    According to the Islamic feminists, several Muslim-majority countries have seen in recent years a wave of gendered policies which prosecute as arab. zina, or fornication (that is, extramarital sexual intercourse), various types of behavior. This has paradoxical results especially concerning rape: often, victims of rape get sentenced (even to death), while the rapists, if prosecuted at all, get acquitted. From the Islamic feminist point of view, the “zina ordinances” are a consequence of a patriarchal (and non-religious) ideology, which considers women as mere sexual objects. The author points out that the same patriarchal treatment of women seems to emerge from some criminal judgments involving Muslim women and Muslim men, issued by European courts in relation to cultural defense

    La prospettiva di genere, che indaga sulle costruzioni e sulle rappresentazioni delle identità, ha investito da tempo i diversi campi del sapere (dalla sociologia all’architettura, dal diritto alla filosofia, dalla medicina all’economia), eppure ancora oggi pare avere un ruolo marginale e comunque controverso negli studi in ambito religioso. Il rapporto tra le istanze femministe, la prospettiva di genere, l’elaborazione queer e la riflessione teologica sembra, infatti, ancora molto complesso e spesso intriso di conflittualità. A fronte di una letteratura oramai molto ampia e consolidata, nonché di una discussione partecipata sull’intreccio tra i diversi orientamenti, esistono, come è noto, ancora diversi movimenti e correnti ideologiche di opposizione che invece rimandano alle letture più conservatricidei testi sacri e delle tradizioni religiose, ribadendo in vario modo la condanna nei confronti di quei soggetti che rivendicano nuovi spazi, protagonismi e libertà all’interno della sfera religiosa.For some time now a gender studies perspective investigating the processes through which identity is constructed and represented has permeated various fields of knowledge (from sociology to architecture, law to philosophy, medicine to economics). However, it still appears to play only a marginal and controversial role in religious studies, understood in its most diverse articulations and manifestations. It therefore seems that relations among feminist claims, gender studies perspectives, queer insightsand theological reflection remain highly complex and often steeped in conflict. While on one side the literatureis by now extensive and well established, accompanied by anactive discussion about the intertwining of different orientations, on the other side,as is well known, there are also various oppositional movements and ideological currentswhiccontinue to insist onthe most conservative interprea-tionsof the sacred texts and religious traditions, reiteratingin various ways that the subjects claiming new spaces, visibility and freedom in the religious sphere deserve only condemnation
