تفويض سلطة التشريع للسلطة التنفيذية وضماناته وفق الدساتير السودانية
This research aim to define the legislative and administrative delegation, its importance and justifications, and to clarify the position of the Sudanese constitutions on the legislative mandate.
The problem of the research lies in that the legislative authority is the one that maintains and protects the rights and freedoms of individuals in the state and that the legislative mandate is a waiver by the legislative authority of some of its competencies to the executive authority in accordance with the permission granted to it in order to authorize it the right to issue new laws or amend or cancel effective laws By issuing decrees with laws that have the force of law, which requires providing the necessary guarantees that the executive and legislative authority will not deviate, so that state institutions are not paralyzed and stop exercising their functions.
The most important hypotheses of the research are that the legislative mandate has multiple forms and that it has importance and justifications for its approval in the modern state and that it affects the rights and freedoms of individuals if the executive authority abuses it and that the Sudanese constitutional legislator has placed restrictions on the legislative mandate that should not be exceeded when delegating competencies. The researcher used the descriptive approach, the analytical approach, and the comparative approach between the constitutions of Sudan in the different political eras.
The most important results are that the approval of the legislative mandate is important in the exercise of political and executive work in the state and that it has a number of forms and has controls, conditions and determinants that must be met to ensure that the executive authority does not deviate when using the mandate granted to it, and that the Sudanese constitutions have stipulated the legislative mandate according to its conditions to varying degrees. The most important recommendations of the research came to the necessity of taking the Sudanese constitution with the legislative mandate with its constitutional determinants in jurisprudence, and its precise details to ensure its use without infringing on public rights and freedoms in the state
