    Round Table: implementing the EU Directive on adequate minimum wages in southern Europe: the odd case of Italy

    Southern European countries, with their apparently high degree of collective bargaining centralisation and state regulations, may seem to be little affected by the EU Directive on adequate minimum wages. This article looks at the case of Italy, the EU country generally reported to have the highest collective bargaining coverage in Europe, to show how the situation on the ground is more problematic than conventional indicators suggest. Not only does Italy lack a national minimum wage and a legal framework for collective bargaining extension, but its apparent high level of collective bargaining coverage is vulnerable to wage dumping practices. The article identifies the weaknesses of the Italian system and proposes some possible lines of reform. © The Author(s) 2023

    Il contributo analizza criticamente le disposizioni della legge di bilancio 2022 (art. 1, commi 224237, l. n. 234/21) finalizzate a garantire la continuità produttiva e occupazionale in caso di chiusura di azienda con cessazione definitiva dell’attività (cd. norme «anti-delocalizzazioni»). L’analisi fa emergere la debolezza dell’impianto normativo, il cui apparato sanzionatorio (anche dopo le modifiche operate con il cd. decreto Aiuti-ter) è privo di efficacia deterrente e non intacca il principio dell’insindacabilità delle scelte imprenditoriali poste a base dei licenziamenti collettivi, anche quando sono ispirate da fini meramente speculativi.The essay critically analyzes the provisions of the 2022 Budget Law (art. 1, paragraphs 224-237, Law no. 234/21) aimed at guaranteeing production and employment continuity in the event of company closure with permanent cessation of activity (so called anti-relocation law). The analysis reveals the weakness of the new norms, whose sanctioning apparatus is devoid of deterrent efficacy (despite its tightening by Law Decree no. 144/22) and does not affect the unquestionability of the reasons for the collective dismissals, even when they are inspired by purely speculative purposes
