No full textIl contributo si occupa della legislazione imperiale dell’anno 381, così come tramandata dal Codice Teodosiano e ripresa, in parte, dal Codice giustinianeo. Premesso un inquadramento storico, vengono analizzati, in particolare, gli aspetti legati alla datazione e ai destinatari, ai quali segue una rapida ricognizione dei contenuti. Si passa, poi, al confronto fra le due compilazioni, con osservazioni sulla denominazione delle rispettive rubriche, sulla selezione dei testi compiuta dai giustinianei e sulle scelte operate da questi ultimi relativamente alla nuova collocazione dei provvedimenti

Successione intestata, costituzioni del Codex Theodosianus e loro interpretationes: alcune riflessioni
No full textIl contributo affronta l’argomento della successione intestata così come risulta dalle costituzioni imperiali contenute nel Codice Teodosiano e dalle relative interpretationes presenti nel Breviarium. Nel Teodosiano il tema è presente in più luoghi. Ad esempio, il titolo C.Th. 5.1, De legitimis hereditatibus, ne tratteggia alcuni aspetti generali, ma toccano la materia della successione intestata anche il titolo 8.18, specificamente dedicato ai bona materna e, nella prospettiva più specifica e circoscritta del rapporto fra bonorum possessio e accettazione dell’eredità, il titolo 4.1. Nel saggio si compie una ricognizione prevalentemente incentrata sulla struttura e sui contenuti del provvedimento di Valentiniano e Teodosio del 426, che nel Codice Teodosiano appare suddiviso fra più titoli. Si dedica poi un’attenzione specifica alle interpretationes, in parecchie delle
quali le singole regole di prevalenza tra successibili sono oggetto di spiegazioni assai particolareggiate.
L’indagine sul rapporto, in questa materia, tra fonti di matrice romana e legislazione visigotica mette in evidenza un cambiamento di mentalità giuridica, nel quale si colgono le radici del passaggio a un sistema successorio di stampo più moderno

Dr. Pulitano’s book, published by Routledge in 2016, offers a timely window on issues of diasporic identity by affirming the importance of narrative as a discursive mode to understand the human face of contemporary migrations. She explores the work of four well-known writers currently living in the United States: Jamaica Kincaid, Michelle Cliff, Edwidge Danticat, and Caryl Phillips. No full textIl saggio, a partire dal quadro normativo in materia di edifici sportivi e per spettacoli nell’antica Roma, analizza il caso dello Stadio Meazza di Milano, la cui demolizione è al momento sospesa in attesa della verifica dell’esistenza di un interesse culturale. Nei mesi scorsi si sono svolte trattative per il trasferimento dello stadio a soggetti privati, al fine di escludere l’applicazione automatica del vincolo culturale. Nel frattempo, continuano a contrapporsi opinioni divergenti: da un lato, chi è favorevole alla ristrutturazione dell’attuale impianto; dall’altro, chi si schiera per la demolizione e la costruzione di una nuova struttura.The essay, starting from the legal framework for sports and performance buildings in the ancient Rome, analyses the case of the Meazza Stadium in Milan, whose demolition is at the moment suspended due to the verification of the existence of a cultural interest. Negotiations have taken place in recent months regarding the transfer of the stadium to private ownership, in order to exclude the automatic enforcement of the cultural restriction. Meanwhile, opposing opinions continue to clash: some favor renovating the current stadium, while others advocate for its demolition and the construction of a new facility

In the first book-length study devoted to this subject, Elvira Pulitano offers a survey of the theoretical underpinnings of works by noted Native writers Paula Gunn Allen, Robert Warrior, Craig Womack, Greg Sarris, Louis Owens, and Gerald Vizenor. In her analysis Pulitano confronts key issues and questions: Is a distinctive way of reading and interpreting Native texts possible or needed? What is the relation between a Native American critical discourse and a more general postcolonial critical theory? Will Native critical theory be subsumed within postcolonial theory and homogenized as a colonial Other, or will it test postcolonial ideas against Native American problems and predicaments? And how can Native critical theory redefine Western styles of theory? Unlike Western interpretations of Native American literatures and cultures in which external critical methodologies are imposed on Native texts, ultimately silencing the primary voices of the texts themselves, Pulitano's work examines critical material generated from within the Native contexts and epistemologies to propose a different approach to Native literature. Pulitano argues that the distinctiveness of Native American critical theory can be found in its aggressive blending and reimagining of oral tradition and Native epistemologies on the written page—a powerful, complex mediation that can stand on its own yet effectively subsume and transform non-Native critical theoretical strategies.
