    Law Enforcement Against Perpetrators of Imported Clothing Smuggling as an Economic Crime to Enhance the National Economy

    Smuggling at present has reached an alarming level, no longer merely constituting an economic offense but amounting to an economic crime. The smuggling of goods, particularly textiles, has caused significant losses and adversely affected the national economy. The state’s response in establishing a special task force to address smuggling has, in practice, been unable to eradicate the influx of smuggled goods in a comprehensive manner. Measures undertaken thus far have proven inadequate in resolving the problem. The sanctions provided under Law No. 17 of 2006 on Customs, in the form of criminal penalties and/or fines, are considered insufficient if the objective is to recover the losses suffered by the state, both in terms of taxation and other economic consequences. In reality, such sanctions have failed to create a deterrent effect, leaving the state in a position of continual loss

    Legal Philosophy in Construction Contract Dispute Resolution: Between Arbitration and Litigation

    Disputes in construction contracts are a common occurrence due to project complexity, differing interpretations of clauses, and delays in work execution. In practice, two main dispute resolution paths are often chosen: arbitration and litigation. This study stems from the need to examine these dispute resolution mechanisms not only from a procedural perspective but also from a legal philosophy perspective that emphasizes the values ​​of justice, legal certainty, and expediency. The purpose of this study is to understand how legal philosophy can serve as a basis for selecting and assessing the effectiveness of arbitration and litigation as forums for resolving construction contract disputes. This study uses a juridical-normative method with a qualitative approach, supported by a comparative analysis of regulations, arbitration and court decisions, and relevant legal philosophy literature. The analysis shows that arbitration emphasizes efficiency, confidentiality, and procedural flexibility, thus closer to the values ​​of expediency and legal certainty. Conversely, litigation offers formal legitimacy, transparency, and broader legal protection, reflecting the values ​​of formal justice. However, both have limitations: arbitration is often hampered by high costs, while litigation is often protracted. The selection of a dispute resolution mechanism in a construction contract should be based not only on practical aspects but also on philosophical considerations regarding the objectives of the law.     The Principle of Penal Mediation: An Analysis of the Integration of Justice, Legal Certainty, and Utility in the Settlement of Fraud and Embezzlement Cases

    This study analyzes the implementation of penal mediation within the Indonesian criminal justice system, specifically for fraud and embezzlement offenses. Although adopted through the Indonesian National Police Chief Circular Letter No. SE/8/VII/2018, penal mediation faces significant challenges in achieving a harmonious integration of the principles of justice, legal certainty, and utility. Using a normative juridical method and qualitative analysis through the lens of Lawrence M. Friedman\u27s legal system theory, this research reveals a critical misalignment between its theoretical promise and practical application. The findings identify the root causes as the absence of a strong legal foundation, fragmented authority among institutions, and the dominance of a positivist legal culture. As its primary contribution, this study formulates a holistic, systemic reformulation framework comprising: (1) the strengthening of legal substance through umbrella legislation that standardizes formal and material requirements; (2) structural reform through the certification of independent mediators and deeper integration of the process into the integrated criminal justice system; and (3) a contextual cultural approach that accommodates socio-local wisdom. The proposed framework is designed to harmonize the three dimensions of the legal system to establish a penal mediation mechanism that is legitimate, just, and effective

    Comparative Analysis of Social Enterprise Regulations in ASEAN: Opportunities for Socio-Economic Development in Indonesia

    Social enterprises have attracted global attention due to their ability to simultaneously combine economic objectives and social missions. Thailand, the Philippines, and Singapore are examples of countries in Southeast Asia that have developed different regulatory frameworks to support the growth of social enterprises. This study aims to analyze the regulation of social enterprises in Thailand, the Philippines, and Singapore and explore relevant and contextual ius constituendum to build a national legal framework for social enterprises in Indonesia. The research method used is a comparative study and literature review of regulations, government policies, and social enterprise development practices in the three countries. The results show that Thailand implements the Social Enterprise Promotion Act that provides legal recognition and fiscal incentives; the Philippines uses a hybrid approach through cooperative regulations and government policies; while Singapore emphasizes ecosystem development through supporting institutions, training, and access to financing. Based on these findings, Indonesia requires a national legal framework that includes formal legal recognition, social and economic accountability, fiscal incentives, and multi-sector collaboration mechanisms, so that social enterprises can play an effective role in sustainable development

    The Money politics has long been a major concern in the context of general elections in Indonesia. From a legal perspective, the practice of money politics has serious implications for the integrity and fairness of the electoral process. Through a comprehensive legal review, this article investigates the legal framework governing money politics in the 2024 Indonesian elections. By analyzing existing regulations, implementation challenges, and law enforcement efforts, this article presents a clear picture of the status of money politics in the Indonesian legal system. The conclusion highlights the importance of proactive measures to strengthen law enforcement, raise public awareness, and improve the electoral system to maintain integrity and fairness in future elections

    This article presents a progressive hermeneutic model as an interpretive framework for resolving Sharia economic disputes, using a case study of the Majene Religious Court Decision Number 1/Pdt.G.S/2024/PA.Mj. This research is driven by the finding that the judge’s hermeneutic approach in Sharia economic cases remains dominated by a legal-formal orientation, particularly in cases resolved through a peace deed. The standard clauses of Islamic banking, the limited scope for judicial interpretation, and the weak protection of vulnerable parties within the contractual structure indicate the need for a more responsive hermeneutic framework, grounded in the principle of substantive justice and based on maqāṣid al-shari’ah. Using normative-empirical methods, this study develops a progressive hermeneutic model grounded in three pillars: normative texts, socio-economic contexts, and the moral goals of Islamic law

    Penelitian ini bertujuan memetakan pola penggunaan insektisida dan mendeteksi residunya pada jagung di Desa Lambara Kecamatan Tanambulava, Kabupaten Sigi sebagai upaya mitigasi risiko pencemaran dan ketidakamanan pangan. Hasilnya diharapkan menjadi dasar rekomendasi penggunaan pestisida yang lebih tepat guna. Penelitian ini dilaksanakan pada bulan Februari hingga Juni 2024, bertempat di Desa Lambara, Kecamatan Tanambulava, Kabupaten Sigi. Pelaksanaan Penelitian dibagi menjadi dua tahapan, Tahap survey dan Tahap pengujian residu insektisida.  Data yang dikumpulkan terdiri atas karakteristik responden, jenis bahan aktif insektisida, frekuensi aplikasi, pencampuran insektisida dan deteksi residu insektisida. Berdasarkan hasil penelitian,  Insektisida yang banyak digunakan dengan bahan aktif 40% metomil. Frekuensi aplikasi insektisida sebanyak enam kali, kadar residu metomil ditemukan sebesar ≤ 0,010 mg/kg, residu yang ditemukan pada jagung tersebut berada di bawah atau sama dengan BMR yang diizinkan, dengan demikian jagung tersebut aman dan sesuai dengan standar yang ditetapkan untuk konsumsi manusia.     Tujuan penelitian ini untuk mengkaji peran pupuk KCl terhadap pertumbuhan dan hasil tanaman bawang merah (Allium ascalonicum L.) varietas Tajuk pada cekaman kekeringan. Penelitian dilaksanakan pada bulan September - Desember 2024. Lokasi penelitian di lahan penelitian Fakultas Pertanian Universitas Pembangunan Nasional “Veteran” Surabaya Jawa Timur. Suhu rata-rata per tahun 24°-34° C. Penelitian ini merupakan penelitian faktorial dengan dua faktor yang disusun dengan menggunakan Rancangan Acak Lengkap (RAL). Faktor  pertama, yaitu pemberian Konsentrasi PEG 6000 (K) yang terdiri dari 5 taraf, yaitu 0%, 5%, 10%, 15% dan 20%. Faktor kedua, yaitu pemberian dosis pupuk KCl (D) terdiri dari 4 taraf, yaitu 1 g KCl/polybag, 1,3 g KCl/polybag, 1,6 g KCl/polybag dan 2 g KCl/polybag. Data parameter dianalisis menggunakan Analisis Ragam (Anova) dan di uji lanjut dengan Uji Beda Nyata Jujur (BNJ) pada taraf 5%. Parameter yang diamati panjang tanaman (cm), jumlah daun per rumpun, dan bobot basah umbi per rumpun (g). Hasil penelitian menunjukkan pemberian konsentrasi PEG 6000 5% dan dosis pupuk KCl 1,3 g KCl/polybag memberikan pengaruh nyata pada parameter panjang tanaman dan tidak berbeda nyata pada parameter jumlah daun per rumpun dan bobot basah umbi per rumpun (g).     The Improving Soil Fertility: The Impact of Organic Amandements and Basal Fertilizers

    This study aimed to determine the optimal combination of soil amendments and basal fertilizer application to maximize cucumber yield. A factorial experiment was conducted in 2021, assessing the effects of two factors: soil amendments (cow manure and raw rice husk) and basal fertilizer application (with and without). The experiment employed a Randomized Complete Block Design (RCBD) with two replications. Soil analysis prior to the experiment revealed low nitrogen, high phosphorus, and high potassium levels. Data on cucumber yield, plant biomass, and nutrient use efficiency were collected and analyzed using ANOVA and Duncan\u27s Multiple Range Test (DMRT). Results showed that cow manure significantly increased cucumber yield compared to rice husk. The combination of basal fertilizer and cow manure resulted in the highest yield and most efficient nutrient use. These findings highlight the importance of integrated soil fertility management strategies for maximizing cucumber production.     PT. Yuksri Prima Indonesia menghadapi fluktuasi penjualan pada produk ayam ungkep, yang mengindikasikan adanya permasalahan pada strategi pemasaran, kepuasan, dan loyalitas konsumen. Penelitian ini bertujuan untuk menganalisis pengaruh Segmentation, Targeting, dan Positioning (STP) terhadap kepuasan dan loyalitas konsumen. Metode yang digunakan adalah pendekatan deskriptif kuantitatif yang bersifat explanatory di Kota Bekasi. Pengumpulan data dilakukan melalui kuesioner kepada 100 responden dan dianalisis menggunakan regresi linier berganda. Hasil penelitian menunjukkan bahwa secara simultan, STP berpengaruh signifikan terhadap kepuasan (99,9%) dan loyalitas (95,2%) konsumen. Secara parsial, segmentation berpengaruh positif terhadap kepuasan, namun targeting dan positioning berpengaruh negatif. Terhadap loyalitas, segmentation dan targeting berpengaruh negatif, sedangkan positioning berpengaruh positif. Kesenjangan antara ekspektasi yang dibangun melalui targeting dan positioning dengan pengalaman nyata konsumen menjadi penyebab utama penurunan kepuasan. Disarankan perusahaan mempertahankan segmentasi yang ada, namun mengevaluasi ulang strategi targeting dan positioning agar lebih konsisten dengan kualitas produk untuk membangun loyalitas jangka panjang.
