Alarmed, but not alert in the 'war on terror'? The High Court, Thomas V Mowbray and the Defence Power
The article examines the judgment in Thomas v. Mowbray by the High Court in Australia handed down during the so called 'War on Terror'. According to the author, (i) the High Court de-emphasized the importance of the difference between war and peace in fixing the scope of the defence power in the Australian Constitution in a manner which was inconsistent with its earlier celebrated decision in the Communist Party Case in 1950 during the Cold War; and (ii) failed to apply a sufficiently rigorous test of proportionality in characterising the impugned Commonwealth laws. The article discuss the legal background and social implications of the High Court's decision, using the Communist Party Case in 1950 as a point of comparison

Martin Mowbray had the idea and John Wiseman and the author joined in initiating a new kind of social policy journal in the first months of 1994. The journal was launched in order to bring academics, researchers and practitioners together to say what was wrong with the dominant paradigm of 'free marketeers' and 'economic modernisers' promoting 'competition' and 'globalisation'
Moral Status for Malware!:The Difficulty of Defining Advanced Artificial Intelligence
The suggestion has been made that future advanced artificial intelligence (AI) that passes some consciousness-related criteria should be treated as having moral status, and therefore, humans would have an ethical obligation to consider its well-being. In this paper, the author discusses the extent to which software and robots already pass proposed criteria for consciousness; and argues against the moral status for AI on the grounds that human malware authors may design malware to fake consciousness. In fact, the article warns that malware authors have stronger incentives than do authors of legitimate software to create code that passes some of the criteria. Thus, code that appears to be benign, but is in fact malware, might become the most common form of software to be treated as having moral status
Elastic analysis of soil media.
Elastic Solutions can be used to predict stresses and displacements in loaded soil media provided the non-linear stress-strain behaviour of the soil is recognised and allowance made for it in calculating displacements.
This thesis examines the methods of elastic analysis suitable for examining problems in Soil Mechanics and the determination of suitable stress-strain parameters.
The use of the Finite Element method in Soil Mechanics is reviewed, and a computer program for examining linear elastic plane stress and plane strain problems is presented. The program has been used to examine a range of problems involving infinitely long excavations of rectangular cross-section in the surface of a stratum overlying a rigid base. The excavations were analysed for a uniform vertical loading in the base of the excavation and for lateral wall loads representing the effect of the release of the insitu stresses during excavation. Cases in which the lateral movement of the walls is completely restrained are also considered, and the effect of wall restraint on the vertical displacements due to the vertical base loading is shown to be small. Results obtained by the author suggest that care should be exercised in the use of the Finite Element method to analyse problems involving loaded rigid footings or the stresses behind rigid retaining walls, and that the solutions in these cases may be inaccurate.
The solutions available for surface loadings on layered elastic strata are reviewed and results obtained from a Fourier Series approach are presented for a range of problems involving surface loadings on a single rigid base elastic stratum. Uniform vertical and horizontal strip loadings and rigid strip footings with vertical, horizontal and moment loadings are considered. A uniform vertical strip load on the surface of a multilayer stratum overlying a half space or rigid base is also analysed. The computer programs and full mathematical derivations for the strip loading cases are presented, and the extension of the solutions to rectangular loadings is discussed and the basic mathematical derivations outlined. The application of the Fourier Series solutions to the calculation of consolidation settlements is discussed.
Work by other investigators suggests that a hyperbolic model may be suitable for approximating soil stress-strain curves and that fundamental stress-strain behaviour should be examined in tests in which the bulk stress remains constant during the application of the shear stress. Equipment designed to carry out slow drained triaxial tests in which the bulk stress is constant during the shearing phase is described, and the results of a short series of tests used to proof test the equipment are presented
An edition of the Coucher Book and charters of Bolton Priory (Yorkshire)
This thesis contains an edition of the Coucher Book of Bolton Priory, an Augustinian house in Yorkshire, together with edited sections of Dodsworth MS 144, like the Coucher Book, a copy of the lost cartulary, and a number of original charters. These documents have been edited in full, with each being preceded by a caption in English together with a date and references to other copies. The edition of the Coucher Book contains notes as to where those sections believed to have been omitted from the cartulary are located in Dodsworth NIS 144. The chapters which precede the edition are intended to give some context to the edition, as well as a brief examination of its contents. The first chapter contains a short history of the Augustinian Order, its development in England, and how Bolton Priory fits into this scheme. Chapter two is concerned with the patrons and benefactors of the priory. It is divided into two sections: the first examines the founders and patrons of the priory and their descendants, whilst the second explores the non-patronal benefactors of the house, with a brief analysis of several of the families who were connected from an early date with the priory, as well as the extent of their support and their motives. The third chapter investigates the estates of the priory and their development. Temporal property is examined first, focussing upon the various types of property acquired, together with its location, and methods of acquisition, and then spiritualities: those churches in which the canons acquired an interest, and to what extent as well as how this was acquired. Finally chapter four examines the lost cartulary and the Coucher Book, exploring their administrative histories, as well as a brief analysis of the charters of the founders and others
