    Het voorbije decennium is een tendens zichtbaar waarbij vennootschappen buiten het Verenigd Koninkrijk gebruik (willen) maken van de Engelse Schemes of Arrangement om een insolventie af te wenden door hun schulden te herstructureren. Dit werk beschrijft hoe deze schemes functioneren in het Europees internationaal privaatrecht. Hierbij gaat de focus uit naar de zogenaamde creditor schemes en er wordt bijgevolg geen aandacht besteedt aan de overige vormen. Zowel de bevoegdheid van de Engelse rechtbanken om een scheme t.a.v. een buitenlandse vennootschap te sanctioneren als de latere erkenning en tenuitvoerlegging ervan in andere Lidstaten worden besproken en dit in het licht van de Insolventieverordening, de Brussel I(bis)-Verordening en de Rome I-Verordening. Het onderzoek is gebaseerd op rechtsleer en rechtspraak, dit laatste hoofdzakelijk van het Europees Hof van Justitie, de Engelse rechtbanken en enkele Duitse vonnissen en arresten. De hoofdconclusie die kan worden getrokken uit het onderzoek is dat er rechtsonzekerheid bestaat m.b.t. deze materie, maar dit neemt niet weg dat er argumenten kunnen gegeven worden inzake de manier waarop men met de problematische aspecten kan omgaan. Hiermee tracht dit werk een effectieve bijdrage te doen in het academisch debat aangaande dit onderwerp en zo enkele knelpunten te verhelpen.     The current paradigm for democracy and environmental justice rests heavily on the principles of transparency and public participation. Access to information is a precondition for the effective exercise of public participation mechanisms, and when it comes to environmental matters, one can hardly be conceived without the other. Regarding environmental data held by the private sector, companies are increasingly faced with demands for access to information which until quite recently was considered to fall under business (confidential) secrets and out of bounds for public access. Legal instruments such as the Aarhus Convention and overall transparency Directives and Regulations for access to documents of the EU institutions are increasingly being used to bring privately held data under public scrutiny. However, a consistent approach to the regulation of privately held environmental data needs further development. The research employs analysis under international, European and comparative law (Colombia, the United States and South America) to examine the tensions raised by the different interests at stake and analyse the need for new legislation providing wider access to the public, as well as pinpointing the best way to approach the issue to guard the principles of transparency and public participation without overlooking the protected interests of private actors to business confidentiality and intellectual property.status: Publishe

    The coherent regulation of Energy and Environment in the European Union – using shale gas as a case-study To adapt to newly emerging environmental and energy challenges, European energy and environmental law has undergone many revisions and changes throughout the past 30 years. The successful regulation of all environmental aspects of human activities, and the interaction between environmental and energy priorities, has proven to be challenging. The inclusion of the new title XXI on energy in the Lisbon Treaty changed the Union’s competences and the legal basis to act in this regard. It still has to be seen if this new constitutional setup is better suited to combine energy supply security on the one hand and environmental protection concerns on the other. One emerging subject in both such areas of law, which is testimony to this challenge, is the extraction of unconventional gas resources, such as shale gas, which is a possible response to both increasing energy demand in the European Union and dependence on gas imports from third countries such as Russia. The large scale and manipulative nature of hydraulic fracturing techniques elicits a mixed response due to a large realm of unknowns, not only about externalities but also concerning the ability of the technology to deliver. Characterised by uncertainties and promises to address climate change, shale gas extraction raises several technical, ethical and legal issues. The research project will (a) test the new constitutional setup on the basis of this challenging case study, (b) assess the Union’s quest for a common energy policy in the absence of a Treaty provision and (c) further analyse other cross cutting issues subject to the environmental and energy supply security challenge, as well as (d) analyse the status of the precautionary principle in European (Environmental) law and (e) assess the existing legal framework on a Union level, taking into account the regulatory experience gained in the United States.status: Publishe
