Formalizing Land Rights: Liability of the Indonesian Land Agency for the Loss of Vital Archives
The research aims to determine the role of vital archives for registration of land rights in realizing legal certainty for freehold over land and the form of liability of the National Land Agency for loss of vital archives. The research was a socio-legal research using a descriptive method. To analyze the data, the researcher processes and analyzes qualitatively. The results show that the vital archive for land registration has a very important role in the legal certainty of land rights. It is a data record of land registration that connects the land owner with his/her land. In addition, vital archive is an evidence of the truth of the procedure for the issuance of land certificates as well as an evidence of the correctness of land ownership by right holders. The form of liabilities of the National Land Agency for the loss of vital archive for land registration is administrative, civil and criminal liabilities. But unfortunately, this has not been regulated in the legislation in the agrarian sector. Until now, the application of these liabilities can be done based on the archive’s laws. Environmental Policy, Public Health and Human Rights: Assessing the Regional Regulation on Waste
Everyone has the right to a good and healthy environment as part of human rights. Hence, to actualize the right to a good and healthy environment, the community or everyone has the right to environmental information related to the role in environmental management. The research is a socio-juridical. The results show that the management of human environment in Manado is implemented through the establishment and implementation of local regulations. The issuance of local regulations related to environmental law enforcement are local regulations on Environmental Protection and Management; Domestic Wastewater Management; and Waste Management and Cleaning Service Fees. However, the three local regulations have not been implemented optimally. Even the local regulation on the Waste Management and Cleaning Service Fees provides regulations that are not in accordance with the needs of the community in waste management and not in accordance with the laws and regulations related to waste

PENGATURAN PEGAWAI NEGERI SIPIL (PNS) BERISTRI LEBIH DARI SEORANG DITINJAU DARI PERATURAN PEMERINTAH NOMOR 45 TAHUN 1990 TENTANG IZIN PERKAWINAN DAN PERCERAIAN BAGI PNS
Tujuan dilakukannya penelitian ini adalah untuk mengetahui dan menganalisis bagaimana pengaturan dan kesesuaian ketentuan izin bagi Pegawai Negeri Sipil untuk beristri lebih dari seorang dalam perundang-undangan dan untuk mengetahui apa sanksi yang akan diterima oleh Pegawai Negeri Sipil yang beristri lebih dari seorang tanpa izin. Dengan menggunakan metode penelitian yuridis, disimpulkan: 1. Pengaturan mengenai izin bagi Pegawai Negeri Sipil untuk beristri lebih dari seorang terdapat dalam pasal 4 ayat (1) Peraturan Pemerintah Nomor 45 Tahun 1990. Permintaan izin diajukan kepada pejabat melalui saluran hierarki dari instansi yang bersangkutan dan dalam ketentuan ini memungkinkan Pegawai Negeri Sipil pria untuk beristri lebih dari seorang apabila telah memenuhi persyaratan yang ada yaitu sekurang-kurangnya salah satu syarat alternatif dan ketiga syarat kumulatif. 2. Bagi Pegawai Negeri Sipil yang melakukan pelanggaran yaitu beristri lebih dari seorang tanpa izin dijatuhi salah satu jenis Hukuman Disiplin berat berdasarkan Peraturan Pemerintah Nomor 94 Tahun 2021 yang terdiri atas penurunan jabatan setingkat lebih rendah selama 12 (dua belas) bulan, pembebasan dari jabatannya menjadi jabatan pelaksana selama 12 (dua belas) bulan dan pemberhentian dengan hormat tidak atas permintaan sendiri sebagai Pegawai Negeri Sipil.

Aspek Hukum Hak Kepemilikan di atas Laut
The issuance of Land Ownership Certificates in Indonesian maritime areas presents significant administrative legal issues due to the lack of alignment between land and maritime law. According to the Basic Agrarian Law and maritime regulations, sea areas cannot be privately owned. The issuance of SHAT in maritime areas, especially without proper reclamation procedures, potentially violates the principle of legality. Conflicts of authority between the National Land Agency (BPN) and the Ministry of Marine Affairs and Fisheries frequently arise, resulting in legal uncertainty and significant ecological impacts. Regulatory harmonization and stricter oversight are required to ensure environmental sustainability and social justice.
Penerbitan Sertipikat Hak Atas Tanah di wilayah perairan Indonesia menimbulkan persoalan hukum administrasi yang signifikan, karena tidak adanya keselarasan antara hukum pertanahan dan hukum kelautan. Berdasarkan Undang-Undang Pokok Agraria dan regulasi kelautan, wilayah laut tidak dapat dijadikan objek hak milik individu. Penerbitan SHAT di wilayah laut, terutama tanpa proses reklamasi yang sah, berpotensi melanggar asas legalitas. Konflik kewenangan antara Badan Pertanahan Nasional dan Kementerian Kelautan dan Perikanan sering kali terjadi, menimbulkan ketidakpastian hukum dan dampak ekologis yang merugikan. Diperlukan harmonisasi regulasi dan pengawasan yang lebih ketat untuk memastikan keberlanjutan lingkungan dan keadilan sosial.
