    Conflict of law and the methodology of Tarjīẖ : a study in Islamic legal theory

    Islamic law never achieved unity but expressed itself in, at least, four surviving schools. More interestingly, contemporary Muslim communities are still divided among themselves on a number of issues related to their laws. This work describes how problem of legal conflicts have been tackled by Muslim jurists. It is an attempt to examine closely the phenomenon of conflict in Islamic law from the standpoint of usūl-al-fiqh or Islamic legal theory. In fact, much is heard nowadays of the contradiction in the body of Islamic law. Whilst in contrast, little is presented in terms of the methodology of removing this conflict. The present work therefore, attempts to redress this balance. The emphasis of the work will be concerned primarily with tarjīh methodology ; how to give preference to one piece of evidence or argument over the other when they conflict. Nevertheless, considerable concern is given to investigating the background to the conflict of law in the Shari'ah. This study of a neglected area in Islamic legal scholarship will be an important source of reference to students, both practising and theoretical jurists or to anyone who merely wishes to increase his knowledge of legal themes, particularly legal conflict. The very aim of the work is to argue that conflict is a natural and unavoidable consequence of legal study because legal conflict is only conflicting principles and arguments adduced by both the classical and modern jurists to reach what is actually intended by God in the target case. Therefore, conflicts are inevitable in most of the cases in fiqh owing to the variety of principles set out to deal with one piece of legal evidence, let alone with all the pieces of legal evidence in question. Tarjīh is therefore, an important and workable instrument in the re-examination of these conflicts and in arriving at the most accurate principle for establishing the law for as long as this is possible. It is hoped that the discovery of new facts and the increase of knowledge which results from the broadening and deepening of the research will positively contribute to the process of unification of Islamic law

She established a non-profit organization that educates children, including young women and girls affected by the Boko Haram insurgency so that they can become self-reliant and acquire new vocational skills. Written in 2019, this Kanuri Ajami text contains two parts: The first part deals with the life and works of Hajiya Kaltume Bulama Gana, and the second is an interview transcript with her. In the interview, she discusses her non-profit organization, her Herwa Heart of Art Initiative. This part provides details on how she established the organization and her successes and challenges. In the last part of the interview, she discusses how philanthropists and the general public can support her organization in order to use the arts to assist the orphans and children displaced and traumatized by Boko Haram in Borno state and beyond.The contents of this collection were developed with support of the Title VI National Resource Center grant # P015A180164 from the U.S. Department of Education.     This short presentation deals with an Arabic poem in praise of the Tijaniyya brotherhood that is titled Shamsiyyat al-ikhwān („Umbrella of the brothers”). The Tijanis claim that the poem was written by Sultan Muhammad Bello. It has been also stated that Bello joined the Tijaniyya order through the mediation of Al-Hajj Umar who spent some years in Sokoto when Muhammad Bello held the office of Sultan. However, the question of his potential initiation into Tijaniyya has been a subject of controversy and a major point of contention between the Tijaniyya and the Qadiriyya in northern Nigeria. The poem Shamsiyyat al-ikhwān contains 153 verses and has been divided into 19 chapters. Most of them deal with the conditions of the Tijaniyya membership, they present the required prayers and describe the values of Tijaniyya. There are three general conditions (shurūṭ): one should not visit any saint (walī) of another brotherhood, whether dead or alive; one has to accept the Tijaniyya order until his death; one should not follow other Sufi way (ṭarīqa). The required prayers are: the individual daily prayers (wird); the group prayer (waẓīfa), and the weekly special Friday prayer (dhikr or ḥaḑra). Of greatest importance is the Tijani claim that they would enter Paradise without retribution or punishment for whatever crimes they had committed

    A model for enhancing customer satisfaction for quality services and awareness through community participation

    Customer satisfaction as a means of measuring government performance has been on top of global debates of developmental programs at local government. The background of this study highlighted the position of customer satisfaction in many municipal coun-cils in the world and with special focus on Batu Pahat Municipal Council (BPMC). The research problem statement was that it has been observed that municipal aware-ness and community participation have not been harnessed for customer satisfaction for municipal councils’ service delivery. The aim and objectives of the study were to investigate the effects of Community Participation (CP) on customer satisfaction. Four research questions and five hypotheses were formulated to guide the study. The study population was 401,902 defined as a group of service users who are directly involved in receiving the services provided by the BPMC. The sample for the study was 400 survey respondents from the citizens living within BPMC. A structured questionnaire was presented to the respondents, selected through simple random sampling. Explor-atory Factor Analysis (EFA), Confirmatory Factor Analysis (CFA) were used to test the validity and reliability of the conceptual research model. The survey results sup-ported three hypotheses (H1, H2, H3) confirming that community participation has a mediating effect on customer satisfaction in BPMC. Hypothesis five (H5) was sup-ported in the main research, which indicates that CP has a mediating effects on cus-tomer satisfaction and also confirmed the pilot study that municipal awareness has an effect on customer satisfaction. The unique finding of the study is that, it has espoused the importance of CP as a mediator towards achieving customer satisfaction. This re-search has only been applied to BPMC, and further testing across different MC’s in Malaysia is needed to generalise the findings. The researcher concludes that commu-nity participation can enhance customer satisfaction through comprehensive model at the grass root level

    Islam views life as complete package, economic aspect being an important part of it. The most sensible area of economic system in Islam is rule of earning and expenditure. It was reported by Abu-Hurairah (R.A) that the prophet (SAW) said: “A time will come when people would not bother for their earning; it is Halal or Haram” (Bukhari: vol. 2, No .2056). The book titled Tanbih as-Sahib ala Ahkam al-Makasib (Alerting the Brother for the rules of Earning) by late Sultan Muhammad Bello through much light on the Islamic rules of earning and expenditure. The present paper analyzed the relevance of this important book to the areas of earning, expenditure and economic development, from the Islamic perspective. The author’s historical and educational background, as noted under the brief history of the author, points to the author’s ability to address economic issues in general earning and expenditure in particular. Islam memandang hidup sebagai paket yang lengkap, aspek ekonomi menjadi bagian penting darinya. Bidang sistem ekonomi yang paling masuk akal dalam Islam adalah aturan pendapatan dan pengeluaran yang makalah ini menyoroti dari Tanbih As-Sahib Ala Ahkam Al-Makasib. Karya ini mencoba menyoroti ajaran dasar Tanbih as-Sahib ala Ahkam al-Makasib (Memperingatkan Saudara tentang Aturan Penghasilan) oleh mendiang Sultan Muhammad Bello melalui banyak penjelasan tentang aturan Islam tentang penghasilan dan pengeluaran.     The Lahawiyin: Identity and History in a Sudanese Arab Tribe Tamador Ahmed Khalid Abdalla Abstract This thesis is concerned with the Lahawiyin of northern Sudan, and it explores the relationship between identity and history in this Sudanese Arab tribe since the late nineteenth century. The history of the Lahawiyin reveals continuous crossings of borders and boundaries through a period of substantial political and economic change, much of it driven by external forces. The thesis demonstrates that the Lahawiyin Arab identity has been central to the way that Lahawiyin leaders have sought to develop and maintain their authority, and the ways in which ordinary Lahawiyin have tried to maintain a particular way of life and patterns of social relations. Arab identity has been used instrumentally to make claims or assert rights; but it has also shaped the way in which Lahawiyin have understood their interests. The emphasis on Arab identity has been closely linked to the prolonged campaign by some Lahawiyin for a homeland (dar), and in the way that Lahawiyin have negotiated their subordinate status within larger Arab confederations – first the Kababish, then the Shukriyya. It has also shaped Lahawiyin relationships with their own subordinates, particularly slaves. Though the Lahawiyin campaign for a dar has not been successful, and their lifestyle of most Lahawiyin has now changed irrevocably away from pastoralism, Arab identity has continued to be important in current contests over the political status of potential leaders, and the group as a whole. The thesis makes use of a range of archival sources in the UK National Archive, in Sudan Archive at Durham and at the National Records Office in Khartoum. During the fieldwork various academic sources were consulted in Khartoum and Gedarif which form an important aspect of the narratives together with the many stories which were generated from the oral histories told by the Lahawiyin. Using these materials, the thesis discusses how the Lahawiyin, have utilized their Arabness, and the way they present their history, to negotiate their status with a series of regimes, from the Turco-Egyptian state of the nineteenth century to the current regime of the National Congress Party
