This Article analyzes many of the major labor law decisions of the Burger Court and their impact on organized labor. The author compares the Court\u27s methodology with that of the Warren Court and asserts that the Burger Court has, in many instances, simply expanded on themes developed by its predecessor. The author further discusses areas in which the Burger Court has broken new ground and concludes that the Burger Court has accelerated the pendulum against the interests of organized labor
METAPHOR ANALYSIS OF TWO INTERNATIONAL BURGER FRANCHISES
Burger King and McDonald's are the two largest burger franchises globally, characterized by the number of restaurants owned. Burger King and McDonald's competition can be seen from how the two companies penetrate the global market. From the advertising context, both companies innovatively and persuasively develop consumer awareness on the one hand, and on the other hand, there are attempts to weaken competitors. This research is directed to analyze the (multimodal) metaphor used by the two companies to promote burger products. Qualitative research on pictorial advertisements was carried out in stages through several phases, which included descriptions of social, historical, and cultural contexts, identification of visual elements, identification of verbal elements, and analysis that elaborated on the three phases. The analysis shows competition between Burger King's and McDonald's advertisements. Multimodal metaphor analysis comprehensively shows that both companies use visual and verbal elements to increase consumers' awareness of existing or future products. Both companies tend to use personification to build corporate identity and the products offered and will be promoted. This research still has many weaknesses. The author suggests that the analysis focus on linguistic elements and extra-linguistic elements, such as motion, images, and sounds
Numerical modeling of nonlinear Newwaves for impact assessment on offshore structures
Offshore structures are designed to resist the impact of the extreme wave. Shell EP Projects desires a computer model that is able to simulate the impact of the design wave on gravity based offshore platforms, such as the Sakhalin PA-B platform. Comflow is a numerical model that simulates fluid flow, by solving the Navier-Stokes equations using the improved Volume-of-Fluid method. The wave inflow is prescribed at a side boundary of the Comflow domain. Shell uses the Newwave theory to prescribe the wave group that contains the design wave. The shape of the wave train that contains the design wave is important for the impact on the structure as it influences wave run up and reflection; possibly causing the wave to slam against the bottom of an offshore platform deck. Shallow water and wave steepness influence the shape of the wave group; this can be simulated with nonlinear wave models. This thesis concerns the simulation of nonlinear Newwaves and the implementation in Comflow. The goals of the thesis hence are to: 1. Find a wave model to simulate fully nonlinear Newwaves. 2. Couple the nonlinear wave model to Comflow. 3. Validate the wave impact on structures in Comflow with scale model tests. Vijfvinkel [25] developed a quasi-spectral method to solve the wave potential equation; the one dimensional spatial domain is periodic and it requires solely an initial condition. The method is based on expansion of the Dirichlet-Neumann operator, which is substituted in the governing equations. The operator consists of the surface elevation and the velocity potential at the surface. These are the properties that are calculated in a time domain. A velocity profile can be reconstructed. The Vijfvinkel computer code was obtained and revitalised. The Beji Battjes test [3] was simulated in Comflow. It confirmed the grid and time step requirements [19], and it showed that the nonlinear formation and release of higher harmonics are also simulated correctly following the requirements. Three additional numerical tests were set up to indicate the validity of Newwave simulation. Each test highlights a separate aspects of nonlinear modeling of Newwaves. \u95 The second experiment consists of a tank in which a standing wave is sloshing. The simulation in Comflow is done for various relative water depths. It showed that, except for shallow water, wave propagation is simulated reasonably well, however, damping can play a significant role due to the upwind discretisation method and velocity extrapolation method at the surface. \u95 In the third experiment the wave steepness is increased up to near breaking conditions, in Comflow and in Vijfvinkel. It proved that Vijfvinkel has superiour performance in simulation of steep waves. \u95 In the fourth experiment Newwaves are simulated in Vijfvinkel. A method is used that transforms the linear initial condition to a quasi-nonlinear initial condition. Simulations with a starting time of more than 50 seconds prior to the linear focus time, have higher peaks before the wave group reaches the linear focus location. The wave group becomes a bound wave group; the shape of the wave group shows less variation, and it propagates with a common velocity. Vijfvinkel is coupled to Comflow. The output of Vijfvinkel is transformed to comply with the Comflow domain, and the input procedure of Comflow is extended to be able to read external input files. This new input procedure allows the simulation of an arbitrary disturbance of the free surface. A simulation is performed in which Vijfvinkel prescribes the nonlinear Newwave to the inflow boundary in Comflow. A necessity is the development on the numerical core of Comflow. This was identified and anticipated on in the Joint Industry Project, as a large number of grid cells is required to model propagating waves and damping plays a significant role. For the simulation of impact on offshore structures the implementation of local grid refinement will increase the accuracy and efficiency of the simulation of wave impact on structures. Only when these developments are achieved, validation with scale model tests is sensible, for Comflow to become a valuable design tool to assess wave impact on offshore structures.Hydraulic EngineeringCivil Engineering and Geoscience

Based on the results of the pre-survey conducted by the author, according to the respondents, there were problems in the implementation of the cooperative agreement between the holders of the d´besto chicken and burger permit holder and the investor. The problem began when the 'chicken & burger party at the center, was late in sending raw materials so that it was able to hamper business processes and bring harm to the' Chicken & Burger cab party. Srikandi Pekanbaru City According to a statement submitted by one of the investors that the losses they found reached Rp. 1,000,000 (one million rupiahs) per day and delays occur for 3 working days, meaning the D’Besto chicken & Burger cab. Srikandi suffered a loss of Rp. 3,000,000 (three million rupiah). This research by the author establishes the main problem, namely how the Implementation of Cooperation Agreement with the Entrepreneurship Pattern between the D'Besto Chicken & Burger License Holder and Investors in Pekanbaru City and what are the inhibiting factors in the implementation of the Cooperation Agreement between the Entrepreneurship Pattern D'besto Chicken & Burger with Investors in Pekanbaru City. This writing when viewed from the type of writing research, it is classified as a sociological legal research that is research based only on Primary Data that is the main data that the author can get from the field by conducting direct interviews with several respondents who have been appointed by the author From the results of research by the author that: Franchise is an agreement / agreement between two parties where all the provisions refer to the Civil Code, namely Article 1313 of the Civil Code about the agreement, Article 1320 of the Civil Code about the validity of the agreement and the provisions of Article 1338 paragraph (1) of the Civil Code about the principle of freedom of contract. A franchise agreement is an agreement that does not conflict with law, religion, public order and decency. In practice in the field there are irregularities / violations committed by the franchisee. These deviations lead to defaults that result in losses to the franchisor. Constraints encountered by the parties regarding Taxes on Royalties (VAT) so far have been franchised, while royalties received by franchisees are the net value of gross sales. Maken individuen als consument en burger een andere afweging tussen verkeersveiligheid en reistijd?
Bij beleidskeuzes over transportbeleid moet regelmatig een afweging worden gemaakt tussen reistijd en veiligheid. Een goed voorbeeld is het verhogen van de maximumsnelheid naar 130 kilometer per uur. Transporteconomen stellen het welvaartseffect van dergelijke maatregelen vast in een maatschappelijke kosten-batenanalyse (MKBA) door de verwachte reistijdverandering te vermenigvuldigen met de waarde van een uur reistijdwinst (Value of Time) en door de verwachte verandering in het aantal verkeersdoden te vermenigvuldigen met de waarde van een statistisch mensenleven (Value of a Statistical Life). De dominante methode om de ‘Value of Time’ en de ‘Value of a Statistical Life’ vast te stellen zijn keuze-experimenten waarin aan respondenten wordt gevraagd om routekeuzes te maken. De routes waaruit respondenten kunnen kiezen verschillen bijvoorbeeld in reistijd, reiskosten en verkeersveiligheid. Aan de hand van de routekeuzes wordt vastgesteld hoeveel euro Nederlanders overhebben voor reistijdwinst en verbetering van verkeersveiligheid. Verschillende wetenschappers bekritiseren deze methode, omdat de afwegingen tussen reistijd en veiligheid van individuen als automobilist (consument van mobiliteit) volgens hen niet overeenkomen met de manier waarop dezelfde individuen als burger vinden dat de overheid afwegingen moet maken tussen reistijd en veiligheid. In dit onderzoek tonen wij middels keuze-experimenten aan dat individuen inderdaad verschillende preferenties hebben als consument en burger, wanneer zij een afweging maken tussen reistijd en veiligheid. Als burger kennen zij meer waarde toe aan verkeersveiligheid dan aan reistijd vergeleken met de keuzes die zij maken als consument. We hebben ook onderzocht hoe dit verschil kan worden verklaard door individuen zowel consumenten- als burgerkeuzes voor te leggen en hen te vragen waarom ze verschillende keuzes maakten. De volgende drie verklaringen werden het vaakst genoemd: 1) De overheid heeft een grotere verantwoordelijkheid voor de veiligheid van burgers dan voor de reistijd van burgers en automobilisten hebben een relatief grote verantwoordelijkheid voor hun reistijd; 2) De overheid kan verkeersveiligheid gemakkelijker meewegen dan het individu. De overheid heeft meer kennis over verschil in veiligheid tussen routes, terwijl het individu in de werkelijkheid niet of nauwelijks kennis heeft over verschil in veiligheid tussen routes; 3) Consumenten hebben het gevoel dat hun routekeuze hun reistijd beïnvloedt, maar zij hebben niet het gevoel dat hun routekeuze hun veiligheid beïnvloedt, ondanks het feit dat de veiligheid van de routes verschilt. Consumenten geven bijvoorbeeld aan dat beide routes voor hen even veilig zijn vanwege hun goede rijstijl. Daarom kennen zij als consument minder waarde toe aan veiligheid dan als burger

Excerpt: Several specimens of Scaphytopius magdalensis (Provancher) were collected by Burger (1966), and brought to the attention of the senior author for verification. This leafhopper, a vector of Blueberry Stunt, is widely distributed in the eastern United States, and southern Ontario and Quebec. This, the first record of a leafhopper virus vector for blueberries in Michigan, increases the list of leafhopper vectors of plant diseases in the state , given in Taboada and Hoffman (1965). to 14
Continuous bounded cohomology and applications to rigidity theory
The central theme of this paper is a product formula for (continuous) bounded cohomology, and more specifically its applications to rigidity theory for lattices — both in Lie/algebraic groups and more general topological groups. A more condensed exposition of some of the material published in the Lecture Note of the second author is followed by finiteness results for lattices. An appendix by Burger–Iozzi pins down a powerful use of boundary maps in this context.EG
