No full textLa partecipazione finanziaria dei lavoratori all’impresa è un tema di crescente interesse per il giurista, che coinvolge non solo, come naturale, il diritto del lavoro, ma anche il diritto societario, la filosofia del diritto, il diritto costituzionale ed europeo e, per finire, il diritto comparato.
Tale forma di partecipazione è stata variamente declinata e realizzata nelle diverse realtà giuridiche, risultando comune tanto alle esperienze di civil law quanto a quelle di common law, nell’ambito delle quali è stata favorita attraverso la previsione e l’adozione di piani ad hoc per l’azionariato dei dipendenti, divenuti poi un modello per altri sistemi che hanno tentato di imitarne i contenuti e gli effetti.

Nel presente saggio, l’autore espone la genesi dell’opera e i motivi per cui la curatela è stata affidata ad interpreti italiani. Dopo aver presentato, dal punto di vista sistemologico, l’ordinamento georgiano, l’autore ripercorre brevemente la storia del diritto del lavoro, presentando il contenuto dell’opera e criticando anche l’impostazione del codice stesso; vengono, infine, proposti alcuni suggerimenti metodologici per le successive opere di aggiornamento del testo di legge
