No full textABSTRACT: A term unique in the jurisprudential literature appears in PS. 4, 9, 8: Latina ingenua. The fragment – taken from the Breviarium Alaricianum – probably refers to the Latin daughter or descendant from Latini Iuniani. Therefore, the condition of these kind of Latini (who have not been granted the Roman citizenship in 212 A. D.) was transmitted across the time, from generation to generation. We know nothing about their rights; our available sources do not allow to speculate about it. Nevertheless, we can assume that part of the human material used to stabilise the colonate was constituted by freedmen coming from the Latini Iuniani and their descendants

No full textI propose an examination of Nino Tamassia’s thesis, contained in a book entitled ‘Testamentum militis e diritto germanico’. Its basic premise relies on the absence of the idea of testamentary succession in the Barbarian populations. In the osmotic process of combination between Roman culture and barbaricum Tamassia finds elements of continuity between testametum militis (where there wuold be a trace of pre-Roman Italic law) and the affirmation of the principle of testamentary succession which was applied by in thoose constellations of gentes who populated the territories beyond the Rhine and the Danube. In particular, my analysis focuses on investigation of the title 46 of Pactus legis Salicae (De adfathamire), in which Tamassia detects an analogy with the Roman ‘fedecommess

No full textQueste ricerche, dedicate alle Pauli Sententiae – un’opera di controversa paternità a dispetto del fatto che una costante tradizione d’età tardoantica l’attribuisca al giurista Giulio Paolo – si propongono di dimostrare, attraverso un’analitica disamina esegetica, che i loro contenuti corrispondono perfettamente al pensiero giuridico severiano.
L’indagine si suddivide in due parti. Nella prima si prendono in esame il quadro storiografico, le vicende della tradizione testuale, nonché la fortuna tardoantica dei libri sententiarum. La seconda, invece, si rivolge all’esame esegetico dei passi che propongono, con varie formulazioni, la dicotomia honestiores / humiliores. Chiude il volume una rilettura critica delle ipotesi di Ernst Levy e di Detlef Liebs, con un bilancio sulle proposte storiografiche rimaste a contendersi il campo

Nel ripercorrere un siffatto itinerario il volume che, qualche decennio fa, raccolse gli scritti di Giuseppe Grosso in materia di cose e di diritti reali mi è servito da guida preziosa.In this paper I propose to reconstruct the paths followed by Italian legal science to elaborate the character of prediality in the so-called General provisions of Title VI of Book II of the Civil Code in force.
In retracing such an itinerary, the volume which, a few decades ago, collected the writings of Giuseppe Grosso on the subject of things and real rights has served as a valuable guide for me
