Restoring Democracy in a Multiracial Society. Comments on Steven Levitsky’s “The Third Founding: The Rise of Multiracial Democracy and the Authoritarian Reaction Against It”
No full textIn this brief Essay, I present six comments to Steven Levitsky’s lecture. I suggest that the author (1) clarify some of the basic concepts he uses in his text, particularly the concept of democracy; (2) not confuse the problems of democracy with the problems of constitutionalism; (3) take more centrally into account the problem imposed on our democracies by the existence of profound political and social inequalities; (4) extend and specify some of the institutional reforms he suggests in his text, particularly related to the Senate; (5) pay attention to the structural nature of the problems that are presently affecting the American political system; and (6) review his proposal to reinvigorate majority rule, in light of his defense of a multiracial democracy.Fil: Gargarella, Roberto. No full textEste trabajo realiza una revisión crítica sobre el libro de Cristina Lafont, Democracia sin atajos, abordando tres de los temas tratados allí por la autora: el valor de los “mini-públicos” en el contexto de una radical crisis de representación, como la que vivimos; el problema democrático que plantea la intervención de los tribunales en la decisión (final) de controvertidos asuntos de interés público (una intervención que Lafont alienta enfáticamente en su trabajo), y los límites propios de una visión que propone reducir el papel de la ciudadanía a una intervención destinada a presentar “desafíos” frente a las decisiones tomadas por las autoridades públicas.This is a critical review of Cristina Lafont’s work, Democracy without Shortcuts. Law and punishment: from criminal injustice to social justice
No full textEn el trabajo se argumenta que en situaciones de profunda desigualdad e injusticia social, el Estado pierde autoridad para seguir ejerciendo su poder coercitivo en materia penal. Se argumenta a favor de que en situaciones tales se examine el poder coercitivo del Estado con una presunción negativa en cuanto a la validez del uso del mismo, y en la medida en que las injusticias señaladas se prolonguen en el tiempo.The main idea of the article is that in situations of profound inequality and social injustice, the State’s authority to exercise its coercive powers in the area of Criminal Law is undermined.
