LIMITATION OF LIABILITY FOR MARITIME CLAIMS OF THE SHIPOWNER: NEED FOR LEGISLATIVE CLARIFICATION The author focuses on the legal regime applicable to the limitation of liability for maritime claims of the shipowner of ships of 300 gross tonnage or more. The author points out that Italy has not deposited the instrument of ratification of the “Convention on Limita-tion of Liability for Maritime Claims “ concluded in London on 19 novembre 1976 as amended by Protocol of 2 maggio 1996. The author also points out that Di-rective 2009/20/EC of the European Parliament and of the Council of 23 aprile 2009 “on the insurance of shipowners for maritime claims”, is applicable “to ships of 300 gross tonnage or more”. Finally the author notes that Italy, in complying with Directive 2009/20/EC with Legislative Decree No. 111 of 20 giugno 2012, has amended article 275 of the Navigation Code which now governs the limitation of liability for maritime claims of the shipowners of ships of ”less than 300 gross tonnage.” A brief review is also made of the insurance regime and the debt limitation of the shipowner of pleasure craf

Considerazioni sui mezzi aerei a pilotaggio remoto e sul regolamento Enac
Il contributo si sofferma sulla nozione di aeromobile e di apparecchio a pilotaggio remoto alla luce della normativa italiana, con cenni a quella europea e uniforme, rilevando come si renda necessario, anche in tale ambito, raggiungere più consolidati livelli di armonizzazione. Esamina poi il Regolamento Enac del dicembre 2013, entrato in vigore nell’aprile 2014 ed emanato in attuazione dell’art. 743 c. nav. con lo scopo di definire quali mezzi aerei a pilotaggio remoto sono considerati aeromobili. Poiché il regolamento pone due distinzioni (da un lato «i sistemi aeromobili a pilotaggio remoto» (identificati con l’acronimo SAPR), dall’altro gli «aeromodelli», sono analizzate le conseguenze in punto di applicazione delle relative disposizioni.Considerations on remotely piloted aeria vehicles and on ENAC regulation. The article focuses on the notion of remotely piloted aircraft and vehicles in light of Italian legislation, with reference to European legislation and uniform law, noting the necessity to reach a more consolidated level of harmonization. The author then reviews the ENAC Regulation of December 2013, entered into force on April 2014, implementing Article 743 of the Navigation Code for the purpose of defining which remotely piloted aerial vehicles are considered aircraft. Since the Regulation makes two distinctions (Remotely Piloted Aircraft Systems (RPAS) and Model Aircraft, the author considers the consequences of the implementation of the relative provisions.
