Social values in some novels of the 'Heimatkunst' movement
The thesis compares the values and attitudes promoted in the fiction
of five authors associated
with the 'Heimatkunst' movement. The introduction
attempts a definition of the term 'Heimatkunst' and then proceeds
to
an
examination of the theoretical writings of Adolf Bartels and Friedrich
Lienhard, indicating the often considerable differences in attitude between
the two critics and outlining such common ground as they share with each other
and the "practitioners of
the movement treated in this study. The thesis
then moves to an analysis of single novels, where necessary relating these
works to their authors' other writings. The novels chosen for analysis are
Wilhelm von Polenz' Der Büttnerbauer, Adolf Bartels' Die Dithmarscher, Gustav Frenssen's Jörn Uhl, Ludwig Ganghofer's Der hohe Schein and Hermann
Löns's Der Wehrwolf. These analyses confirm the existence
of
that common
ground between the authors outlined in the introduction - their veneration
of rural life and their suspicion of urban culture and values, their anti-
intellectual bias, nationalist or racialist sympathies and their belief
that contemporary ills may be cured or ameliorated
by
a return to the
pre-industrial, nature-based values of the rural community. The manner,
degree and consistency with which they commit themselves to these attitudes
and views vary and there are certain preoccupations common
to
only some
of the authors dealt with, although even these differing concerns can often
be related to individual interpretations
of
shared premises. The thesis
concludes with an examination of common stylistic and technical features
of their fiction and the literary devices employed to direct the reader's
sympathies
The adsorption of peroxynitric acid on ice between 230 K and 253 K
Peroxynitric acid uptake to ice and snow has been proposed to be a major loss process from the atmosphere with impacts on the atmospheric oxidation capacity. Here we present results from a laboratory study on the interaction of peroxynitric acid with water ice at low concentration. Experiments were performed in a coated wall flow tube at atmospheric pressure and in the environmentally relevant temperature range of 230 K to 253 K. The interaction was found to be fully reversible and decomposition was not observed. Analysis based on the Langmuir adsorption model showed that the partitioning of peroxynitric acid to ice is orders of magnitude lower than of nitric acid and similar to nitrous acid partitioning behavior. The partition coefficient (<I>K</I><sub>LinC</sub>) and its temperature dependency can be described by 3.74 × 10<sup>&minus;12</sup> × <I>e</I><sup>(7098/<I>T</I>)</sup> [cm]. Atmospheric implications are discussed and show that the uptake to cirrus clouds or to snow-packs in polar areas is an important sink for peroxynitric acid in the environment

Competing Theories of Blackmail: An Empirical Research Critique of Criminal Law Theory
Blackmail, a wonderfully curious offense, is the favorite of clever criminal law theorists. It criminalizes the threat to do something that would not be criminal if one did it. There exists a rich literature on the issue, with many prominent legal scholars offering their accounts. Each theorist has his own explanation as to why the blackmail offense exists. Most theories seek to justify the position that blackmail is a moral wrong and claim to offer an account that reflects widely shared moral intuitions. But the theories make widely varying assertions about what those shared intuitions are, while also lacking any evidence to support the assertions.
This Article summarizes the results of an empirical study designed to test the competing theories of blackmail to see which best accords with prevailing sentiment. Using a variety of scenarios designed to isolate and test the various criteria different theorists have put forth as “the” key to blackmail, this study reveals which (if any) of the various theories of blackmail proposed to date truly reflects laypeople’s moral judgment.
Blackmail is not only a common subject of scholarly theorizing, but also a common object of criminal prohibition. Every American jurisdiction criminalizes blackmail, although there is considerable variation in its formulation. The Article reviews the American statutes and describes the three general approaches these provisions reflect. The empirical study of lay intuitions also allows an assessment of which of these statutory approaches (if any) captures the community’s views, thereby illuminating the extent to which existing law generates results that resonate with, or deviate from, popular moral sentiment.
The analyses provide an opportunity to critique the existing theories of blackmail and to suggest a refined theory that best expresses lay intuitions. The present project also reveals the substantial conflict between community views and much existing legislation, indicating recommendations for legislative reform.
