    The essay analyses the rules of protection of the agribusiness sector that have been approved by the European Union with the aim of ensuring the liberty of consumers to make an informed choice, having in mind the notion of “average consumer” and, in particular, the mandatory labelling information system. The author identifies some of the weak points of the contractual model of new formalism, observing how consumers do not always adopt a rational behaviour, because their choice can be guided by cognitive mistakes. Therefore, when lawmakers approve new rules, they must pay greater attention to the internal psycological mechanisms of consumers; these are well known by companies which use them to plan their marketing strategies. That is the only way lawmakers can ensure the circulation of safe food products and the effective protection of consumers

The author asks himself about the possibility of invoking the dignity not only in cases where it is necessary to protect people's lives but also as a general principle that can guide the personal choices when they affect and have consequences on the legal position of the other. The respect for human dignity is then invoked in order to justify the prohibition of the uterus for rent (surrogate motherhood), by providing additional topics to understand the reasoning of the European Court of Human Rights

The essay analyzes some critical points of the law and, above all, the difficulties of exact legal qualification of the supply of food. There are many differences from the definition of donation of the Italian Civil Code that make it impossible to apply the provisions of the Civil Code to the convey of foodstuffs. The author examines the problems of food waste in Europe and criticizes the solution of the French law punishing companies who do not comply with the obligation to transfer non-sold foods against waste instead of giving incentives to virtuous behaviors

    Il contributo esamina alcuni modelli di gestione dei domini collettivi, dotati di personalità giuridica privata, ai sensi della legge n. 168/2017, mostrando le contraddizioni che il legislatore ha lasciato irrisolte. L'analisi approfondisce l'utilizzo del modello di forme speciali di cooperative previste da quattro Regioni e la possibilità di utilizzare la struttura degli enti senza scopo di lucro regolata dal libro primo del Codice Civile. In particolare, l'autore ritiene che l'assenza dell'elemento personale nelle fondazioni non costituisca alcun ostacolo alla gestione dei beni in proprietà collettiva.The essay examines some models for the management of collective domains, endowed with private legal personality, under Law No. 168/2017, showing the contradictions that the legislator has left unresolved. The analysis delves into the use of the model of some special forms of cooperatives provided by four Regions, and admits the possibility of using the structure of non-profit entities regulated by the first book of the Civil Code. The author considers that the absence of the personal element in foundations does not constitute any obstacle to the management of assets in collective ownership

    Il mercato agroalimentare nell'era digitale innanzi all'emergenza Covid-19

    La pandemia ha posto il mondo davanti ad una crisi globale. I più recenti studi hanno evidenziato che, al pari degli altri virus respiratori, la trasmissione del Covid-19 avviene prevalentemente attraverso le vie aeree, mentre il rischio di infettarsi attraverso il consumo e la manipolazione di alimenti o imballaggi rimane molto basso. Tuttavia, le esigenze di distanziamento sociale hanno spinto le imprese a pensare soluzioni innovative per lo svolgimento dell’attività lavorativa in modalità online e a trovare forme alternative per il trasporto e la distribuzione delle merci. Questa riflessione ha influenzato molti settori, compreso l’ambito agroalimentare, sia per quanto riguarda le fasi di preparazione degli alimenti, sia per quanto riguarda le modalità di fornitura e trasporto del cibo. Di fronte ai numerosi problemi dell’emergenza sanitaria, l’utilizzo delle nuove tecnologie, come ad esempio la blockchain o la tecnologia IoT, può certamente assicurare molti vantaggi alle aziende che producono alimenti. L’autore approfondisce i vantaggi derivanti dall’utilizzo delle nuove tecnologie nel settore dell’industria agroalimentare, ritenendo necessario un aggiornamento normativo che tenga conto dell’ampia possibilità di soluzioni concrete che le nuove tecnologie permettono oggi, in tema di: responsabilità del produttore, trasparenza della filiera agroalimentare, corretta informazione dei consumatori, ma anche nell’ambito della lotta alle pratiche commerciali sleali tra le imprese concorrenti. Nonostante i vantaggi offerti dalla nuova tecnologia, la dottrina giuridica rimane scettica e continua ad utilizzare le categorie giuridiche tradizionali per spiegare i nuovi fenomeni, mentre per l’autore sarebbe più opportuno adottare metodologie e soluzioni giuridiche inedite, maggiormente compatibili con la moderna evoluzione scientifica e tecnologica.The pandemic has confronted the world with a global crisis. The most recent studies have shown that, like other respiratory viruses, transmission of Covid-19 is mainly airborne, while the risk of infection through the consumption and handling of food or packaging remains very low. However, the need for social distancing has prompted companies to think about innovative solutions for carrying out their work online and to find alternative forms of transport and distribution of goods. This reflection has influenced many sectors, including the agri-food sector, both in terms of food preparation and the way food is supplied and transported. Faced with the many problems of the health emergency, the use of new technologies, such as blockchain or IoT technology, can certainly provide many advantages for food producing companies. The author explores in depth the advantages deriving from the use of new technologies in the agrifood industry sector, considering it necessary to update regulations that take into account the wide range of concrete solutions that new technologies allow today, in terms of: producer responsibility; transparency of the agri-food supply chain; correct consumer information, but also in the fight against unfair commercial practices among competitors. Despite the advantages offered by the new technology, the legal doctrine remains sceptical and continues to use traditional legal categories to explain the new phenomena, while for the author it would be more appropriate to adopt new methodologies and legal solutions, more compatible with modern scientific and technological evolution
