    The essay is concerned with Gazprom case: it considers not only the decision by the ECJ, but more generally the whole dispute between Gazprom and the Lithuanian Ministry of Energy, taking place before both the arbitral Tribunal, whose seat is in Stockholm, and the Lithuanian courts. In particular, the A. critically analyses the “anti-suit award”, with which the arbitral Tribunal ordered to the Ministry of Energy to renounce to some claims in the proceedings it started before the Lithuanian courts. Then the ECJ judgment on the case is taken into consideration, in which the Court hold that Regulation (EC) No 44/2001 must be interpreted as not precluding a court of a Member State from recognising and enforcing, or from refusing to recognise and enforce, an arbitral award prohibiting a party from bringing certain claims before a court of that Member State. The A. points out that the decision has two differents rationes decidendi. The first one is based on the scope of application of the principle of mutual trust, limited to the relations between the courts of different Member States, with the exclusion of the relations between a national court and an arbitral Tribunal. The second one (more pragmatic and, on the A.’s view, preferable) takes into consideration the differences between an anti-suit injunction issued by a national court (relevant in West Tankers’ case), whose effectiveness is granted by the contempt of court’s sanctions and the “anti-suit award”, whose effectiveness is not guaranteed in any way

    This essay is concerned with the West Tankers saga after the decision of the European Court of Justice, examining the different procedural means by which West Tankers tries, on the one hand, to sanction the alleged breach of the obligation to arbitrate by Allianz and Generali, on the other, to “neutralize” the effects of any future Italian judgment, declaring the liability of West Tankers vis-à-vis the insurers. The author focuses his attention particularly on the judgment of the English High Court, holding that an arbitral tribunal is not deprived, by reason of European law, of the jurisdiction to award damages for breach of the obligation to arbitrate, agreeing with such a decision, although for different reasons. The last part of the essay investigates which damages should be awarded to West Tankers, distinguishing on the basis of the different possible outcome of the Italian proceedings

    This case-note is concerned with a recent judgment of the ECJ, in which it was held that a jurisdiction clause, agreed in the contract concluded between the manufacturer of goods and the buyer thereof, cannot be relied on against a sub-buyer who brings an «action directe » for damages against the manufacturer, unless it is established that that third party has actually consented to that clause under the conditions laid down in Article 23 Regulation Brussels I.     Nella sentenza annotata le Sez. un. non hanno risolto la questione, loro rimessa, sul se il convenuto, costituitosi in un giudizio straniero, che ivi non abbia sollevato l’exceptio iurisdictionis, possa poi, nel processo italiano di riconoscimento della sentenza resa all’estero, far valere il difetto della competenza internazionale indiretta del giudice che ha pronunciato la decisione, in base all’art. 64, lett. a), L. n. 218/1995. La S.C. ha all’uopo rilevato che nel caso di specie, ove si discuteva del riconoscimento di una misura di protezione di un minore, trovava applicazione la Conv. dell’Aja del 19 ottobre 1996 sulla protezione dei minori, e non invece la L. n. 218/1995. Nella nota anzitutto si criticano le Sez. un. per aver omesso di pronunciarsi sulla questione loro rimessa, oggetto di uno dei motivi di ricorso, sulla base dell’operatività in casu della cit. Conv., poiché ciò poteva aver rilievo soltanto a valle del riscontro della fondatezza di quel motivo, imponendo la correzione della motivazione ex art. 384, 4° comma, c.p.c., anziché la cassazione della decisione impugnata. Il commento affronta poi la questione non risolta dal S.C., giungendo alla conclusione che la mancata eccezione di difetto di giurisdizione, da parte del convenuto costituitosi nel processo straniero, non preclude a questi di contestare, nel giudizio italiano di riconoscimento della sentenza pronunciata all’estero, la sussistenza della competenza internazionale indiretta, ma comporta di regola l’infondatezza di una simile contestazione, poiché si è qui in presenza di una accettazione tacita della giurisdizione, che in Italia normalmente costituisce criterio attributivo della competenza giurisdizionale, in forza dell’art. 4, 1° comma, ult. parte, L. n. 218/1995
