    This paper examines the foundation of the Italian Constitutional Court’s authority by comparing it with that of the German Federal Constitutional Court. Unlike the Bundesverfassungsgericht, the Corte costituzionale had to build its authority on a particularly weak legal basis. However, it succeeded in developing a dynamic of «power in weakness», which explains several of its most characterizing features: its exceptionally cooperative relationship with the ordinary courts, its terse style of reasoning, its low profile in the society, its activist interaction with the legislature, and its tactical dialogue with the Court of Justice of the EU. The idea of «power in weakness» also provides a key to understanding some recent developments in the Court’s jurisprudence and attitude

    The Max Planck Handbooks in European Public Law describe and analyze public law of the European legal space, an area that encompasses not only the law of the European Union but also the European Convention on Human Rights and, importantly, the domestic public laws of European states. Recognizing that the ongoing vertical and horizontal processes of European integration make legal comparison the task of our time for both scholars and practitioners, the series aims to foster the development of a specifically European legal pluralism and to contribute to the legitimacy and efficiency of European public law. The first volume of the series began this enterprise with an appraisal of the evolution of the state and its administration, offering both cross-cutting contributions and specific country reports. This second volume continues this approach with an in-depth appraisal of the foundations of the constitutional order in various and diverse European countries. Fourteen country reports investigate the antecedents, foundations, organization, basic principles, and challenges to European constitutions. They include countries with long-lasting and recently amended constitutions, decentralized or unitary, with different political systems and institutional settings. In keeping with the focus on a diverse but unified legal space, each report also details how the constitutional identity of each country has been elaborated and what it entails. Together, the chapters of this volume provide a strong and diverse foundation for a continuing European constitutional dialogue

    Este artículo examina los fundamentos de la autoridad de la Corte Constitucional italiana comparándola con la del Tribunal Constitucional Federal alemán. En comparación con el Tribunal alemán, la Corte italiana ha construido su autoridad sobre una base particularmente débil. Sin embargo, ha tenido éxito en desarrollar una dinámica de “poder en la debilidad”, que explica importantes características de la Corte Constitucional italiana: su relación excepcionalmente cooperativa con los tribunales ordinarios, su estilo conciso de razonamiento, su deliberado bajo perfil frente a la opinión pública, su interacción activista con el legislador y su diálogo táctico con el Tribunal de Justicia de la Unión Europea

    Несмотря на то, что вопрос об определении понятия запрещенного "применения силы" в соответствии со статьей 2(4) Устава ООН и обычным международным занимает центральное место в международном правопорядке, в его отношении среди государств, ученых и юристов сохраняется в полном смысле слова неопределенность. Этой неопределенностью нередко пользуются государства, которые стремятся занизить существующие требования к соблюдению данной нормы. В связи с этим в Эрин Побье „Понятие запрещенного "применения силы" в международном праве“ представлена и применена оригинальная исходная концепция - так называемая «теория типов», используемая для определения запрещенного "применения силы" между государствами с акцентом на понятии "применения силы". В статье утверждается, что запрещенное "применение силы" между государствами характеризуется целым рядом элементов, причем не все из них должны обязательно присутствовать, чтобы конкретное деяние подпадало под это понятие. Напротив, эти элементы, включая определенные типы последствий, тяжесть и намерение, определяются, взвешиваются и оцениваются для того, чтобы установить, соблюден ли, как минимум, нижний порог определения "применения силы". Применяя теорию типов к конкретным примерам из практики, автором публикации делаются принципиальные выводы относительно определения "применения силы" и демонстрируется полезность данной теории как инструмента для ученых-юристов и практиков

    The Constitutional Relationship between the European Union and the European Community: Consequences for the Relationship with the Member States

    This contribution addresses the question of the complex legal relationship between the European Union the European Community and their member states. It is argued that the legal order of the Communities forms a part of the Union¿s legal order. In that sense there is a single legal order of the Union, which may even be perceived in terms of a constitution. This constitution may be seen as overarching everything that goes on within the Union, on the basis of both the Union and the Community treaties. Through the unity of the Union¿s legal order, the member states do not stand in another relation to the Union than to the Communities. With the Treaty on European Union they established a new international legal person, the organs of which on the basis of decision-making procedures are made competent to adopt decisions and to act on behalf of the member states. As the Union constitution is based on an interdependence of all norms in the European Union (including those based on the Community treaties), it becomes increasingly difficult to make a strict separation between the three parts of the Union. Although this paper was originally written in reaction to a paper by Prof. Werner Schroeder, entitled The Constitutional Relationship between the European Union and the European Communities, it can perfectly be read on a stand alone basis as the arguments used by Schroeder are repeated
