Il diritto di whistleblowing come impegno sociale: tra generazioni di diritti e tecniche di tutela
Il presente contributo intende offrire una lettura del diritto di whistleblowing in chiave di capability, ovvero come diritto capacitante del senso civico della persona, della sua capacità trasformativa del mercato e dell’ambiente sociale in cui vive, attraverso l’esercizio critico della libertà di espressione, sancita dall’art. 10 della Convenzione Europea dei diritti dell’uomo, dall’art. 11 della CDFUE e dall’art. 21 Cost. Dopo avere inquadrato l’istituto nella cornice teorica della libertà come impegno sociale, il contributo si soffermerà su alcune questioni interpretative della Dir. 2019/1937/UE, per come recepita nel d.lgs. 10 marzo 2023, n. 24. Lontana dall’essere un mero esercizio filosofico, invero, la razionalizzazione del diritto di whistleblowing in un’ottica di capability si collega all’obiettivo di dare risposta ad alcuni profili problematici di una figura normativa complessa, destinati ad emergere nel prosieguo dello scritto, sviluppando al contempo una più ampia riflessione sulla evoluzione delle tecniche di tutela giuslavoristiche difronte alla crisi di effettività delle categorie e delle istituzioni fondative della materia

This article is concerned with the role of social partners in shaping the green economy. By reviewing a number of best practices the Author explores the strategic role of social partners in outlining the green agenda and driving the economy towards more sustainable pathways. Linking variable pay to green objectives represents an effective incentive for workers and management to implement green practices. Collective bargaining on green salary is therefore regarded as a key instrument in greening the workplaces. Moreover, the dynamism of the green labour market requires actions aimed at promoting vocational education and training as well as anticipating future skill needs. In this connection, social partners are supposed to play a crucial role too
The Shift Towards Single-employer Bargaining in the Italian Car Sector: Determinants and Prospects at Fiat
This paper examines decentralized collective bargaining in the Italian car industry. Its intention is to explain why the Italian vehicle manufacturer FIAT has recently moved from multi-employer to single-employer bargaining, and whether this trend may be relevant to other sectors in the future. The author argues that the “FIAT phenomenon” is likely to remain an isolated one and that the company will probably revert to multi-employer bargaining. A number of institutional and economic determinants are considered in support of this argument

L’articolo esamina il rapporto tra standard di tutela in materia di ambiente di lavoro e tutela ambientale. Attraverso un’analisi retrospettiva sull’evoluzione dei due apparati normativi, l’Autore discute i limiti e le opportunità di un approccio integrato al rischio ambientale, nell’ambito del quale si innesta una rilettura dell’obbligo di sicurezza in chiave di sostenibilità. L’articolo valorizza il ruolo dell’autonomia collettiva nel decostruire la contrapposizione tra lavoro, salute pubblica e ambiente.The article investigates the relationship between the legislation on work environment and environmental protection standards. By conducting a retrospective analysis on the evolution of both normative domains, the Author discusses the limits and opportunities of an integrated approach to environmental risks, suggesting a reinterpretation of occupational health and safety legislation in terms of sustainability. The role of collective autonomy in deconstructing the trade-off between labour, public health and the environment is emphasized
From Fixed to Flexible? Wage Coordination and the Collective Bargaining System in Italy
This article analyses the rules on wage coordination and their effectiveness in the Italian two-tier bargaining system. It seeks to cast light on bargaining coordination by starting from the analysis of collective agreements, rather than focusing exclusively on normative and institutional aspects of wage bargaining. Accordingly, the study examines a dataset of 498 company-level collective agreements concluded between 2012–2015 in three sectors – metalworking, food, banking and finance – to analyse wage developments in company-level bargaining. The study considers the extent to which local wage negotiations are consistent with the rules on wage bargaining coordination laid down in economy-wide agreements and national collective labour agreements. Wage coordination rules are generally respected, though a significant number of company-level agreements still provide fixed-rate pay rises in breach of the rule that wage increases at company level should be linked to productivity and other factors relating to the workers’ and/or the firm’s economic performance. Although the violation of wage bargaining rules between national agreements and company-level collective agreements is in line with the favourability principle, it is argued that local negotiations on fixed-rate pay rises could be regarded as a form of uncoordinated decentralization, diminishing the effectiveness of horizontal coordination policies and the normative role of the social partners
Conversione ecologica degli ambienti di lavoro, sindacato e salari
Questa ricerca si propone di indagare il ruolo svolto dalle istituzioni di relazioni industriali nel processo di efficientamento energetico degli ambienti di lavoro e della produzione. Precisamente, l’A. spiega come e perché il sindacato e la contrattazione collettiva contribuiscano non solo a favorire il processo di conversione ecologica del lavoro, ma a renderlo più equo e partecipato, assicurando un impatto positivo sui salari dei lavoratori. Per rispondere a queste domande, è stata utilizzata la metodologia del case study, indagando tre casi di aziende che hanno introdotto per via contrattuale sistemi premianti collegati al raggiungimento di obiettivi verdi, come l’efficienza e la conservazione energetica.The aim of this paper is to analyse the role of the industrial relations institutions in the ecological conversion of working environments and productions. The research question underpinning it is how and why trade unions and collective bargaining contribute to the greening of workplaces, and to make this process more just and participated, guaranteeing a positive impact on wages. To answer this question, the Author designs a cross-case synthesis on three case studies of companies that negotiated collective agreements where variable pay is linked to green objectives, such as energy efficiency and energy conservation
Classification of Language Interactions
Context: the presence of several languages interacting each other within the same project is an almost universal feature in software development. Earlier work shows that this interaction might be source of problems. Goal: we aim at identifying and characterizing the cross-language interactions at semantic level.% among artifacts written in different languages. Method: we took the commits of an open source project and analyzed the cross-language pairs of files occurring in the same commit to identify possible semantic interactions. We both defined a taxonomy and applied it. Result: we identify 6 categories of semantic interactions. The most common category is the one based on shared ids, the next is when an artifact provides a description of another artifact. Conclusions: the deeper knowledge of cross-language interactions represents the basis for implementing a tool supporting the management of this kind of interactions and the detection of related problems at compile time
