    No full text
The Author seeks to demonstrate that the impact of the eurozone’s financial crisis onthe European social model is due both to scarce capacity of the EU political institutionsin managing that crisis and to the fact that, in the last decade, the launch of theEuropean social model was not accompanied with the political conditions aimed atmeeting the challenges posed from a powerful non-regulated global financial market. To this end, after having exposed the main features of the EU economic governance, the author draws attention on the instruments (Six pack, Fiscal Compact, ESM) recentlyadopted from the EU or its single member States with the aim of reacting to thefinancial crisis.

This is the Author’s presentation at the Conference held on 10 December 2018 at the Sapienza University of Rome in memory of Professor Leopoldo Elia in the tenth anniversary of his death (5 October 2008). It is devoted to Elia’s conception of constitutional time, with the aim of demonstrating that, without giving an explicit theory of the issue, time was crucial in Elia’s thought on the constitution. To this end, the author affords an account of a series of Elia’s contributions, concerning both political institutions and constitutional justice

    No full text
he Author seeks to demonstrate that Bartolo da Sassoferrato, a cele- brated Italian jurist of the Middle Age, anticipated notions and cathegories that will become common in modern times. ‘Sovereignty’ is perhaps the most im- portant of these cathegories, although a strong effort is needed to contextualize the use of such word in Bartolo’s thought. The paper attempts to show that such effort is required even with respect to the question of how Bartolo distinguished the exertion of power according of whether it amounted to a tyrannical use

The essay seeks to demonstrate that the current theoretical divide between ‘neo-constitutionalists’ and ‘positivists’ leaves open the question of how to deal with the main constitutional issues of our age, with particular respect to those arising from the increasing tensions between courts and legislators. At this regard, the author points out that the exertion of discretionary powers from judges should not be evaluated just on substantial grounds, but, first and foremost, from the perspective of whether traditional procedural restraints on the judicial activity have been respected

The author provides a theoretical account of the relationship of the vast phenomenon of ‘globalisation’ with constitutionalism.
