    Jelen dolgozat röviden bemutatja a hitellevél egyedi hasznosságát, különös tekintettel a kereskedelmi hitellevélre, és felhívja a figyelmet a hitellevél rendszerében tapasztalható hiányosságokra, így a csalásra és az ilyen területek szabályozásának igazságtalanságára Vietnámban. A dolgozat leírja a kereskedelmi hitellevéllel való tranzakciók során a felek jogait és kötelezettségeit, valamint a hitellevél alapvető szabályait. Az értekezés bemutatja az erkölcstelen felek által okozott, dokumentumokkal történő félrevezető gyakorlatokat, amelyek kifizetéseket tesznek lehetővé kötelezettségeik teljesítése nélkül. Ezek a csalárd tevékenységek olyan körülményeket tükröznek, amelyek veszélyeztetik a dokumentumokon alapuló hitelrendszer stabilitását. Ezenkívül a disszertáció elemzi az ilyen csalárd tevékenységekkel foglalkozó hivatalos szabályozásokat néhány konkrét országban, valamint adott államok bíróságainak álláspontját. A dolgozat megvizsgálja a csalás szabályozásának hatását és integrálását a hozzáadott érték láncokba. Nemzetközi szabályozások mellett a szerző a nemzeti egységesítő rendszerekre is fókuszál, amelyek a csalás szabályozását tartalmazzák. Például az Egyesült Államokban érvényes, csalásra vonatkozó szabályokat, mint a Közös Kereskedelmi Kódex, szintén bemutatja a dolgozat. Emellett megvizsgálja a Kínai Népköztársaság csalást érintő szabályozását és a vonatkozó jogeseteket. Ezután a disszertáció ismerteti Vietnam mostani gazdasági helyzetét a kereskedelmi hitellevél alkalmazása tekintetében, ideértve a jelenlegi szabályozásokat és legutóbbi jogi döntéseket. Az írás rámutat ezen jogterület hiányosságaira Vietnam-ban, a legújabb döntések és a vietnami jogesetek bemutatásán keresztül. Ezek a jogesetek a vietnami bíróságok álláspontját fogják tükrözni a hitellevéllel történő csalásokkal, valamint a felek jogaival és kötelezettségeivel kapcsolatban. Ezután a szerző megkísérel ajánlásokat tenni a jelenlegi helyzet alapján Vietnámban. This thesis intends to briefly introduce the unique utility of letters of credit, which specifically focus on commercial letters of credit, and introduce the inadequacies in the system of letters of credit concentrating on fraudulent activities and presenting the shortage of justice in regulating such areas in Vietnam. The rights and obligations of parties in the transactions of commercial letters of credit will be described in this thesis as well as the cornerstone rules of letters of credit. The thesis will exhibit the exercise of unscrupulous parties misleading documents and obtaining payments without performing duties. Such fraudulent activities illustrate circumstances that jeopardize the stability of the documentary credit system. This dissertation also emphasizes the official regulations dealing with such fraudulent activities in some specific countries as well as the opinions of their courts. The thesis will explore the impact of fraud rules and their integration into value chains. Besides international regulations, the author shall focus on the national uniforms regulating fraud rules. For example, the United States regulations regarding fraud rules which is the Uniform Commerce Code will be embodied in this thesis. Furthermore, this thesis also illustrates and examines the regulations and case law of the People’s Republic of China relating to fraud rules. The dissertation then shall further mention the recent economic situation of Vietnam regarding the application of commercial letters of credit, including the current regulations and the recent legal judgments. The lack of law in this field in Vietnam is also expressed through this study by presenting the recent decisions and the Vietnam case law. This case law shall perform the point of view of the Vietnam People’s Courts toward fraud in letters of credit as well as the right and duties of parties. Then, the author shall try to give recommendations based on the current situation in Vietnam

    Seismic activity characteristics in the East Sea area

    In this paper, seismic activity characteristics in the East Sea area was analyzed by authors on the base of the unified earthquake catalog (1900-2017), including 131505 events with magnitude 3 ≤ Mw ≤ 8.4. The seismic intensity in the East Sea during the period 1900-2017 is characterized by the earthquake representative level Mw = 4.7. The strong earthquake activity in the East Sea area clearly shows the regularity in each stage. In the period from 1900 to 2017, the East Sea area has four periods of strong earthquake activity, each stage is nearly 30 years with particular characteristics. The distribution of the maximum earthquake quantities by years has a cyclicity in all four periods. In each stage there are 1-2 strong earthquakes with Mmax ≥ 8.0. The strong earthquakes with Mmax ≥ 7.5 have occurred by a repeatable rule of 3-5 years in all four stages. This allows the prediction of the maximum earthquake repeat cycle of Mmax ≥ 7.5 in the study area is 3-5 years. In other hand, the maximum magnitude values for the East Sea region has assessed by GEV method with several different predict periods (20, 40, 60, 80, 100 years), with predicted probability 80%.     The emerging legal framework for private sector development in Viet Nam's transitional economy

    A major objective of Viet Nam's transition to a market economy has been to reactivate the private sector in a mixed economy. Several new laws have been introduced in the past five years to implement this policy and to create an enabling environment for the private sector. The author reviews some of the more important laws and regulations that affect Viet Nam's private sector activities, including laws on real property, intellectual property, companies, domestic investment, foreign investment, bankruptcy, contracts, and dispute resolution. Anti-monopoly law has not yet been introduced in Viet Nam. The issue of competition is addressed in the context of trade law, the relative roles of the state and private sector, and restrictions in company law. These areas all establish the foundation of a legal framework for a market economy. The author concludes that Viet Nam's legal framework, like China's, is still influenced by ideology, which causes problems in such areas as private ownership of real property and with such fundamental legal concepts as"due process of law."It is noted that the private sector is constrained by the lack of an independent judiciary, the absence of private land ownership, other uncertainties in property law that limit the develpoment of financial markets, and the inherent bias of the system in favor of the state sector (and collective ownership). Also noted is a law-abiding attitude, equally important to development has been slow to develop. The author goes on to point out that the foreign investment process is too complicated, and its company law too restrictive. A first priority should be to strreamline regulations, as well as liberalize trade policy and increase efforts in privatization of state enterprises. In this respect the author notes that export processing zones may be a useful interim instrument to attract foreign investment but should be phased out over time.     Algorithm and program for earthquake prediction based on the geological, geophysical, geomorphological and seismic data

    By applying an improved  method of the Earth's crust classification, we develop an algorithm and build an earthquake prediction program using a combination of geological, geophysical, geomorphological and seismic data.This program includes a system of multiple windows with different functions, which can divide fault zones into the different segments by the maximum magnitude values Mmax. Using the constructed program, we carried out an earthquake prediction test for the Northwest Vietnam by a combination of geological, geophysical, geomorphological and seismic data. According to the received results, zoning maps of maximum earthquake prediction for the researched region has been established. The results show that the   areas, capable of generating earthquakes with Mmax = 6.5 - 6.8  are primarily concentrated along some major fault zones such as Lai Chau-Dien Bien, Son La, Song Ma, Song Da, Tuan Giao or near the intersection of these fault zones.     The load and operational speed of trains on railway bridges play a significant role. In the context of increasing demand for rail transport, accurately determining these parameters not only helps ensure safety but also brings economic benefits and optimizes system efficiency. This research aims to determine the load and speed of trains based on dynamic displacement results obtained from sensors installed on railway bridges. The study was applied on a real urban railway bridge. The dynamic displacement data of the railway bridge under the influence of passing trains is collected using high-sensitivity LVDT sensors. By applying finite element models (FEM) and real-time displacement data analysis combined with optimization algorithms, the estimation of train load and speed is performed. The analysis results show that the estimated load and speed values are relatively accurate compared to reality. This method helps to accurately monitor and manage train load and speed.     The load and operational speed of trains on railway bridges play a significant role. In the context of increasing demand for rail transport, accurately determining these parameters not only helps ensure safety but also brings economic benefits and optimizes system efficiency. This research aims to determine the load and speed of trains based on dynamic displacement results obtained from sensors installed on railway bridges. The study was applied on a real urban railway bridge. The dynamic displacement data of the railway bridge under the influence of passing trains is collected using high-sensitivity LVDT sensors.
