    Discrezionalità amministrativa e principio del risultato

    The paper is devoted to investigating the relationship between administrative discretion and the role of legal principles, from the perspective of the contract to which a public body is a party. As is well known, the new Italian Contracts Code opens with a series of principles, placed in hierarchical order. According to both the legal literature and the first decisions of the administrative courts, it is possible to identify solutions to the problem that are also very distant from each other. The most widespread is the one for which the introduction of the principles and the (only partial) overcoming of the regulation of extremes of detail would result in the creation of significant margins of administrative discretion; administrative discretion that would be necessary in relation to the administrative activity through the contract in order for it to achieve its result. As I see it, this orientation is wrong to hold that principles are a source of discretionary power and not its limit. A second, narrower but very authoritative orientation has argued that the principles of the Italian Contracts Code have, in reality, no relevance, because they would be nothing more than summaries of other principles and rules that are in any case applicable. The fault of this orientation is that it overlooks the fact that the hierarchical ordering of principles determines a criterion for discretionary decisions and for their review by the judge, and this certainly applies to principles in general - so that their composition and ordering is a serious interpretative problem that, instead, in the case of public contracts, is resolved by law. The immediate purpose of the essay is, instead, to demonstrate that the hierarchical ordering of the principles established by the Italian Contracts Code fulfils the function of dictating the criterion both for the interpretation of the rules applicable to the concrete case, and for their application with the exercise of administrative discretion; consequently, on the one hand (that of the exercise of executive power) it derives a profound limitation of the spaces of discretion and, on the other hand (that of jurisdictional review), a criterion for very profoundly reviewing administrative discretion. The mediated aim of the essay is to test the validity of the legal theory of the public interest that was proposed in this very journal – see, vol. XIII (2/2023).Il lavoro è dedicato all\u27indagine della relazione tra discrezionalità amministrativa e ruolo dei principi di legge, nella prospettiva del contratto di cui sia parte un ente pubblico. Come noto, il nuovo Codice dei Contratti italiano si apre con una serie di principi, posti tra loro in ordine gerarchico. Sia secondo la letteratura giuridica che secondo le prime decisioni delle corti amministrative, è possibile individuare soluzioni tra loro anche molto distanti del problema. La più diffusa è quella per la quale l\u27introduzione dei principi ed il (solo parziale) superamento della normazione di estremi dettaglio avrebbero come conseguenza la creazione di margini significativi di discrezionalità amministrativa; discrezionalità amministrativa che sarebbe necessaria in relazione all\u27attività amministrativa attraverso il contratto, per far sì che questa raggiunga il suo risultato. A mio modo di vedere quest\u27orientamento ha il torto di ritenere che i principi siano fonte di potere discrezionale e non un suo limite. Un secondo orientamento, più ristretto ma molto autorevole, ha sostenuto che i principi del Codice dei Contratti italiano non abbiano, in realtà, nessun rilievo, perché non sarebbero altro che riassuntivi di altri principi e norme comunque applicabili. Il torto di questo orientamento è quello di trascurare il fatto che l\u27ordinazione gerarchica dei principi determina un criterio per assumere le decisioni discrezionali e per il loro sindacato da parte del giudice e questo certamente manca ai principi in via generale – sicché la loro composizione e ordinazione è un serio problema interpretativo che, invece, nel caso dei contratti pubblici, è risolto dalla legge. Lo scopo immediato del saggio è, invece, quello di dimostrare che l\u27ordinazione gerarchica dei principi fissati dal Codice dei Contratti italiano assolve alla funzione di dettare il criterio sia per l\u27interpretazione delle norme applicabili al caso concreto, sia per la loro applicazione con esercizio di discrezionalità amministrativa; conseguentemente, per un lato (quello dell\u27esercizio del potere esecutivo) ne deriva una profonda limitazione degli spazi di discrezionalità e, per altro lato (quello del sindacato giurisdizionale), un criterio per sindacare in modo molto profondo la discrezionalità amministrativa.     Making Legal and Enforcement Decisions in the Management of Resources (on the Example of Ukraine)

    Most scientific research is focused on certain aspects of resource management in general, and on natural resources management in particular. However, a comprehensive approach to solving these challenging issues requires clarifying the mechanism of making legal and law enforcement decisions in the field of resource management through the prism of the criteria for their adoption. In addition, the concept of “natural resource management” needs to be replaced by the concept of “resource management”. The Aristotelian (dialectical) method became the leading method of this research at each of its stages. The study of the “resources” concept as a system of interconnected elements was carried out using the synergistic method. The axiological method is important for the systematization of approaches to making legal decisions regarding resource management and the development of a general concept of their adoption. When studying the mechanism of making legal and law enforcement decisions, the formal legal method was used as a special research method. Quantitative methods are justifiably criticized. The application of these methods made it possible to define resources as a complete, interdependent system of elements, as well as to define standards for making legal decisions in the field of resource management

    The aim of this essay is to carry out a stylistic analysis of the language used in a choice of the poems included in the collection This Nothing’s Place by Pasquale Verdicchio, paying particular attention to instances of memory and space, which strongly contribute to a re-definition of the poet’s identity through a sense of belonging. The language connected with the idea of space is foregrounded by stylistic devices such as internal deviation, repetition of lexemes and parallelism of structure. Verdicchio, as a migrant, questions the issue of identity by discovering a place of belonging in a space of spaceless and timeless memory and imagination. The geographies and maps his poems hint at are not only related to physical places but to spaces of emotion, which intertwine in a dimension of fluidity

    In her fiction and poetry, Mary O’Donnell has often touched topics dealing with explicit taboo subjects, masturbation, anorexia, menopause, abortion or domestic violence. In her 2014 novel, Where They Lie, O’Donnell tackles a different taboo, the neglected and disturbing topic of the Disappeared during the Troubles in Northern Ireland. These men and women were kidnapped, killed and buried somewhere in the country, mostly by Republican paramilitaries because believed to be informers. Reticence and lies surround the Disappeared in current discourse and O’Donnell’s novel aims at breaking down this taboo.     Ferdinando Bona contributed to stabilizing the historiographical turn that Manfred Fuhrmann imprinted on Gaian studies (the Institutiones belong to the ancient ‘systematic manual’ literary genre). Bona suggested that the role of diairetical patterns should be redefined. Within the ‘expository system’ of the Institutiones, Gaius\u27 divisiones appear today as a functional tool for the composition of the text and the transmission of information to the reader, like other text organization tools. Among these instruments is the listing, with which the author of a text orders an articulated set of legal information. Confines between listing and division are blurred, and their expository use closely reflects the techniques used for argumentative purposes by Roman jurisprudence. This essay addresses the listings within the text of the Institutiones and the various ways they were used, thus fitting into Bona\u27s research line
