    Nell’ottica di apportare significativi miglioramenti al sistema penale in ogni sua dimensione, la “Riforma Cartabia” punta alla conquista della “terra di mezzo”, l’udienza preliminare: con il precipuo intento di rafforzare il ruolo di filtro contro le imputazioni azzardate, il d.lgs. n. 150/2022 delinea un nuovo iter procedurale che il g.u.p. è tenuto a seguire nel caso di rettifica dell’addebito che – seppur completo in tutti i suoi aspetti – non è conforme alle risultanze emergenti dagli atti processuali. Per questa via, il legislatore genera un insormontabile paradosso: da una parte, rafforza il ruolo di controllo del giudicante che finisce, di fatto, per sostituirsi al p.m. nella formulazione dell’imputazione; dall’altra, l’organo della giurisdizione perde, in udienza preliminare, il potere di qualificare autonomamente il fatto (come, peraltro, previsto dall’art. 521, comma 1, c.p.p. per la fase dibattimentale), dovendo in ogni caso trasmettere gli atti all’organo dell’accusa per contestare l’addebito modificato. Alla luce di tali considerazioni, non sembra superfluo interrogarsi sull’opportunità di mantenere in vita una fase che, nonostante la buona prova di sé nel “tempo di sperimentazione”, non è più in grado di adempiere alle sue funzioni in ragione di un sistema stravolto rispetto a quello delineato dal codice del 1988.With a view to bringing about significant improvements to the criminal justice system in all its dimensions, the “Riforma Cartabia” aims at conquering the “middle ground”: with the main purpose of strengthening the filtering role against reckless charges (whether incomplete or erroneous) with a view to reducing the number of cases, Legislative Decree no. 150/2022 outlines a new procedural procedure to be followed by the judge in the event of rectification of a charge which – although complete in all its aspects – does not conform to the findings emerging from the trial documents. In this way, the legislature generates an insurmountable paradox: on the one hand, the review role of the prosecuting magistrate is strengthened (this time explicitly) and he ends up taking the place of the public prosecutor in the formulation of the charge; on the other hand, the prosecutor’s role is strengthened (this time explicitly) and he is in fact replaced by the prosecutor in the formulation of the charge. in the formulation of the indictment; on the other hand, the judge loses the power to independently re-qualify the fact (as, moreover, provided by article 521, paragraph 1, c.p.p. for the trial phase), having in any case to transmit the acts to the prosecuting body to contest the amended charge. It does not seem superfluous to question the advisability of keeping alive a phase that, despite its good track record during the “trial time”, is no longer able to fulfill its functions because of a system that has been overhauled compared to the one outlined by the 1988 Code

    La legitimatio ad causam della parte civile in pendenza dell’accordo sulla pena: istanze risarcitorie e prospettive liquidatorie

    Per le Sezioni Unite non esistono preclusioni alla costituzione di parte civile in pendenza di un accordo di applicazione della pena già concluso tra imputato e P.M.; di conseguenza, il giudice è tenuto a decidere sulla liquidazione delle spese sostenute dalla stessa, a prescindere dalla domanda sul risarcimento del danno. L’Autore, dopo aver circoscritto gli spazi di manovra concessi al danneggiato nel rito negoziato, si sofferma sull’interesse del medesimo a invocare la pretesa risarcitoria e/o restitutoria nelle more della decisione giudiziale sulla pertinenza e congruità dell’accordo. L’obiettivo è la ricerca di un equo compromesso tra le esigenze di tutela giurisdizionale del danneggiato dal reato e la garanzia della effettiva premialità del patteggiamento che, come noto, implica rinuncia al contraddittorio in cambio di benefici intra ed extra procedimentali

    Choroidal Remodeling After Subthreshold Micropulse Laser in Chronic Central Serous Chorioretinopathy: Short-Term Outcomes

    : Objectives: To evaluate the effects of subthreshold micropulse laser treatment (SMLT) on choroidal architecture in chronic central serous chorioretinopathy (CSC) and their correlations with functional outcomes. Methods: This retrospective study included 48 eyes with chronic CSC that were treated with 577 nm SMLT. The choroidal thickness (CT); Sattler's layer and choriocapillaris complex thickness (SLCCT); Haller's layer thickness (HLT); subretinal fluid (SRF); and best-corrected visual acuity (BCVA) were assessed at baseline and at 2 months post treatment. Results: At 2 months, the SLCCT increased from 185.92 ± 80.89 μm to 214.17 ± 83.36 μm (p = 0.023), and the total CT increased from 444.46 ± 80.43 μm to 484.33 ± 93.19 μm (p = 0.002). The SRF height decreased from 140.38 ± 95.89 μm to 57.58 ± 63.54 μm (p < 0.001), with complete resolution in 79.2% of cases. The BCVA improved from 0.41 ± 0.48 to 0.22 ± 0.30 logMAR (p < 0.001). Changes in the SLCCT correlated negatively with BCVA changes (r = -0.48, p = 0.025) and positively with total CT changes (r = 0.687, p < 0.001). Conclusions: SMLT induces significant choroidal remodeling in chronic CSC, particularly affecting the Sattler-Bruch layer complex. The increase in the SLCCT correlates with visual improvement, challenging the conventional understanding of choroidal thinning in CSC treatment

    Exploring Potential Complement Modulation Strategies for Ischemia–Reperfusion Injury in Kidney Transplantation

    : The complement system plays a crucial role in regulating the inflammatory responses in kidney transplantation, potentially contributing to early decline in kidney function. Ischemia-reperfusion injury (IRI) is among the factors affecting graft outcomes and a primary contributor to delayed graft function. Complement activation, particularly the alternative pathway, participates in the pathogenesis of IRI, involving all kidney compartments. In particular, tubular epithelial cells often acquire a dysfunctional phenotype that can exacerbate complement activation and kidney damage. Currently, complement-modulating drugs are under investigation for the treatment of kidney diseases. Many of these drugs have shown potential therapeutic benefits, but no effective clinical treatments for renal IRI have been identified yet. In this review, we will explore drugs that target complement factors, complement receptors, and regulatory proteins, aiming to highlight their potential value in improving the management of renal IRI

    The efficacy of a modified mandibular advancement device for OSA treatment in a group of adult patients

    Objective: The Mandibular Advancement Device (MAD) is actually recommended for the treatment of Obstructive Sleep Apnea (OSA) with mild or moderate severity. The present study evaluated the effects of a fully customizable MAD-type device (It Makes You Sleep, IMYS), in patients with moderate-to-severe OSA. Methods: Twenty-nine patients (15 men and 14 women; mean age 62, SD +/- 10 years) were retrospectively enrolled. Home Sleep Apnea Testing;(HSAT) was performed for all patients at baseline (T0) and after three months (T1) of IMYS therapy. The analyzed respiratory parameters were: Apnea-Hypopnea Index (AHI), Oxygen Desaturation Index (ODI), Minimum Oxygen Saturation (minSO2) and Medium Oxygen Saturation (medSO2). Results: From T0 to T1, a significant reduction of AHI and ODI was reported, as well as a significant increase of minSO2 and medSO2. Conclusion: The IMYS device could be an effective MAD appliance for treating moderate-to-severe OSA

    The article proposes a reflection on the legal nature of Art. 2 TEU, with particular reference to its judicial application, intended as the possibility of its direct application by the Court of Justice to monitor Member States’ compliance with the values contained in the Treaty. While the doctrine remains divided on this issue, the Court of Justice started moving in this direction, although not yet reaching a conclusion. The absence of advancement in this regard could generate disparities between different values, with certain values becoming subject to particularly rigorous scrutiny, while others remain in a sort of limbo, from which it may be challenging to extract them. This could undermine the effectiveness of Article 2 TEU as a means of safeguarding the constitutional identity of the Union
