    AI model training: consent or legitimate interest? Guidance on choosing the most appropriate legal basis

    ChatGPT, Gemini, CoPilot are just some among the most talked-about examples of large generative AI models whose functioning relies on algorithms trained by means of large amounts of data. Acknowledging that such data may also include “information relating to an identified or identifiable natural person”, AI developers should then address the issue of the compliance of such models with personal data protection legislation. In this regard, this article seeks to identify, from an accountability perspective, the most appropriate legal basis for the collection and processing of personal data for AI training purposes. Specifically, after noting that - except in very limited cases - the choice should narrow between the prior consent of data subjects and a legitimate interest pursued by the controller or a third party, the article will first explore the pitfalls of a consent-only approach which indeed risks making data processing extremely burdensome for controllers. Next, the article will deal with the possibility of recognising and accepting legitimate interest as an appropriate legal basis for the pursuit of algorithm training purposes, through the implementation of sophisticated mitigation measures that can make the use of this basis as safe as possible for data subjects. Finally, assuming that legitimate interest can be used as a legal basis for algorithm training purposes, the article suggests overcoming the separation between the AI model development and deployment stages in order to choose the most appropriate legal basis between consent and legitimate interest

    Dataset Assessment Tools for the AI Act Compliance of High-Risk AI Systems

    The European Union’s Artificial Intelligence Act (AI Act), effective as of August 2024, introduces stringent data governance requirements for high-risk AI systems. Central to these obligations is the mandate for data used in training, validation, and testing to be subject to rigorous quality controls and governance practices aligned with the system's intended purpose. This paper examines the AI Act’s novel emphasis on responsible data handling as a foundation for mitigating bias, ensuring safety, and protecting fundamental rights. It argues that while existing scholarship largely focuses on algorithmic fairness at the model level, insufficient attention has been given to fairness embedded within the data itself. Addressing this gap, the paper explores the complex ethical and epistemological tensions inherent in defining “fairness”, and critiques current policy frameworks for their narrow focus on technical fixes. The study highlights the FAnFAIR tool as a pioneering approach to data fairness evaluation, offering a hybrid methodology that integrates automated statistical diagnostics with qualitative, context-aware assessments. FAnFAIR aligns its features with the AI Act’s legal mandates and facilitates compliance through continuous bias monitoring, data quality enhancement, and informed decision-making about dataset suitability. This paper provides a socio-legal and technical analysis of data governance under the AI Act, advocating for a shift toward embedded ethical oversight throughout the AI lifecycle and, in particular, in the data processing phase

    Angelo Maria Ripellino e la poesia sovietica: Posizionamenti nel campo editoriale e letterario nazionale e transnazionale

    L’articolo si concentra sulla figura di Angelo Maria Ripellino (1923-1978), slavista e collaboratore editoriale presso la casa editrice Einaudi. Attraverso un’indagine sociologica, ispirata dal quadro teorico di Pierre Bourdieu, si analizzano la corrispondenza di Ripellino con l'editore e gli elementi paratestuali relativi alla traduzione di poesia sovietica – nello specifico la traduzione delle poesie di Boris Pasternak (1959), dell’antologia Nuovi poeti sovietici (1961) e del poema Lenin di Vladimir Majakovskij (1967) –, per mettere in luce i tentativi di posizionamento di Ripellino nel campo intellettuale italiano tra la fine degli anni Cinquanta e gli anni Sessanta, e rispetto alle dinamiche della Guerra Fredda.     This article focuses on Angelo Maria Ripellino (1923-1978), Slavic Studies scholar and publishing agent working for the Turinese publishing house Einaudi. Drawing on a sociological framework, inspired by Pierre Bourdieu, it investigates Ripellino’s correspondence with the publisher as well as paratextual elements related to the translation of Soviet poetry – specifically, the translation of Boris Pasternak’s poems (1959), of the anthology Nuovi poeti sovietici (1961) and of Vladimir Mayakovsky’s poem Lenin (1967) – in order to shed light on his positionings within the Italian intellectual field between the end of the Fifties through the Sixties, and within the Cold War dynamics

    Da giovanile passione, una di quelle che prende alla gola e comporta una cospicua spesa in libri, la letteratura spagnola diviene un riferimento centrale per la costituzione della poetica pasoliniana degli anni friulani, per venire meno nei decenni successivi. Lungi dal volerne indagare puntualmente la genealogia e gli sviluppi, l’obiettivo di questo staggio è di ricostruire la traiet-toria di Pasolini nel campo letterario applicandovi il filtro ‘letteratura spagnola’, rimarcandone continuità, oscillazioni e rotture. In tal modo si osserverà come l’alveo spagnolo si riverberi, seppur discontinuamente, lungo l’intero arco qui descritto manifestandosi in forme e generi sempre diversi rinnovati, dalla Pìssula antologia ibèrica degli anni Quaranta al ‘picarismo’ di Ragazzi di vita e Petrolio, passando per Uccellacci e uccellini e la tragedia Calderón.   Started as a youthful passion – one of those that grips the throat and entails a considerable purchase of books – Spanish literature rapidly becomes a central reference for Pasolini’s poetics during his Friulian experience, although it seemed to fade in the following decades. Far from aiming to investigate its genealogy and developments, the objective of this essay is to reconstruct Pasolini’s trajectory within the literary field through the lens of ‘Spanish literature’. By observing continuities, oscillations and ruptures, it should be possible to analyze its reflection in Pasolini’s work and its appearance in heterogeneous genres and forms, from the Pìssula antologia ibèrica to the ‘picareqsue’ novels Ragazzi di vita and Petrolio, through Uccellacci e uccellini and the drama Calderón

    This paper intends to deepen the deconstructive debate that Derrida proposes with Agamben’s thought in The Beast and the Sovereign (2002-2003). In particular, it is aimed to analyse the concept of naked life (bloß Leben) understood as the original performance of the sovereign power, as outlined in Homo Sacer (1995). This discussion highlights the intertwining of life and politics, which characterises both deconstruction and biopolitics. They demonstrate an unexpected closeness and an unbridgeable distance, which may be summarised by three different logics: Agamben’s ‘logic of exception’, which is countered by the proposal of destituent power; Esposito’s ‘logic of immunisation’, from which a new instituting thought can be delineated; Derrida's ‘logic of supplement’. The latter proposes a different reading of zôon politikon and allows us to outline a new autoimmunitarian logic of life-death that one has to understand in order to deal with the spectres of crisis of contemporary democracie

    The article sketches a possible line of development on the Oxbridge-Turin axis from the early analytic philosophy of Peano and Russell to the analytically renewed legal theory of Bobbio and Hart. The paper discusses the different character of the interactions between Russell and Peano and Bobbio and Hart, and then analyzes some of Bobbio’s main critical contributions to the discussion of Hart’s theory on obligation, secondary rules, and the notion of sanction. Finally, it hypothesises that some of the most famous theses of Hart’s theory were briefly anticipated by Bobbio in writings from the late 1950s

    Javanese women and their noble values: From Påncå Wastå to Kåncå Wingking in Mangkunegaran Principality, Surakarta, Indonesia

    This article explores the profound meaning of kåncå wingking in the context of the Babad Tutur of K.G.P.A.A. Mangkoenagoro I, the Serat Piwulang scripts by K.G.P.A.A. Mangkoenagoro IV, and the real-life practices of the princesses and consorts in Praja Mangkunegaran, Surakarta, Indonesia. Previous research on kåncå wingking has predominantly focused on women’s domestic responsibilities and the notion that they lack agency over their lives. However, the research of Kumar and Carey reveals the significant involvement of Praja Mangkunegaran women in the realms of arts, defense, and governance. Employing an ethnographic approach from a qualitative perspective, this study reveals the pivotal role of Javanese women in leading and harmonizing the spiritual main system between their husbands, family, and Praja Mangkunegaran. It explores the role of Javanese women in Praja Mangkunegaran, emphasizing their leadership and ability to balance the spiritual framework. The Serat Piwulang scripts are implemented through their authority and status, aligning with Islamic principles of impartiality. Wara Srikandhi, a puppet character, represents the attainment of spirituality and true nirvana in Javanese ethical and aesthetic values. Princesses and consorts are regarded as mustikaning wanudya, embodying spiritual strength, gentleness, and grace. Meanwhile, Kåncå wingking represents the culmination of the implementation and interpretation of Påncå Wastå and the flaming womb in the roles of angamatjani and ardhanareswari. The findings suggest that the meaning of kåncå wingking is rooted in rightful authority, celebrating the glory of Javanese women as sources of spiritual power

    Diversi ma uniti: Identità culturale e patrimonio archeologico nei musei pubblici nella Cina contemporanea

    This article analyses the assertion of Chinese national identity through museological and museographic practices of enhancing Chinese archaeological heritage in contemporary public museums in China. Museum practices on prehistoric collections displayed in permanent exhibitions reveal a narrative account of Chinese civilisation that exploits the past and the inherently incomplete nature of prehistory to establish the current nationalistic characteristics of collective cultural identity in China. With a case study of China's Neolithic pottery exhibits, this analysis uses primary data collected during field research. It includes analytical details on the content of permanent galleries in public museums, interviews with museum staff, and written visitor questionnaires. The exhibits of Chinese Neolithic vessels highlight the efforts of contemporary public museums in providing narratives about the prehistoric past with socio-political functions, which disseminate the identity values of unity and cohesion. In this context, Chinese identity is defined in cultural-historical terms, which, legitimised by the supposed millenary cultural continuity of Chinese civilisation, homogenise differences by promoting a cultural unicum with an assimilatory intent summarised in the paradigm ‘unity in diversity’ or ‘plural unity’ (duoyuan yiti多元一體). The scientific discipline of archaeology, legitimised by the authority of the museum institution and supported by highly effective museographic choices, lends credibility to the narratives presented in museums. This study sheds light on the role of museum strategies that intersect with broader political, cultural and social dynamics in an era of economic neo-liberalism and a booming heritage industry, and that reinforce the values of cultural nationalism domestically and are charged with China's claim to be among the great civilisations internationally.Questo articolo analizza l’affermazione dell’identità nazionale cinese attraverso le pratiche museologiche e museografiche di valorizzazione del patrominio archaeologico cinese nei musei pubblici contemporanei in Cina. Le pratiche museali pertimenti a collezioni preistoriche esposte in mostre permanenti rivelano un resoconto narrativo della civiltà cinese che sfrutta il passato e la natura intrinsecamente incompleta della preistoria come strumento per stabilire le attuali caratteristiche nazionalistiche dell'identità collettiva culturale in Cina. Con uno caso studio sulle esposizioni di terracotte neolitiche della Cina, questa analisi usa dati primari raccolti durante ricerca sul campo, e include dettagli analitici sui contenuti delle gallerie permanenti nei musei pubblici, interviste con il personale del museo, e questionari scritti dei visitatori. Le mostre dei vasi neolitici cinesi evidenziano chiaramente gli sforzi dei musei pubblici contemporanei nel fornire narrazioni sul passato preistorico con funzioni socio-politiche, che divulghino i valori indentitari di unità e coesione. In questo contesto, l’identità cinese è definita in termini storico-culturali, che, legittimati dalla presunta continuità culturale millenaria della civiltà cinese, omogeninzzano le differenze promuovendo uno unicum culturale con un intento assimilatorio riassunto nel paradigma ‘unità nella diversità’ o ‘unità plurale’ (duoyuan yiti 多元一體). La disciplina scientifica dell'archeologia, legittimata dall'autorità dell’istituzione museale, e supprtata da scelte museografiche di grande efficacia, conferisce credibilità alle narrazioni presentate nei musei. Questo studio fa luce sul ruolo delle strategie museali che si intersecano con dinamiche politiche, culturali e sociali più ampie in un'epoca di neoliberismo economico e di boom dell'industria del patrimonio culturale, e che rafforzano i valori di nazionalismo culturale domesticamente e sono cariche di pretese della Cina di figurare tra le grandi civiltà a livello internazionale

    Ontologia e tecnica: La filosofia futura tra Vattimo e Severino

    The following paper aims to outline the relations between ontology and technique in Gianni Vattimo and Emanuele Severino, to indicate the contribution that these two thinkers leave to future philosophy. Vattimo and Severino, two protagonists of contemporary Italian philosophy, offer two totally different ontological accounts. On the one hand, an ontology characterized by the ‘historical nature’ of being and the critique of the traditional notion of truth; on the other, the exposition of the ‘original structure’, whose foundation is the eternity of being as such and which implies the radical critique of the western civilization, which results alienated. The ontological accounts of both philosophers are closely linked to their philosophy of technique and their reflection on the role of politics in technique civilization. Such research can offer important inspiration for thought to understand our world and its future
