No full textCon la pronuncia 86/2016, difficilmente ci si sarebbe potuti attendere che la Corte siglasse un’altra pagina della tormentata storia giurisprudenziale che erode, da quattordici anni, la Legge 40 in materia di procreazione medicalmente assistita . Per l’esame delle due questioni proposte alla Consulta, e soprattutto con riguardo alla pronuncia additiva sollecitata dall’ordinanza di rimessione del Tribunale di Firenze sul temperamento del divieto di sperimentazione sull’embrione , non era difficile ipotizzare entrambe le pronunce di inammissibilità. Prevedibile l’inammissibilità della questione di legittimità che verteva sull’art. 6 co. 1 della Legge, per la contraddittorietà del fatto dal quale originava la censura, che ne rendeva chiaramente inattuale e ipotetica la rilevanza nel giudizio ordinario. Altrettanto non inatteso, seppure di certo più complesso, l’analogo esito dell’esame sulla questione avanzata con riferimento all’art. 13 (co. 1, 2 e 3). Nonostante ciò, soprattutto questo punto, che chiamava la Consulta ad affrontare, seppure nel perimetro tracciato dall’incidente di costituzionalità, la sorte degli embrioni sovrannumerari e della loro destinazione alla ricerca scientifica, investiva i giudici di un mandato difficile e non aggirabile

Full text linkDisability has become an increasing subject of concern under the legal and political contemporary debate. In this context, many scholars have focused the problem of the legal qualification of the disability subject as a topic connected to the European case law on the vulnerable groups. Especially in the EHCR’s decisions, mental disability has often been considered as a special case on which the Judges have grounded a “social” model of vulnerability even if, for mental illness, quite different are the perspectives emerging from the European case law. The different considerations of mental disability enable us to face the structural ambiguity of the category, because of the distinct capabilities of the subjects involved in it.
