The vanishing author in computer-generated works: a critical analysis of recent Australian case law
Abstract
The use of software is ubiquitous in the creation of many copyright works, yet the requirement in copyright law that every work have a human author who engages in independent intellectual effort means that its use may prevent copyright subsistence. Several recent Australian cases have refocused attention on authorship as an essential criterion of copyright subsistence, and these cases suggest that much computer-produced output may be authorless and thus lack copyright protection. This article, the first in a two-part series, analyses how each case deals with the question of authorship of computer-produced works and why the use of software diminishes copyright protection for a significant number of computer-generated works. The article critiques the application of conventional notions of human authorship developed in the pre-computer age to modern productions and suggests alternative approaches to authorship that satisfy both the major objectives of copyright policy and the need to adapt to the computer age. The article argues that, without a broader judicial approach to authorship of computer-generated works, Parliament must remedy the lacuna in protection for these ‘authorless’ works. Possible solutions for reform are suggested. In a forthcoming article, the author comprehensively examines those reform proposals

Host galaxy magnitude of OJ 287 from its colours at minimum light
OJ 287 is a BL Lacertae type quasar in which the active galactic nucleus (AGN) outshines the host galaxy by an order of magnitude. The only exception to this may be at minimum light when the AGN activity is so low that the host galaxy may make quite a considerable contribution to the photometric intensity of the source. Such a dip or a fade in the intensity of OJ 287 occurred in 2017 November, when its brightness was about 1.75 mag lower than the recent mean level. We compare the observations of this fade with similar fades in OJ 287 observed earlier in 1989, 1999, and 2010. It appears that there is a relatively strong reddening of the B-V colours of OJ 287 when its V-band brightness drops below magnitude 17. Similar changes are also seen in V-R, V-I, and R-I colours during these deep fades. These data support the conclusion that the total magnitude of the host galaxy is V = 18.0 ± 0.3, corresponding to MK =-26.5 ± 0.3 in the K-band. This is in agreement with the results, obtained using the integrated surface brightness method, from recent surface photometry of the host. These results should encourage us to use the colour separation method also in other host galaxies with strongly variable AGN. In the case of OJ 287, both the host galaxy and its central black hole are among the biggest known, and its position in the black hole mass-galaxy mass diagram lies close to the mean correlation. © 2022 The Author(s) Published by Oxford University Press on behalf of Royal Astronomical Society
Conditions of Birth and Early Childhood Developmental Risk for Mental Disorders
Distinct classes of children in the general population are at increased odds of later mental illness and other adverse outcomes according to patterns of early childhood developmental vulnerability. If certain risk factors known at the time of birth are reliably associated with membership in early childhood risk classes, then preventative interventions could be initiated in the earliest years of life. Associations between 14 factors known at the time of birth and membership in early childhood risk classes were examined in 66,464 children. Risk class membership was associated with maternal mental illness, parental criminal charges and being male; distinct patterns of association were shown for some conditions, for example, prenatal child protection notification was uniquely associated with misconduct risk’. These findings suggest that risk factors known at the time of birth could assist in very early detection of children who may benefit from early intervention in the first 2000 days

Optical monitoring of BL Lacertae object OJ 287: A 40 day period?
We present the results of our optical monitoring of the BL Lacertae object OJ 287 during the first half of 2005. The source did not show large-amplitude variations during this period and was in a relatively quiescent state. A possible period of 40 days was derived from its light curves in three BATC wave bands. A bluer-when-brighter chromatism was discovered, which is different from the extremely stable color during the outburst in 1994-1996. The different color behaviors imply different variation mechanisms in the two states. We then revisited the optical data on OJ 287 from the OJ-94 project and also found a probable period of 40 days in its optical variability during the late 1994 outburst. The results suggest that two components contribute to the variability of OJ 287 during its outburst state. The first component is the normal blazar variation. This component has an amplitude similar to that of the quiescent state and also may share a similar periodicity. The second component can be taken as a ''low-frequency modulation'' to the first component. It may be induced by the interaction of the assumed binary black holes in the center of this object.
