    This paper starts out from a semantic question to investigate the relationship between the state and its territory: what is the meaning (denotatum, Bedeutung) of the phrase ‘state territory’? In order to answer the question, the author explores three concepts of territory: (i) territory as part of the state, (ii) territory as sphere of validity and (iii) territory as figmentum. ‘Figmentum’ is a neologism coined by the author to mean a figment, or entity produced by legal norms

    L'articolo concerne l'ontologia e l'epistemologia delle entità sociali. Secondo il filosofo austriaco Hans Kelsen (1881-1973), le entità sociali e istituzionali sono le sole entità che possono essere nulle, vuote. Il punto di partenza di questo articolo Il Nullo e il Nulla è l'analisi della testi di Hans Kelsen. Ma: Perchè le entità sociali sono le sole entità a poter essere nulle, vuote ? Per rispondere a questa domanda, nella prima parte dell'articolo, l'autore introduce due nuovi concetti: imperfezione-di-validità e falsificazione- di-validità. La seconda parte dell'articolo pone una nuova domanda ontologica: Le entità sociali nulle (vuote) sono qualcosa?The article concerns ontology and epistemology of social entities. According to the Austrian philosopher Hans Kelsen (1881-1973), social and institutional entities are the only entities that can be null, void.     This paper examines Adolf Reinach’s views about negative states of affairs. The author briefly presents the history of the issue from the Middle Ages to the 20th century. The views of Reinach and Roman Ingarden are compared. A special focus is ascribed to the problem of omissions in the legal sense.
