    When science and the criminal process come into contact, cognitive mechanisms are set in motion aimed at reorganizing knowledge belonging to worlds other than the legal one. In this context, the actors of the trial scene are forced to move on a hybrid terrain in which judicial epistemology and scientific epistemology mix. Such a fascinating picture pushes the scholar of the criminal process to seek interpretations suitable for explaining the multiple dilemmas that the phenomenon entails. Starting from a historical-legislative excursus of the expert evidence, the proposed analysis examines the different channels through which expert knowledge enters the process, starting from the investigative phase, and reserves a special focus on digital forensics and forensic genetics, to reach the most guaranteed contexts, such as the preliminary hearing and the public trial. Before arriving at the decision control system, the analysis dwells on the evaluation and decision-making moments. It is precisely here that the judge in the presence of the expert, in order to rationally carry out his function of ius dicere, is required to use a language free of lexical ambiguities, thanks to which science and law interact, communicating in a dimension of full awareness of one's own epistemological boundaries

    Starting from the book "Trial to the Prison," edited by A. Donadio, the author reflects on the stakes of the penal execution phase, which she defines as "restored freedom," and connects it to the important and numerous contributions gathered in that work. The concept, which embraces a broad vision of freedom, combines the re-educational dimension of punishment, understood as the necessary rehabilitation of the convicted person, with respect for their inviolable rights. It refers not simply to the prisoner's physical release, but to a journey toward freedom that also encompasses psychological freedom, understood as autonomy and mental independence, and therefore the ability to make informed and autonomous decisions, as well as moral freedom, which entails dignity and the ability to self-determination without subtle incursions by the authorities. Then, the Author addresses the hot topic of the life imprisonment, in which "restored freedom" is invoked as a new constitutional parameter to overcome the rigid preclusionary mechanism for access to alternative measures provided for by Article 4-bis of the penitentiary rules

    La necessità di un equilibrio tra “certezza della pena” e “rieducazione del condannato” postula che la pena consista in un trattamento umano e rispettoso della dignità della persona. Posta tale premessa, l’Autrice mette in relazione il fenomeno della sovrappopolazione carceraria con i principi che stanno a base della cooperazione giudiziaria, di cui il MAE rappresenta la prima concretizzazione, per rilevarne le possibili alterazioni dei rapporti tra le autorità giudiziarie, in particolare quando si tratta di accogliere o rifiutare la consegna del condannato a pena detentiva. In tale contesto sembra apprezzabile il nuovo approccio della Corte di Lussemburgo che, nella decisione del 5 aprile 2016, ha, dapprima elevato a valore guida, nelle decisioni di consegna, la dignità e il connesso divieto di trattamenti inumani e degradanti di cui all’art. 3 CEDU, e dopo, tracciato iter e presupposti affinché il rifiuto di eseguire il MAE da parte dello Stato di esecuzione possa essere validamente espresso.     Con la decisione dell’8 novembre 2016, la Corte di Giustizia (Grande Sezione), nel procedimento penale a carico di Ognyanov, ha ritenuto che l’art. 17, commi 1 e 2 della decisione quadro 2008/909 / GAI del Consiglio, del 27 novembre 2008, in tema di reciproco riconoscimento delle sentenze penali che irrogano pene detentive o misure privative della libertà personale, come modificata dalla decisione quadro 2009/299 / GAI del Consiglio, del 26 febbraio 2009, deve essere inteso nel senso di impedire l’applicazione di una norma nazionale che autorizzi lo Stato di esecuzione a concedere alla persona condannata una riduzione di pena a motivo del lavoro da essa svolto durante la sua detenzione nello Stato di emissione, quando le autorità competenti di quest’ultimo Stato, conformemente al diritto dello stesso, non hanno riconosciuto siffatto beneficio. Il diritto dell’Unione – ha affermato la Corte – deve essere interpretato nel senso che un giudice nazionale è tenuto a prendere in considerazione le norme del diritto interno nel loro complesso e a interpretarle, quanto più possibile, conformemente alla decisione quadro 2008/909, al fine di conseguire il risultato da essa perseguito, disapplicando, ove necessario, di propria iniziativa, l’interpretazione accolta dal giudice nazionale di ultima istanza, allorché la stessa non risulti compatibile con la legislazione europea. Secondo l’Autrice l’interpretazione adottata dalla Corte di Lussemburgo non è convincente. Non ravvisandosi un contrasto tra le normative, i giudici europei, nel caso di specie, avrebbero, infatti, inopportunamente, invocato il primato del diritto dell’Unione sul diritto interno più favorevole
