    Impresa, territorio e responsabilità sociale. Il caso dell’industria chimica

    L’attività di impresa ha effetti positivi e negativi sull’ambiente e sul territorio. In questo contesto un ruolo chiave è giocato dalla responsabilità sociale delle imprese poiché già nella fase di creazione del valore è possibile generare esternalità positive per la società. Il presente articolo si propone di spiegare perché oggi i temi dell’impresa, territorio e responsabilità sociale siano così attuali e perché la teoria degli stakeholders offra una prospettiva interessante, in relazione sia ai principi che propone sia al processo attraverso cui viene applicata. Attenzione è rivolta al caso del settore della chimica per il quale la responsabilità sociale è strettamente legata alla dimensione ambientale dello sviluppo sostenibile. Per raggiungere tale obiettivo, viene brevemente descritto il rapporto tra impresa e territorio e alcuni elementi di teoria e di prassi legati al fenomeno della responsabilità sociale dell’impresa.     On a Babuška Paradox for Polyharmonic Operators: Spectral Stability and Boundary Homogenization for Intermediate Problems

    We analyse the spectral convergence of high order elliptic differential operators subject to singular domain perturbations and homogeneous boundary conditions of intermediate type. We identify sharp assumptions on the domain perturbations improving, in the case of polyharmonic operators of higher order, conditions known to be sharp in the case of fourth order operators. The optimality is proved by analysing in detail a boundary homogenization problem, which provides a smooth version of a polyharmonic Babuska paradox

Japan (Amami Islands), Samoa and Tuamotus to New Caledonia, Loyalty Islands and Western Australia, west to Mauritius, sand and stones, and under coral slabs, intertidal to 60 m, in our material confirmed live to <i>ca</i> 30 m.</p> <p> <b>Description.</b> Shell claviform, adult length to 12 mm, breadth/length 0.40–0.41, aperture/total length 0.40–0.43, with coeloconoid spire, drawn apex and truncate base. Teleoconch of 6–7 whorls of somewhat angulated outline; concave subsuturally with periphery at whorl's mid-height. Suture wavy, adpressed to previous whorl. Base broad, shallowly indented with distinct fasciole in adult shells. Outer lip with wide indistinct stromboid notch; anal sinus widely open U-shaped. No subsutural cord or sulcus. Terminal varix situated about 1/ 4–1/5 whorl behind lip. Axial ribs strong, opisthocline, on last whorl extended to parietal area and reaching fasciole, but indistinct on subsutural slope. Last adult whorl with 10–13 axials. Fasciole with 4–5 coarse, declivous ridges, entire shell surface covered with dense, collabral growth lines.</p> <p>Background colour light grey or yellowish, with lighter projections of axials. Whorl peripheries and shell base with intricate pattern of reddish or brown lines. Whorls peripheries fringed with fine brown lines with interstices between axial elements also coloured brown and one fine spiral line overriding axials. Similar brown chain-like band situated on parietal area of shell, and another one marks fasciole.</p> <p>Protoconch (Fig. 13 F–G) cylindrical-domed, of two smooth whorls, except very fine incremental lines in lower part of second whorl. Diameter about 710 Μm, height about 670 Μm. Protoconch-teleoconch transition indistinct, marked by change in suture morphology and appearance of strong axial rib.</p> <p> <b>Radula</b> (Fig. 12 C, D): Rachidian very narrow, length nearly three times exceeds width, with rounded slightly convex anterior edge, with strong median cusp and fine side denticles. Lateral teeth medium broad, arcuate, with 13–14 cusps, 2nd–4th from inner side being the longest and gradually diminishing in length towards outer side, where they evanesce. Marginal teeth medium long, narrow, with slightly broader long blade. Blade edges very weakly thickened. Accessory limb broad, weak.</p> <p> <b>Remarks.</b> This well-known species has been described and figured by Cernohorsky (1978) and Wells (1991). It is characterised by its glossy surface and vivid colour pattern of dark brown spiral lines on a yellowish or brown ground. New Caledonian examples of <i>C. lamberti</i> appear to be mostly paler than those from the central west Pacific, and several examples are uniform white. Largest and smallest adult from New Caledonia: 10.5 x 4.3 mm; 7.3 x 3.3 mm.</p> <p> The type figures of <i>Pleurotoma mariei</i> appear to show a very pale or bleached example of <i>C. lamberti</i>. Supporting evidence is provided by a label accompanying a sample of <i>C. lamberti</i> received from Marie himself, now in the MacAndrew collection (NHMUK); this is annotated “= <i>mariei</i> Crosse ”.     Il contributo, premesso l’inquadramento giuridico della fattispecie civilistica del contratto di appalto, affronta le problematiche giuslavoristiche relative al divieto di dissociazione tra titolarità formale ed effettiva utilizzazione della prestazione di lavoro evidenziando la problematicità dell’accertamento dei requisiti di genuinità dell’appalto. Avvalendosi dei consolidati arresti giurisprudenziali, l’A. si sofferma sui presidi approntati dall’ordinamento per la tutela dei lavoratori impiegati in appalto, dalla responsabilità solidale per crediti retributivi e contributivi alle tutele esperibili in caso di successione di appalti. Un focus particolare viene dedicato alla posizione del committente in relazione agli obblighi di sicurezza nell’appalto e alle sanzioni conseguenti ai casi di uso non conforme della fattispecie giuridica.The contribution, starting from the legal framework of the civil case of the procurement contract, addresses the labor law problems connected to the prohibition of dissociation between formal ownership and actual use of the work performance, highlighting the difficulties in verifying the genuineness requirements of the contract. Making use of consolidated jurisprudential guidelines, the Author focuses on the safeguards set up by the law for the protection of workers employed on contracts, from joint liability for salary and contribution credits to the protections available in the event of succession of contracts. A particular focus is dedicated to the position of the contractor in relation to the safety obligations in the contract and the sanctions resulting from cases of non-compliant use of the legal case

    We discuss a few old results concerning embedding theorems for Campanato and Sobolev-Morrey spaces adapting the formulations to the case of domains of class C0,γ, and we present more recent results concerning the extension of functions from Sobolev-Morrey spaces defined on those domains. As a corollary of the extension theorem we obtain an embedding theorem for Sobolev-Morrey spaces on arbitrary C0,γ domains
