertensi. Tourism isthe transformation of the digital era, especially information technology and communication in terms of finding information. the increase in existing internet such as social media has the opportunity to increase hotel occupancy. tourism potential is an attractive destination for domestic and foreign tourists. this is a challenge in increasing hotel occupancy there is especially in the digital era which is full of competition. therefore the use of digital technology and hotel marketing and services are the main keywords in increasing hotel occupancy.

Human Rights Protection In The Distribution Of Humanitarian Aid To War Refugees
The war in Syria has caused a major humanitarian crisis, causing millions of civilians to flee to various countries, especially in the Middle East. This condition demands a fast, equitable, and effective distribution of humanitarian aid. In the distribution process, the protection of human rights (HAM) is crucial so that all refugees gain access to aid fairly and without discrimination. This study aims to analyze the implementation of human rights protection in the distribution of humanitarian aid for Syrian refugees and identify the challenges faced. The method used is a normative and empirical legal approach with a case study in Jordan, a country with many Syrian refugees, and a strategic point for the distribution of international aid. Data were obtained from an analysis of global and national refugee law and the results of interviews and observations in the field. The findings show that although there are international legal instruments such as the 1949 Geneva Convention, Additional Protocols, and the UN Charter, their implementation in the field is still weak. Discrimination in access to aid, lack of transparency, and exploitation of vulnerable groups such as women and children were found. In addition, dependence on international organizations and weak coordination between humanitarian actors hamper distribution effectiveness. Strengthening monitoring mechanisms, increased coordination, and human rights-based policies are needed to make aid distribution more inclusive and equitable
Handling of Land Plots That Violate Protected Rice Fields: The Urgency of Law Enforcement and Food Security Protection
Soil plays a crucial role in human life and the ecosystem, serving as a source of food, shelter, and regional regulation in Indonesia. Land use is governed by agrarian law, including the regulation of protected agricultural areas. However, violations related to the conversion of protected rice fields pose a significant threat to national food security. This study examines cases of land conversion in Semarang Regency, where land designated for protected rice fields has been misused for residential or commercial purposes, violating government regulations. The aim of this research is to analyze the legal implications of such violations and to provide policy recommendations to the National Land Agency. This research uses the empirical juridical method with a descriptive analytical approach. The results indicate that the conversion of protected rice fields has a detrimental impact on food security, reduces agricultural land, and affects farmers’ welfare. The study emphasizes the need for stronger legal enforcement and effective policy implementation by the National Land Agency to address land conversion issues. This research contributes to the efforts of land protection and the enforcement of agrarian law in Indonesia
