Au-delà de la frontière. La Charte de Lampedusa, un exemple de récriture des droits contre la logique de l’enfermement
No full textThe paper describes the elaboration of the Charter of Lampedusa. It focuses on the political and geopolitical upheavals of 2014, paying particular attention to the evolving humanitarian-military devices of border management and controls deployed in the Euro-Mediterranean area. Borders are analyzed not only with respect to their function of geographic separation, but also as social, cultural, and economic markers. The objectives and limits of the Charter are explored in light of its capacity to represent an alternative vision against the political, economic, social and cultural predominant model in Europe. It is argued that this model needs to be completely restructured. The alternative vision offered by the Charter of Lampedusa is based on an inclusive and bottom-up conception of human rights, and opposes the instrumentalization of human rights as well as the adoption of a purely humanitarian paradigm.Le présent article décrit l’élaboration de la Charte de Lampedusa1 et analyse les bouleversements politiques et géopolitiques qui ont suivi son écriture, en parallèle avec les évolutions des dispositifs humanitaires-militaires de création, de gestion et de contrôle des frontières dans la zone euro-méditerranéenne. Les frontières sont considérées à partir de leur fonction de séparation ; une séparation qui n’est pas seulement géographique, mais également sociale, culturelle, économique, et qui l’est aussi à l’intérieur des limites nationales. Potentialités et limites de la Charte sont ainsi évaluées à la lumière de sa capacité de représenter un cadre de référence encore actuel, aspirant à construire une vision alternative au modèle politique, économique, social et culturel prédominant en Europe ; un modèle qui aujourd’hui nécessite plus que jamais d’être complètement déstructuré. Cette vision alternative est imaginée à partir d’une conception des droits inclusive et « par le bas », qui s’oppose à leur histoire d’instrumentalisation institutionnelle, et à leur « réduction » dans le paradigme de l’humanitaire

No full textL'articolo presenta i principali risultati raggiunti dal Progetto «I diritti umani delle persone in condizione di povertà», promosso e portato avanti dalla Divisione Ricerca e Sviluppo della Coesione sociale del Consiglio d’Europa tra il 2010 e il 2013.
La necessità di un approccio politico del tutto nuovo alla povertà è stato il primo presupposto da cui ha mosso il progetto che ha potuto contare sulla collaborazione di decine di esperti provenienti da molti dei 47 paesi dell’Europa della Cedu, attivi in ambito accademico-universitario, sindacale, dell’associazionismo, nonché di persone che a vario titolo possono essere considerate testimoni diretti della povertà contemporanea. Gli sforzi congiunti di tutti i partecipanti hanno portato alla pubblicazione della Guida "Vivere in dignità nel XXI secolo. Povertà e diseguaglianze nelle società dei diritti umani: il paradosso delle democrazie", che chi scrive ha avuto l’onore e la responsabilità di comporre e curare armonizzando e integrando i testi dei vari esperti elaborati a partire dalle decine di riunioni che si sono susseguite nell’arco del progett

No full textDopo avere illustrato brevemente i principi che sostanziano il diritto d'asilo, e la loro centralità all'interno del sistema dei diritti umani, il saggio analizza le politiche migratorie contemporanee per come agiscono ai confini dell'Unione europea, in special modo nel Mare Mediterraneo, e, in Italia, dopo l'ingresso sul territorio dei e delle richiedenti asilo. Queste politiche si dimostrano incompatibili con il rispetto dei principi dell'asilo, ed anzi strutturalmente improntate alla loro violazione, mettendo a rischio la tutela e l'esercizio delle libertà e dei diritti non solo per le persone migranti

No full text“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
