Per sempre giovane. La laicità nel dibattito culturale francese: scrittori e politica ecclesiastica da Victor Hugo a Annie Ernaux
Con uno sguardo che spazia da Victor Hugo a Annie Ernaux, Per Sempre Giovane indaga la complessa interazione tra la sfera letteraria e quella giuridica con riferimento all’idea di laicità in Francia. L’affare Dreyfus, l’intervento degli écrivains durante le due guerre mondiali e le successive evoluzioni nel panorama politico e sociale francese offrono infatti un contesto ricco e variegato per esplorare le interazioni della letteratura con le questioni della libertà religiosa, della separazione tra Stato e Chiesa e della tutela dei diritti fondamentali in condizioni di uguaglianza.
In particolare, dedicando una sezione specifica agli anni successivi al 1964 Vincenzo Pacillo evidenzia come la nascita della figura dell’intellettuale specifico imponga di aggiungere all’analisi della letteratura quella del pensiero filosofico e sociologico, nell’ottica di presentare una visione olistica che trascenda non solo l’analisi meramente giuridica, ma anche l’approccio tradizionale di “diritto e letteratura”. Attraverso tale lente, il libro invita a considerare la laïcité non solo nei termini di un principio giuridico ma quale fenomeno complesso, il cui significato e la cui applicazione sono profondamente intrecciati con la storia culturale della Francia. Con la conseguenza che la sua piena comprensione richiede un’analisi proiettata al di là delle norme giuridiche secondo un approccio umanistico al diritto ecclesiastico capace di offrire una prospettiva rinnovata e arricchente, rivelando quanto la letteratura e il pensiero abbiano contribuito non solo a definire, ma anche a difendere e a promuovere il relativo concetto nel contesto francese e oltre

In Switzerland, the public funding of religious groups is actually under discussion. It supports only the groups which have the legal status of public law corporations, while, in a secular state, it seems that any privilege for some Churches should be abolished, or at least reduced so as not to hinder the equality in the freedom of all religions. Hans Urs von Balthasar e Eugenio Corecco: sul rapporto tra teologia e diritti religiosi
The figure of Eugenio Corecco is nodal for the current processes of scientific approach to religious laws: his peculiar vision of the relationship between theology and canon law is still fundamental for a deep understanding of the peculiarities that distinguish the legal systems based on religious beliefs.
In particular, through the figure of Eugenio Corecco, the contribution aims at reflecting on the relationship between theology and canon law. While some scholars emphasized that the scientific autonomy of canon law could to be admitted only by postulating his familiarity with the juridical experience of secular systems, Corecco stated that it is impossible to apply to canon law the proper methodology of secular juridical sciences; He was also convinced that canon law, as derived from the supernatural nature of the Church, should be considered a legal system derived from faith and not exclusively from reason. Corecco's theology of Canon law has been investigated starting from the theological arguments of Hans Urs Von Balthasar and his ideas on the juridical dimension of theology

Sustainable secularism as a tool for managing religious diversity: a framework for European Democracies (and for the industrial relations) in the perspective of European jurisprudence and Robert Audi’s theory
This study explores the conceptual evolution of secularism into a sustainable legal and
political paradigm within European constitutionalism, guided by the influence of Robert
Audi’s theory and the jurisprudence of the European Court of Human Rights (ECtHR). The
transformation from confessional states to secular nations in Europe, marked notably by
the institutional recognition of religious freedom as detailed in Article 9 of the European
Convention on Human Rights, signifies a shift towards a “sustainable secularism.” This
new model advocates for a dynamic balance between religious freedom, state neutrality,
and social cohesion, adapting to societal changes while promoting equal respect and opportunities for all citizens, irrespective of their religious affiliations.
The study discusses the implications of sustainable secularism for the legal frameworks of European states and in the industrial relations, emphasizing the need for laws and
norms to maintain neutrality and avoid favoritism towards any religion or worldview,
adopting instead a governance model that integrates and respects diverse religious perspectives within public life.
Sustainable secularism, therefore, is positioned as a crucial, adaptable framework that
ensures the ongoing relevance and effectiveness of secularism in contemporary society.
It aims to uphold foundational values of freedom of conscience and equality, fostering a
stable, pluralistic, and inclusive environment where diverse beliefs can coexist without
competition. This framework not only prevents sectarianism but also promotes a public policy that respects individual rights and maintains formal equality, adapting to the unique requirements of different societal situations based on the principles of fundamental
rights and human dignity
