Recognition and enforcement of foreign judgments in civil and commercial matters in the PRC, Hong Kong, Macau and Taiwan
Foreign judgment recognition and enforcement is an old topic. However, nowadays, it catches new attention on the background of globalization, a process within which countries around the world are becoming more closely connected than ever with each other. Due to its double nature (i.e. both public authority and personal interests are involved), the issue is quite complicated. In addition, when it comes to four Chinese jurisdictions (the People's Republic of China, Hong Kong, Macau and Taiwan), it becomes even more complex as though each of them is of its independent legal system, and the four jurisdictions are of the same sovereignty. The sensitive political relationship within these jurisdictions makes the issue problematic.
The dissertation starts with detailed discussion and analysis of the current foreign judgment recognition and enforcement laws in the four jurisdictions. The discussion and analysis then is followed by a brief comparison between legislation of the four jurisdictions, trying to present an overview of the issue in the Greater China.

The European Community conflict of laws rules on voluntary assignments
Stel een Franse bank krijgt een geschil met een Nederlands bedrijf over een onderlinge transactie. Welke rechtsregels zijn dan van toepassing, de Franse of de Nederlandse? De Visser onderzocht met betrekking tot een specifieke transactie - de overdracht van vorderingen - welke rechtsregels van toepassing zijn.
Dit is een probleem dat zich voordoet in het internationale kapitaalverkeer. Overdracht van vorderingen vindt onder meer plaats als een bedrijf geld wil lenen bij een bank. Het bedrijf kan in dat geval de vorderingen die het nog heeft uitstaan bij anderen - zoals bijvoorbeeld abonnementsgelden of kredieten aan afnemers - overdragen of verkopen aan de bank of in zekerheid geven als onderpand voor een geldlening.
Ieder land heeft hiervoor eigen rechtsregels. Deze werken goed voor zover de overdracht binnen een en hetzelfde land plaatsvindt. Maar in veel gevallen vinden transacties tussen bedrijven en banken tegenwoordig plaats binnen verschillende landen van de EU. Zo zou het kunnen dat een Nederlands bedrijf dat geld wil lenen bij een Franse bank de vordering die het nog heeft op een Duitse cliënt, aan deze bank overdraagt. Partijen kunnen daarbij bovendien afspreken dat het Engelse recht op de transactie van toepassing is. Is het laatste het geval, dan is het echter voor de Franse bank nog maar de vraag of deze ook daadwerkelijk de vordering op de Duitse cliënt in zijn vermogen heeft. Het is namelijk niet ongebruikelijk dat de vordering van het Nederlandse bedrijf op de Duitse cliënt bijvoorbeeld door Nederlands recht of wellicht door Duits recht wordt beheerst. De vraag is dan of niet bijvoorbeeld óók aan de regels van het Nederlandse of het Duitse recht moet worden voldaan wil de Franse bank er zeker van zijn dat het de vorderingen heeft.
Het proefschrift van De Visser gaat over de vraag aan welke rechtsregels moet zijn voldaan wil degene die de vordering overgedragen krijgt, er zeker van zijn dat hij de vordering daadwerkelijk in bezit heeft. De Europese Commissie deed in 2003 een voorstel om regels voor dit type transactie binnen de EU te harmoniseren. Zij stelde daartoe voor om de rechtsregels toe te passen van de woonplaats van de partij die de vordering overdraagt. De Visser toonde met zijn onderzoek aan dat dit in de praktijk niet goed werkt, omdat het te risicovol uitpakt voor de partij die de vordering overneemt, in bovenstaand voorbeeld de Franse bank. Zijn conclusie is dat partijen bij het aangaan van een dergelijke transactie de meeste zekerheid krijgen als voldaan is aan het recht dat van toepassing is op de overgedragen vorderingen.

In this article the author makes an analysis of the Proposal for a Council Regulation implementing enhanced cooperation on jurisdiction, applicable law and the recognition and enforcement of decisions in matters of matrimonial property regimes. Such proposal is better structured and of a higher quality than the similar proposal dating from 2011. With regard to the scope of the law applicable to matrimonial property regimes and succession matters, as well as the personal effects of marriage, uncertainties remain. The Regulation provides for a comprehensive set of jurisdiction rules. The rules with regard to the applicable law, however, give rise to numerous questions and changes should be made in the future. Overall the author evaluates the proposal as outstanding
