Despite of developing, reforming, improving for many years the public procurement system still receives a lot of criticism from both contracting authorities and suppliers who participate in procurement. Public procurement carried out both in the European Union, as well as Lithuania, has a lot of problems, and is rated as one of the most troubled European Union regulated areas. Common change of procurement laws, different application of court rulings cause misunderstandings, which decline the performance and effectiveness of the public procurement system. However, due to the fact that public procurement system is used by public institutions, municipalities, ministries, municipal sector and other institutions that meet the criteria of the Public Procurement Law, it is quite difficult to create public procurement system suitable for all institutions equally. Procurement system performance depends not only on the contracting authorities, but also the suppliers, purchasing consultants, regulators and courts.
