No full textEl presente proyecto de tesis “Estudio definitivo de la Carretera Cruce C.P. Santeño - C.P. Arbulú - ciudad de Pucalá, Distrito de Tuman, Provincia de Chiclayo, Departamento de Lambayeque”, consiste en la elaboración del estudio a nivel de expediente técnico de la Carretera que une los distritos de Tumán y Pucalá pasando por diferentes localidades tales como Centro Poblado Calupe y Centro Poblado Arbulú. Dicha vía abarca desde el inicio en el distrito de Tumán (cruce C.P. Santeño - km 0+000) llegando hasta la Ciudad de Pucalá (km 8+378.32), existiendo un tramo ramal en el Km 0+370 hacia el C.P. Calupe, (0+000 - 0+736.80). La gran importancia del presente proyecto radica no solo en mejorar la transitabilidad hacia las localidades del lugar y otros destinos del centro y sur del país, sino que también abre paso a un flujo turístico en potencia ya que en el caserío Santa Rosa, existen una huaca con restos arqueológicos en estudio. Con la realización del proyecto se lograría la integración vial de los Centros Poblados Santeño, Arbulú y Calupe, en consecuencia se tendría una adecuada vía para el tránsito de cargas y pasajeros para desarrollar el potencial turístico arqueológico de la Huaca Santa Rosa, además se empalmaría los poblados anteriormente mencionados, dando vida y propiciando desarrollo en el aspecto gastronómico a los Centros Poblados en mención que en la actualidad tienen poca o ninguna acogida gastronómica. Además con la realización del proyecto se tendría una obra vial bien planificada que se traduce en reducciones de los costos operativos de los vehículos, en tiempo y contaminación del ambiente, así como las facilidades para el desplazamiento de los usuarios y en consecuencia menos accidentes y más impulso económico de las zonas por donde atraviesa

No full textNella prima parte della nota, l’Autore analizza la fattispecie di «denuncia di un sinistro non accaduto» di cui all’art. 642, comma 2, c.p., introdotta nel 2002 nell’ambito della riforma delle assicurazioni R.C. Auto, per, poi, affrontare la questione su cui si è pronunciata la Corte di cassazione, relativa al significato da attribuire al concetto di “sinistro”. Infine, l’Autore offre le proprie riflessioni sui rapporti intercorrenti tra la fattispecie esaminata e le altre ipotesi delittuose previste dall’art. 642 c.p. e sulla compatibilità di tali reati con il principio di offensività.In the first part of the note, the Author analyzes the crime of “denunciation of a false accident” that was introduced into the art. 642 c.p. in 2002, and, then, the question about the meaning of “sinistro” (accident) on which the Supreme Court stated. Finally, the Author offers his own reflections on the connection between the examinated crime and other felonies provided under art. 642 c.p., and, also, on compatibility of those crimes with the principle of seriousness of the offense
