Watanabe\u27s theta graph diffeomorphism, constructed using Watanabe\u27s clasper surgery construction which turns trivalent graphs in 4-manifolds into parameterized families of diffeomorphisms of 4-manifolds, is a diffeomorphism of representing a potentially nontrivial smooth mapping class of . The (1,2)-subgroup of the smooth mapping class group of is the subgroup represented by diffeomorphisms which are pseudoisotopic to the identity via a Cerf family with only index 1 and 2 critical points. This author and Hartman showed that this subgroup is either trivial or has order 2 and explicitly identified a diffeomorphism that would represent the nontrivial element if this subgroup is nontrivial. Here we show that the theta graph diffeomorphism is isotopic to this one possibly nontrivial element of the (1,2)-subgroup. To prove this relation we develop a diagrammatic calculus for working in the smooth mapping class group of .16 pages, 11 figure

O presente trabalho cuida do tema A contumácia do autor, à luz do processo civil brasileiro, e tem por finalidade suscitar as hipóteses em que o autor poderia ser considerado contumaz (ou revel), em um processo que se instaurou por sua própria iniciativa, por meio de uma petição inicial que consubstancia o exercício do direito de ação. Verificou-se a necessidade de estudo e aprofundamento do tema, uma vez que na grande maioria da produção acadêmica sobre a inatividade das partes geralmente se limita ao estudo da falta de resposta do réu (revelia) e seus efeitos e, mesmo nesses pontos, algumas releituras devem ser feitas à luz das recentes modificações legislativas no processo civil. Poucos se dedicam ao tema em trabalhos monográficos, sobretudo com os olhos voltados à posição do autor contumaz, e o tratamento legislativo é insuficiente para sanar dúvidas e perplexidades encontradas na doutrina e na realidade forense. Assim, por meio de uma revisão bibliográfica e de pesquisa doutrinária, legislativa e jurisprudencial, no direito brasileiro atual e em perspectiva histórico-evolutiva, além de buscar referenciais também no direito estrangeiro, busca-se desenvolver a pesquisa para uma melhor compreensão do tema e a construção de soluções teóricas e práticas. Conclui-se que o tratamento legislativo, doutrinário e jurisprudencial ainda depende de um melhor enfrentamento das questões envolvendo a contumácia das partes, notadamente do autor, sendo necessário adequar as consequências da contumácia com valores e princípios reinantes no processo civil, tais como o tratamento isonômico entre as partes, a observância do contraditório e a primazia do julgamento do mérito, a fim de assegurar um acesso a uma ordem jurídica justa aos sujeitos do processo, sejam eles autores ou réus.The present work is about the subject The defaulting author in Brazilian civil process Law, and has the purpose to enumerate the hypotheses in which the author could be considered defaulting, in a process that´s began from on his own initiative, by offering a complaint which constitutes the exercise of the right of action. It was verified the need to study and deepening the subject, since in the great majority of the academic production on the subject of inactivity of the parties is usually limited to the study of the defendant\'s lack of response and its effects, and even on these points, some re-reading should be made looking at the recent legislative changes in the civil procedure Law. Few are dedicated to the subject in monographic works, especially focusing on the position of the defaulting author, and the legislative treatment is insufficient to cure doubts and perplexities found in doctrine and forensic reality. Thus, through a bibliographical and doctrinal review, legislative and jurisprudential research, in current Brazilian law and in a historical-evolutionary perspective, in addition to seeking references also in foreign law, we seek to develop research for a better understanding of the subject and the construction of theoretical and practical solutions. It is concluded that the legislative, doctrinal and jurisprudential treatment still depends on a better confrontation of the issues involving the parties\' inability, in particular the author, and it is necessary to adapt the consequences of the default judgment with values and principles reigning in the civil process, such as the isonomic treatment to the parties, the observance of the adversary principle and the primacy of the judgment on merits, in order to ensure access to a fair legal order to the subjects on the proceedings, whether authors or defendants
