An all too human criminology should not forget the bad guys
The Author aims at enlarging the concept of “human criminology”, including in it not only new victims belonging to overlooked fields, but also the peculiar victim represented by the offender. In order to achieve such results, he considers trauma as the common ground which associates offender and victim, and the terrible face of emotion of awe (tremendous, terrific) to the condition of both; conversely, the other face of awe (sublime) is experimented by people who assist to crime without partecipating in it. From such point of view, an oxymoric perspective ought to be assumed by a criminology which intends to go beyond the punitive desire and to contrast it, in order to understand what is happening in the offender, recuperating him to a human dimension
Mariangela Ripoli sulla penalità, il carcere e il trattamento penitenziario. Come costruire spazi per la promozione della desistenza?
In this article, the Author reflects on Mariangela Ripoli’s contribution to the rediscovery of the vindicatory nature of punishment, and of imprisonment. Starting from this realist position, Ripoli is able to point out the antinomy between punishment and human rights, and to theorize, in a truly original way, an only potential, and sometimes conflictual space for criminological treatment: the challenge, which this contribution develops, lies in the hazard of constructing “enclaves” for treatment, i.e. protected settings, a sort of breathable air bubbles that deny in reality the factu-ality of imprisonment. In this perspective, the possibility of teaching criminal justice and penitentiary law with a focus on promoting human rights and building breathable spaces in prisons is discussed
Regularity results for non smooth parabolic problems
The authors consider the solutions of non linear second order parabolic equations/systems that are the natural generalization for evolutionary p-Laplacean. More precisely the Authors, first, prove the local Lipshitz regularity of solutions to a class of parabolic equations characterized by weak growth, differentiability and ellipticity assumptions. Then, they face the vectorial case, first assuming particular structure for the operator and , in this special case, they extend the result proved for the scalar case. For the general vectorial case, the Authors prove a higher integrability results by approximating the solutions of the nonlinear parabolic system with the solutions of more regular parabolic systems
Lower Semicontinuity in SBV for Functionals with Nearly Linear Growth
We present a lower semicontinuity result for free discontinuity energies with a quasiconvex volume term having non standard growth and a quite general surface term
Le ranz des vaches. Nostalgia and migration: A clinical criminological analysis
The present paper tries to show the utility of the analysis of the nostalgic feelings in nowadays’ clinical criminology of migrations: after having succinctly recalled the birth of the concept of nostalgia in the 17th century, the authors recapitulate its evolution and choose the field of the psychoanalytic conceptualizations of the relationship between nostalgia and migrations as an useful tool to analyse some literary and clinical cases. The analysis of the cases allows the authors to suggest the possibility of the existence of an evolutive continuum: from the absence of nostalgia in the melancholic implosion – in which no separation is possible-, passing through the denial of the separation in the delusional reactions and the irreversible acting out denying the separation in the pursuit of a reward through the criminal act, to the altruistic attempts at the concrete modification of reality, and finally to an example of therapeutic working-through of the traumatic situation in a group of delinquent juveniles
