Decontesting an essentially contested concept : The standardization of sustainable finance
The aim of this article is to investigate how the standardization process and the public consultations carried out in the development of new sustainable finance standards and laws tend to shape the decontestation of practices in this field. The analysis of 255 comment letters submitted by various stakeholders in the context of these public consultations shows the dual role of standardization as a mechanism for both the decontestation and the (re)contestation of sustainable finance. This article makes important contributions to the emerging literature on the governance of sustainable finance through initiatives that are meant to improve the transparency of disclosures in this field and prevent investor misconduct. In light of Gallie's theory of essentially contested concepts, this article also contributes to the literature on the challenges of developing sustainability standards and the implications of adopting practices centered on concepts whose meanings and applications are the subject of endless disputes
Le renouvellement des méthodes de droit international privé par l’effet du droit de l’Union européenne
Le droit dérivé de l’UE a une réelle incidence sur le droit international privé, mais s’inscrit généralement dans la logique internationaliste. Au contraire, s’appuyant sur le droit primaire, la CJUE a imposé la logique européenne de libre circulation intra-européenne en bouleversant les raisonnement de droit international privé. Si les libertés européennes et la citoyenneté européenne (qui en est le support pour les personnes physiques) ne suppriment pas – ou pas totalement – l’approche conflictualiste, c’est à la condition que cette dernière ne soit pas constitutive d’une entrave : ni la loi désignée par la règle de conflit, ni la loi du for intervenant au titre de loi de police ou dans le jeu de l’exception d’ordre public ne doivent en effet freiner, restreindre ou empêcher la liberté de circulation ou d’établissement de ceux qui en bénéficient. Tout au plus, la Cour de justice admet que pareille entrave puisse exceptionnellement être justifiée par un motif impérieux à condition encore d’être proportionnée au but poursuivi.

Coastal countries’ economic growth and its implication for their mangrove blue carbon
This paper analyzes the determinants of economic growth in coastal countries and discusses their potential consequences on mangrove blue carbon (BC). We use a Bayesian averaging of classical estimates technique to fit models reflecting alternative theories to 1960–2009 data on 23 specific coastal countries with high mangrove blue carbon climate change mitigation potential, BC countries, and 83 generic worldwide countries, WW countries. We find that the neoclassical, demography, macroeconomic policy, and natural capital theories perform well in explaining growth in BC countries. In contrast, investment in physical capital and proxies for macroeconomic policy and natural capital theories are found not to be good predictors of growth in the WW sample. These results point to the critical problem of existing and potentially increasing anthropogenic pressure that coastal areas with BC are and can be subject to due to land conversion for agriculture, aquaculture, farming and other run-offs, marine resources exploitation, uncontrolled sewage, marine resources direct exploitation, and coastal constructions and public works related to natural capital exports. This grim picture of coastal countries raises the important policy questions of whether central governments ought to give local policy makers and communities incentives to promote nature-based solutions to climate change mitigation and the extent to which international financial institutions should provide support for such initiatives in developing countries
Dispersed Information, Nominal Rigidities and Monetary Business Cycles: A Hayekian Perspective
We study the propagation of nominal shocks in a dispersed information economy where firms learn from and respond to information generated by their activities in product and factor markets. We show that imperfect information on its own has no effect on equilibrium outcomes, when firms have the flexibility to adjust prices and output instantaneously to changes in their market conditions, an outcome that we term the “Hayekian benchmark”. With sticky prices, however, this irrelevance obtains only if there are no strategic complementarities in pricing and aggregate and idiosyncratic shocks are equally persistent. With complementarities and/or differences in persistence, the interaction of nominal and informational frictions slows down price adjustment, amplifying real effects from nominal shocks (relative to a full information model with only nominal frictions). In a calibrated model, the amplification is most pronounced over the medium to long term. In the short run, market generated information leads to substantial aggregate price adjustment, even though firms may be completely unaware of changes in aggregate conditions
Le droit au juge légal en Allemagne : étude à la lumière du droit français et perspectives européennes
Relativement méconnu des juristes français, le droit au juge légal est d'une importance capitale en Allemagne. Cette étude a pour objectif d'évaluer, dans une perspective à la fois historique et comparée, dans quelle mesure le droit allemand au juge légal s'est constitué comme un droit-pivot dans l'ordre juridique allemand. Ce droit, garanti à l'article 101 alinéa 1er deuxième phrase de la Loi fondamentale de 1949, permet en effet à la Cour constitutionnelle fédérale allemande de protéger des éléments variés en lien avec le juge et la fonction juridictionnelle. D'abord conçu pour garantir les compétences des juges inscrites dans la loi et les normes règlementaires, ce droit permet aujourd'hui au juge constitutionnel allemand de s'assurer du respect des règles garantissant l'indépendance et l'impartialité des juges, et, dans une perspective spécifique de droit de l'Union européenne, de contrôler le respect de l'obligation de renvoi préjudiciel à la Cour de justice par les juridictions allemandes. Dans un premier temps, l'étude du développement historique du droit au juge naturel, d'abord en France, puis en Allemagne, permet de montrer que ce droit s'est initialement construit pour protéger les compétences des juges face au pouvoir exécutif. Le recours au droit comparé dans le temps et dans l'espace permet d'apporter des clefs d'explication à la conception actuelle de ce droit en Allemagne, mais aussi à la disparition de son pendant français. L'accent est mis sur l'évolution de la place du juge dans les deux ordres juridiques, et, notamment, sur la quête d'indépendance du pouvoir judiciaire vis-à-vis du pouvoir politique. Dans un deuxième temps, l'étude de la conception actuelle du droit allemand au juge légal, mis en perspective avec le droit positif français, nous invite à constater que ce droit vise aujourd'hui avant tout à garantir le respect des compétences juridictionnelles et des règles d'indépendance et d'impartialité par les juges eux-mêmes. À nouveau, le droit comparé permet de mettre en avant les spécificités de la conception allemande du droit au juge légal. Celles-ci résultent en particulier de l'existence d'une voie de recours permettant à la Cour constitutionnelle fédérale de contrôler la constitutionnalité des décisions juridictionnelles définitives. Le niveau de précision requis en matière de prédétermination du juge compétent pour trancher chaque litige, conjugué à la possibilité de contrôler l'application des règles de compétence par les juges, font du système allemand l'un des plus exigeants en matière de légalité du juge. Une conception plus moderne du droit au juge légal, compris comme droit à un juge répondant aux exigences d'indépendance et d'impartialité requises par la Constitution, permet de mettre en lien le droit allemand avec le droit français, fortement influencé par le droit européen en la matière. Enfin, l'étude spécifique de la mobilisation du droit allemand au juge légal pour contrôler le respect de l'obligation de renvoi préjudiciel à la Cour de justice de l'Union européenne permet d'illustrer le caractère particulièrement extensif de cette garantie en Allemagne. Par l'étude des ressorts et de la portée de ce contrôle, un œil neuf sur le mécanisme européen du renvoi préjudiciel peut ainsi être présenté aux juristes français.Relatively unknown to French jurists, the right to a lawful judge is extremely important in Germany. The aim of this study is to assess, from both a historical and comparative perspective, how the German right to a lawful judge has established itself as a pivotal right in the German legal system. This right, guaranteed under the second sentence of article 101 paragraph 1 of the Basic Law of 1949, enables the German Federal Constitutional Court to protect various elements relating to the judge and the judicial function. Initially designed to guarantee the competence of judges established by law and administrative regulations, this right now enables the German Constitutional Court to ensure the observance of the rules guaranteeing the independence and impartiality of judges and, from the specific perspective of European Union law, to review respect for the obligation for German courts to refer questions to the Court of Justice for preliminary rulings. First, the study of the historical development of the right to a natural judge, first in France and then in Germany, shows that this right was initially created to protect the competences of judges against the executive. The use of comparative law in time and space helps to explain the current conception of this right in Germany, but also the disappearance of its French equivalent. Emphasis is placed on the evolution of the place of the judge in the two legal systems, and in particular on the judiciary's quest for independence from political power. Secondly, by studying the current conception of the German right to a lawful judge, put into perspective with French positive law, we note that this right today aims above all to guarantee respect for jurisdictional competences and the principles of independence and impartiality by the judges themselves. Once again, comparative law enables us to highlight the specific features of the German conception of the right to a lawful judge. These result in particular from the existence of a remedy enabling the Federal Constitutional Court to review the constitutionality of final court decisions. The level of precision required in predetermining which court has jurisdiction to decide each dispute, combined with the possibility of reviewing the application of the competence rules by the judges, make the German system one of the most demanding in terms of the legality of the court. A more modern conception of the right to a lawful judge, understood as the right to a judge who meets the requirements of independence and impartiality required by the Constitution, makes it possible to link German law with French law, which is strongly influenced by European law in this area. Finally, a specific study of the application of the German right to a lawful judge in order to control the obligation to submit a reference for a preliminary ruling to the Court of Justice of the European Union illustrates the particularly extensive nature of this guarantee in Germany. By studying the scope of this review, French lawyers can gain a fresh insight into the European preliminary ruling mechanism

Solution. – L’arrêt rappelle le rôle du juge saisi d’une contestation sur les funérailles : respecter la volonté du défunt, y compris en l’absence de toute expression écrite ou testamentaire.
Impact. – Le juge ne peut confier l’organisation des funérailles à une personne s’opposant au lieu choisi par le défunt, quand bien même il s’agirait de la mère. Cette dernière ne saurait, dès lors, invoquer un manquement à son droit au respect de la vie privée
