Problems about enforcement
The modern culture is constructed according to dualistic and holistic approaches. However, the neurosciences question the value or weight of a single personality greater than its recognition, especially through two concepts or discoveries: the existence of the so-called "extended" mind and the acknowledgement of the role of the so-called social intelligence, or even of the "social brain". This change certainly places the individual in a relationship with the world which is in some ways different from the past. The most important innovation of the nineteenth century was indeed constituted by the arrival of new studying methods applied to public law, borrowed from the scientific and above all sociological positivism and it was not instead, as it is often believed, constituted by the Liberal Constitutions. Within this tumultuous "progress" the neuroscientific discoveries are kind of a "Copernican Revolution" because they question the free will link that had created the illusion of a possible dialogue on equal terms among the human beings. The mere inclusion of the neuroscientific discoveries in the system in force is undoubtedly something important, but it could reveal itself as risky and from this perspective the author analyzes the legal capacity and the ability to act and he tries to establish a new theory rooted on the importance of the species
Neuro Law: Validity and Limits of a Neuroscientific Approach to Problems Relating to Law and justice
In a not too far past, the so-called cognitive neuroscience started to spread its influence also over issues regarding law and justice, arousing a general interest. As a consequence, a new expression, neurolaw has been coined. The author used to point out that an imprecise generalization should not be applied to the ontological problems of law and justice and that they instead should be kept separated. Starting from the basis of Descartes' thought, the author underlies how this construction was challenged about a century ago by the psychoanalysis, which demonstrated that human actions are strongly conditioned by the unconscious impulses.The essay continues to throw some light on the paths leading to both the comprehension and the use of single disciplines, first, the different branches of law.Thus, the author shows how difficult it is today to deal with the subject of the interpretation which-together with the efficiency of the juridical system-is still now the core of the legal world and in particular in the fields of the philosophy of law, in the general theory and in the so-called juridical dogmatic
Public Law and Private Law Issues
In this chapter, the author outlines some of the issues that, from an exclusively subjective point of view, seem to be more relevant in the field of public law. The possible consequences "neurolaw" might have on a branch of law like this cannot be overlooked, because this branch is anyway decisive, not only for the fate of an individual, but also for the destiny of the human population in general at the local, national and global level. The scope of this chapter is to attract the reader's attention on the assumptions at the basis of the changes that are presently taking place in the juridical tradition of the western world using neurolaw that can play a useful part in all these changes

Neurodiritto
Questo volume realizza il primo tentativo in Italia di fondare su basi giuridiche una ipotesi di neurodiritto. Come è noto, tale nuova disciplina, afferente all’amplissimo settore delle c.d. scienze cognitive, ha già da tempo larga diffusione nel mondo, soprattutto nell’area anglosassone, dove peraltro la maggior parte dei contributi sembra privilegiare gli aspetti dedicati al diritto penale e al processo penale. In realtà, se si presta adesione alla tesi neurofenomenologica, l’approccio unitario non può trascurare indicazioni su altre branche del diritto altrettanto importanti quali ad esempio il diritto privato e commerciale, il diritto costituzionale e amministrativo. Tuttavia, dato che non è possibile in epoca di globalizzazione scindere l’analisi giuridica da altre scienze (un tempo denominate sociali) e soprattutto dal settore psicologico-giuridico, lo sviluppo del volume è integrato in tal senso.
Lo scopo di questo lavoro è verificare come ed in che misura le Neuroscienze rappresentino un vero e proprio spartiacque epistemologico che probabilmente è destinato a mutare profondamente gli stessi concetti giuridici fondamental
I beni culturali di interesse religioso nella nuova legislazione statale: le innovazioni nell'Intesa con la Conferenza episcoipale italiana
La nuova Intesa tra il Ministro per i Beni e le Attività culturali ed il Presidente della Conferenza episcopale italiana si è resa necessaria a seguito dell’entrata in vigore del d.lgs. 22 gennaio 2004, n. 42 (Codice dei beni culturali e del paesaggio) e della l. cost. 18 ottobre 2001, n. 3 (modifiche al Titolo V della Costituzione).
Sul piano strutturale il documento, in diverse circostanze, ripropone i contenuti sostanziali dell’Intesa del 1996 (che trascurerò in quanto diffusamente trattati dalla dottrina) ma in più punti «aggiorna» e «integra», per usare la stessa terminologia adottata in sede di sottoscrizione, i contenuti della precedente Intesa. Pertanto in questa sede cercherò di evidenziare e circoscrivere alcune criticità di sistema, se tali saranno anche nelle applicazioni, in rapporto alle intervenute innovazioni legislative
